Book Synopsis The Exchange Order by : Richard Adelstein
Download or read book The Exchange Order written by Richard Adelstein and published by Oxford University Press. This book was released on 2017-08-31 with total page 289 pages. Available in PDF, EPUB and Kindle. Book excerpt: There are three basic institutional systems for governing the exchange of property. One is consensual: the exchange of property rights in ordinary markets. The other two, however, are nonconsensual: the involuntary exchange of entitlements in either civil or criminal liability cases. In The Exchange Order, Richard Adelstein argues that while markets, torts, and criminal justice are ostensibly different constellations of institutions, organizations and individuals, they are remarkably alike. Each governs a particular kind of exchange through a distinctive set of institutions, rules and procedures. They have all evolved over many centuries from the same root, a deep-seated human propensity to communicate with others through trade, to exchange goods for goods and costs for costs as a means of reconciling opposing interests and increasing personal welfare. They perform the same social function, facilitating individually efficient exchanges of rights and compensatory prices, in very different exchange environments that demand very different institutional responses to the problem all three are in place to solve: identifying efficient transfers and seeing that they are completed. The Exchange Order provides a sweeping historical, comparative, and philosophical analysis of how rights and objects, goods and harms, are exchanged in these apparently very different realms. What unites them is a core norm: take only what you can pay for, and pay for everything you take. In markets free exchange is governed by prices and the willingness to sell or buy. Tort and criminal law apply when consensual exchange is violated. The violation is the non-consensual seizure of entitlements and the payment is a liability price on the taker that compensates the victim for the costs imposed by the taking. Tit for tat, an eye for an eye, is the principle of exchange that unites markets, tort and crime.
Book Synopsis The Commerce of War by : Neil Coffee
Download or read book The Commerce of War written by Neil Coffee and published by University of Chicago Press. This book was released on 2009-08-01 with total page 339 pages. Available in PDF, EPUB and Kindle. Book excerpt: Latin epics such as Virgil’s Aeneid, Lucan’s Civil War, and Statius’s Thebaid addressed Roman aristocrats whose dealings in gifts, favors, and payments defined their conceptions of social order. In The Commerce of War, Neil Coffee argues that these exchanges play a central yet overlooked role in epic depictions of Roman society. Tracing the collapse of an aristocratic worldview across all three poems, Coffee highlights the distinction they draw between reciprocal gift giving among elites and the more problematic behaviors of buying and selling. In the Aeneid, customary gift and favor exchanges are undermined by characters who view human interaction as short-term and commodity-driven. The Civil War takes the next logical step, illuminating how Romans cope once commercial greed has supplanted traditional values. Concluding with the Thebaid, which focuses on the problems of excessive consumption rather than exchange, Coffee closes his powerful case that these poems constitute far-reaching critiques of Roman society during its transition from republic to empire.

Intent on nothing more than holing up in the mountains to let herself mend, she is begrudgingly pulled along by her uncle to join him and his friends for their morning coffee at the local shop.Thinking it is nothing more than a few recent retirees in need of filling the time, it isn't until she arrives that she discovers the gathering is of a much different nature. Joining her uncle, the former town sheriff, is Craig Cobb, a past detective with LAPD, and Lou Tobias, a medical examiner from nearby Riverside. Together, the three men form the Hobby Lobby, a term of affection given to the group that meets each morning to help each other through the various hobby cases each picked up over the course of their careers.Initially seeing the men as nothing more than a curiosity, it isn't until Erika learns of the tragic death of a former classmate that she begins to put stock into what they do. Seeing a lot of herself in the girl she hasn't spoken to in years, she begins to prod at the supposed suicide, looking past the macabre surface at the details surrounding the incident. Details that hint of far greater influences beginning to circle the idyllic mountain town than any of them could have ever imagined...
