Book Synopsis Private Property Rights and the Environment by : Shelly Hiller Marguerat
Download or read book Private Property Rights and the Environment written by Shelly Hiller Marguerat and published by . This book was released on 2019 with total page 477 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book explores the current notion and definition of property, and its interpretation and implementation in relation to the environment. The author examines two primary problems: the degradation of land, natural resources and animal abuse; and the increasing erosion of private property rights from property owners by the arbitrary interference of state governments. Examining texts from antiquity to contemporary legislation, it portrays the historical development of the understanding of "nature" as "property" and discusses our obligations towards the environment. Drawing on the most influential political-philosophical texts from all periods of property rights history, the author analyzes modern national and international legislation and case law to offer legally-grounded evidence and explanations. This book advocates the incorporation of a formula that guarantees the protection of property rights into the legal system, and imposes clear and effective responsibility on property owners to limit the use of natural resources and the abuse of animals. This book will appeal to practitioners, researchers and students with an interest in environmental and private property law.--

Book Synopsis Law's Environment by : John Copeland Nagle

Available in PDF, EPUB and Kindle. Book excerpt: John Copeland Nagle shows how our reliance on environmental law affects the natural environment through an examination of five diverse places in the American landscape: Alaska's Adak Island; the Susquehanna River; Colton in California's Inland Empire; Theodore Roosevelt National Park in the badlands of North Dakota; and Alamogordo in New Mexico. Nagle asks why some places are preserved by the law while others are not, and he finds that environmental laws often have unexpected results while other laws have surprising effects on the environment. Nagle argues that sound environmental policy requires better coordination among the many laws, regulations, and social norms that determine the values and uses of our scarce lands and waters.

This book was released on 2003-01-01 with total page 341 pages. Available in PDF, EPUB and Kindle. Book excerpt: This remarkable new book is not a radical text, but seeks to find a principle of responsible proprietorship in our existing legal systems. And in fact it presents an excellent case for the international recognition of a principle of responsible proprietorship in the title registration systems derived from the German model, rooted in the historical Hanseatic model; primarily the Australian Torrens system that spread throughout the British Empire from the mid-nineteenth century on. In great detail, the author demonstrates that this system offers a firm foundation on which a truly responsible environmental law of property can be established.
Book Synopsis Earth Jurisprudence by : Peter D. Burdon
Download or read book Earth Jurisprudence written by Peter D. Burdon and published by Routledge. This book was released on 2014-09-19 with total page 188 pages. Available in PDF, EPUB and Kindle. Book excerpt: The idea of human dominion over nature has become entrenched by the dominant rights-based interpretation of private property. Accordingly, nature is not attributed any inherent value and becomes merely the matter of a human property relationship. Earth Jurisprudence: Private Property and the Environment explores how an alternative conception of property might be instead grounded in the ecocentric concept of an Earth community. Recognising that human beings are deeply interconnected with and dependent on nature, this concept is proposed as a standard and measure for human law. This book argues that the anthropocentric institution of private property needs to be reconceived; drawing on international case law, indigenous views of property and the land use practices of agrarian communities, Peter Burdon considers how private property can be reformulated in a way that fosters duties towards nature. Using the theory of earth jurisprudence as a guide, he outlines an alternative ecocentric description of private property as a relationship between and among members of the Earth community. This book will appeal to those researching in law, justice and ecology, as well as anyone pursuing an interest more particularly in earth jurisprudence.

