This manual therefore provides a detailed introduction to the key areas of the substantive family law of which the junior practitioner should have a good working knowledge. Key aspects of family law covered include domestic violence, occupation of the family home, care proceedings, ancillary relief and orders under s8 Children Act 1989. In recognition of the increasing desire to avoid costly and lengthy adversarial proceedings, the manual also includes a dedicated chapter focusing specifically on the role of mediation as a tool to resolving family law disputes. Adopting a highly pragmatic approach, Family Law in Practice, encourages students to build on their existing basic practitioner skills, and highlights how to approach writing opinions and drafting documents specific to family law, including consent orders. It also provides invaluable practical advice on how to prepare for different types of hearings, what factors to consider in relation to negotiation, how to make persuasive submissions, and how to handle witnesses effectively, ensuring that the junior practitioner is fully prepared for his or her first steps in the family courts.

Book Synopsis European Human Rights and Family Law by : Shazia Choudhry
Download or read book European Human Rights and Family Law written by Shazia Choudhry and published by Bloomsbury Publishing. This book was released on 2010-04-27 with total page 651 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the potential impact of human rights in the way the law interacts with families. Traditionally family law has been dominated by consequentialist/utilitarian themes. The most notable example of this occurs in the law relating to children and the employment of the "welfare principle". This requires the court to focus on the welfare of the child as the paramount consideration. Hitherto the courts and, to a certain extent, family law academics, have firmly rejected the use of the language of rights, preferring the discretion and child-centred focus of welfare. However, the incorporation of the European Convention on Human Rights via the Human Rights Act now requires family law to deal more clearly with the competing rights that family members can hold. In addition, it is clear that, to date, the courts have largely ignored or minimised the different demands that the HRA imposes on the judiciary and, in particular, judicial reasoning. This book challenges that view and suggests ways in which the family courts may improve their reasoning in this field. No longer can cases be dealt with on the basis of a simple utilitarian calculation of what is in the best interests of the child and other family members - greater transparency is required. The book clarifies the different rights that family members can hold and, in particular, identifies ways in which it may be possible to deal with the clash of rights between family members that will inevitably occur. Whether this requires an abandonment of the utilitarian nature of family law, or a reworking of it, is a theme that runs throughout the book.

Book Synopsis Family Justice Review by : Family Justice Review
Download or read book Family Justice Review written by Family Justice Review and published by The Stationery Office. This book was released on 2011-11-28 with total page 232 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Family Justice Review examines the effectiveness of the family justice system and the outcomes it delivers. The review covers both public and private law cases; explores if better use can be made of mediation and how best to support contact between children and non-resident parents or grandparents; examines the processes (but not the law) involved in granting divorces and awarding ancillary relief, and looks at how the different parts of the family justice system are organised and managed. The review is aiming to produce a system which allows families to reach easy, simple and efficient agreements which are in the best interests of children whilst protecting children and vulnerable adults from risk of harm. The agencies and professionals directly involved in the family justice system are all in scope for the Review. This final report takes into account views expressed during the consultation on the interim report and the call for evidence. It makes a number of recommendations to improve public and private law and looks at how the agencies within the family justice system could work together more effectively to improve the experience for children and families
