Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Essentials of American Government It is somewhat presumptuous to attempt to reduce American Government to its essential principles. The subject is difficult - more or less technical and quite beyond the compass of any one book. Therefore, in writing the present volume, the author cites many books in which the matter under immediate consideration is discussed at length. The rule of rules for the student of American government is Multum, not Multa. There is peril, if only the principle be considered, that what knowledge is gained will be an acquaintance with abstractions; if the example, or illustration alone is considered, the peril is of a memory of facts more or less temporary, or isolated. Government is essentially organic in nature and must be studied as an organism. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from The Essentials of American Constitutional Law But principles are not numerous. Possibly in Nature there is but one basic principle and all our so-called natural laws are but aspects of that principle as the human mind conceives or recognizes it. The analogy in government permits the asser tion that the principles of constitutional law are few. Possibly they are severally aspects of one principle: that of sovereignty. To the student of the law, especially to junior students, principles are matters of memory rather than of understanding. It is a vigorous and essentially mature mind that can reduce a complex issue to such simple form as to deduce the principle on which it rests. Book excerpt: Excerpt from Experiments in Government and the Essentials of the Constitution The people of the United States appear now to have entered upon such a period of re examination of their system of government. Not only are political parties denouncing old abuses and demanding new laws, but essential principles embodied in the Federal Constitution of 1787, and long followed in the constitutions of all the states, are questioned and denied. The wisdom of the founders of the Republic is disputed and the political ideas which they repudiated are urged for approval. Book excerpt: Excerpt from Essentials of American History This work has been prepared to give as thorough a knowledge of the political, industrial, and territorial development of our country as the limits of a grammar-school textbook will allow. It endeavors to Show the part played by all the elements, racial and religious, that have made contributions to American history. The upbuilding of the United States is indeed a wonder ful story. From the days of the Vikings onward the long procession of valiant Spanish, English, French, and Dutch voyagers, missionaries, and colonizers appears on its pages. The Indian tribes are seen in the woods or on the plains, along the rivers and on the Great Lakes. The scenes of our great historic actions were enacted on a stage made up of mighty areas, unrivaled waterways, primeval forests, boundless plains, and towering mountain systems. Through all the story we can see the Slow development of a representative form of government, which, checked - now here and now there - by royal prerogative, at last burst its bonds and emerged a free people. \tile the path of progress of the Republic has ever led onward, it was not without, now and then, a mighty struggle, as in the great Civil when the nation had to decide whether a government constituted as it was would con tinue to exist. The Republic rendered its decision, and then and there entered on a career of advancement unequaled in the history of mankind. Book excerpt: Excerpt from Congressional Government: A Study in American Politics I have been led by the publication of a French translation of this little volume to read it through very carefully, for the first time since its first appearance. The re-reading has con vinced me that it ought not to go to another impression without a word or two by way of preface with regard to the changes which our singular system of Congressional government has undergone since these pages were written. I must ask those who read them now to re member that they were written during the years 1883 and 1884, and that, inasmuch as they describe a living system, like all other living things subject to constant subtle modifi cations, alike of form and of function, their description of the government of the United States is not as accurate now as I believe it to have been at the time I wrote it. The develop ment of our national institutions has been discussed from many points of view: political, historical, and economic. Book excerpt: Excerpt from The New American Government, and Its Work The Theory of Checks and Balances - The great changes just described have all been opposed to the spirit and intentions of the men who drafted our form of government. If there was one fear that animated all members of the Convention of 1787, it was the dread of highly concentrated power. AS Englishmen they had long believed in the doctrine that government should be built up of Checks and Balances, that is, every authority, oflicer or legislative body should have some other authority which would check its power and prevent it from becoming absolute or despotic. One form of this doctrine is the theory of Division of Powers. A brilliant French writer, in a book 1 which was read and studied carefully by influential members of the Convention of 1787, de clared that the division of government into the executive, legisla tive, and judicial departments was a necessary means of preserving the liberty of the citizens against Oppression. His method of rea soning was simple. He asks, in what country is the freedom of the citizen best preserved? At the time of writing England was un doubtedly the freest country in the world. How is this freedom of the citizen secured in England? The author's answer was that the British government at that time separated sharply the executive power of the King from the legislative power of Parliament and the judicial power exercised by judges appointed for life. N 0 other country at that time carried this division of powers as far as did Great Britain. Montesquieu therefore concluded that the division of powers was the most effective means of preserving the liberty of the citizen from government despotism. The Fathers followed this theory faithfully in 1787. The three departments were sepa rated as far as possible, and where their co - operation was necessary, they were set in balance as checks against each other. It will be noticed that the underlying motive of the Fathers was the fear of 7 oppression. Briefly expressed it is: Let us divide governmental power into minute particles, giving a small part to each authority so that none may become supreme or even dangerous.