Written by ecological law experts, it does this by 1) providing an overview of shortcomings of environmental law and other areas of contemporary law, 2) presenting specific examples of these shortcomings, 3) explaining what ecological law is and how it provides solutions to the shortcomings of contemporary law, and 4) showing how society can overcome some key challenges in the transition to ecological law. Book Synopsis Land Use Law for Sustainable Development by : Nathalie J. Chalifour
Download or read book Land Use Law for Sustainable Development written by Nathalie J. Chalifour and published by Cambridge University Press. This book was released on 2006-11-20 with total page 606 pages. Available in PDF, EPUB and Kindle. Book excerpt: This 2007 book surveys the global experience to date in implementing land-use policies that move us further along the sustainable development continuum. The international community has long recognized the need to ensure ongoing and future development is conducted sustainably. While high-level commitments towards sustainable development such as those included in the Rio and Johannesburg Declarations are politically important, they are irrelevant if they are not translated into reality on the ground. This book includes chapters that discuss the challenges of implementing sustainable land-use policies in different regions of the world, revealing problems that are common to all jurisdictions and highlighting others that are unique to particular regions. It also includes chapters documenting new approaches to sustainable land use, such as reforms to property rights regimes and environmental laws. Other chapters offer comparisons of approaches in different jurisdictions that can present insights which might not be apparent from a single-jurisdiction analysis.

Book Synopsis Land Use Planning and the Environment by : Charles Monroe Haar
Download or read book Land Use Planning and the Environment written by Charles Monroe Haar and published by . This book was released on 2010 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: In Land Use Planning and the Environment, the authors have dramatically revised and updated a classic, seminal casebook, Land-Use Planning. Designed primarily for the classroom, the book takes a comprehensive approach to the teaching of planning and zoning law, regulatory takings, and environmental topics. Throughout the casebook, the authors identify and explore intersections between land use planning law and environmental regulation. They also identify the hidden environmental "agenda" behind exclusionary zoning, the impact of urban sprawl on clean air and critical habitats, and other interconnections. Professors, students, and law and planning practitioners with strong backgrounds and exposure to "traditional" environmental law will find these intersections a wonderful opportunity to examine familiar topics from a fresh perspective. For other users, Land Use Planning and the Environment will serve as a valuable introduction to the environmental realm, a realm that, more than perhaps any other in American law, is subject to swift and dramatic changes that require the most current teaching materials.
Book Synopsis The Philosophical Foundations of Environmental Law by : Sean Coyle
Download or read book The Philosophical Foundations of Environmental Law written by Sean Coyle and published by . This book was released on 2004 with total page 228 pages. Available in PDF, EPUB and Kindle. Book excerpt: Legal regulation of the environment is often construed as a collection of legislated responses to the problems of modern living. Treated as such, 'environmental law' refers not to a body of distinctive juristic ideas (such as one might find in contract law or tort) but to a body of black-letter rules out of which a distinct jurisprudence might grow. This book challenges the accepted view by arguing that environmental law must be seen not as a mere instrument of social policy, but as a historical product of surprising antiquity and considerable sophistication. Environmental law, it is argued, is underpinned by a series of tenets concerning the relationship of human beings to the natural world, through the acquisition and use of property. By tracing these ideas to their roots in the political philosophy of the seventeenth century, and their reception into the early law of nuisance, this book seeks to overturn the perception that environmental law's philosophical significance is confined to questions about the extent to which a state should pursue collective well-being and public health through deliberate manipulation and restriction of private property rights. Through a close re-examination of both early and modern statutes and cases, this book concludes that, far from being intelligible in exclusively instrumental terms, environmental law must be understood as the product of sustained reflection upon fundamental moral questions concerning the relationship between property, rights and nature.

Book Synopsis Property Rights and Climate Change by : Fennie van Straalen
Download or read book Property Rights and Climate Change written by Fennie van Straalen and published by Routledge. This book was released on 2017-09-14 with total page 269 pages. Available in PDF, EPUB and Kindle. Book excerpt: Property Rights and Climate Change explores the multifarious relationships between different types of climate-driven environmental changes and property rights. This original contribution to the literature examines such climate changes through the lens of property rights, rather than through the lens of land use planning. The inherent assumption pursued is that the different types of environmental changes, with their particular effects and impact on land use, share common issues regarding the relation between the social construction of land via property rights and the dynamics of a changing environment. Making these common issues explicit and discussing the different approaches to them is the central objective of this book. Through examining a variety of cases from the Arctic to the Australian coast, the contributors take a transdisciplinary look at the winners and losers of climate change, discuss approaches to dealing with changing environmental conditions, and stimulate pathways for further research. This book is essential reading for lawyers, planners, property rights experts and environmentalists.
