Book excerpt: The large majority of those claiming Jobseeker's Allowance make every effort to find work. But some customers do just enough to meet the conditions of their claim while at the same time continually failing to demonstrate the focus and discipline that is a key requirement of finding, securing and retaining employment. Mandatory Work Activity is being introduced to enable advisers to address this problem, supporting this particular group of customers at the earliest possible stage. But the Committee finds that published evidence is at best ambivalent about the chances of such 'workfare' type activity improving outcomes for people who are out of work. It is worried about the precedent set by appearing to punish claimants who are satisfying the conditionality rules (otherwise they would be subject to a sanction) but who, in the view of a Personal Adviser appear to display what is deemed to be the 'wrong attitude'. The Committee's key recommendation is that the introduction of this scheme should not continue. Its concerns cover the general principles of the proposals; the way participants will be selected; how placements will be structured and monitored; and the sanction regime attached. The Government, however, does not accept the Committee's recommendations or suggestion that the scheme is a punishment, and sets out its reasons for its position. The proposals are to go ahead.

The law and structures of social security are highly complex, made more so by constant adjustments as government pursues its often conflicting economic, political and social policy objectives. This complexity is highly problematic. It contributes to errors in decision-making and to increased administrative costs and is seen as disempowering for citizens, thereby weakening enjoyment of a key social right. Current and previous administrations have committed to simplifying the benefits system. It is a specific objective of the Welfare Reform Act 2012, which provides for the introduction of Universal Credit in place of diverse benefits. However, it is unclear whether the reformed system will be either less complex legally or more accessible for citizens. This book seeks to explain how and why complexity in the modern welfare system has grown; to identify the different ways in which legal and associated administrative arrangements are classifiable as 'complex'; to discuss the effects of complexity on the system's administration and its wider implications for rights and the citizen-state relationship; and to consider the role that law can play in the simplification of schemes of welfare. While primarily focused on the UK welfare system it also provides analysis of relevant policies and experience in various other states.

Book excerpt: The Work and Pensions Committee supports the Government's objectives for the incapacity benefit (IB) reassessment, which are to help people with disabilities and long-term health conditions to move back into employment, while continuing to provide adequate support for people who have limited capability for work or are unable to work. However, the report finds that the Government's positive messages about the IB reassessment are not getting through to the public. The report argues that that the Government should be more proactive in explaining its aims for the process and in emphasising the range of support which will be available. Current incapacity benefit claimants are being reassessed to decide whether they are able to work. The inquiry looked in detail at the Work Capability Assessment (WCA), the test which is used to assess whether an incapacity benefit claimant is capable of work, or work-related activity. WCAs are carried out by Atos Healthcare as part of a contract with the Department for Work and Pensions. It is widely accepted that the WCA was flawed, in the form in which it was introduced in 2008 for new ESA claimants, leading to a high proportion of inaccurate assessments and poor decisions by Jobcentre Plus. Many of these decisions were overturned at appeal. The report acknowledges that many welcome improvements have been made to the reassessment process as a result of the review by Professor Malcolm Harrington and the trial of the process carried out in Aberdeen and Burnley, before it was introduced nationally.

The authors of this remarkable book have chosen to study a powerful indicator of how this trend might affect legal protection and access to justice for individuals: reforms in social security systems as they apply to cases of reduced earnings capacity. While previously the notion of social protection made welfare state inhabitants feel that the risk of loss of income due to physical or psychological hindrances was minimal, this sense of security can no longer be taken for granted. This book presents in-depth analyses, by nine leading scholars in social security law, of recent reforms in the field of incapacity benefits in four European countries: Germany, the United Kingdom, the Netherlands, and Sweden. The authors emphasize how recent reforms in the field of social security have been transformed into legal provisions, how the gate-keeping function is implemented in the legislation of the different countries, and to what extent the reforms have affected the legal position of the individuals concerned. They find that ever-tightening requirements designed to reduce benefit dependency, in combination with policies emphasizing individual responsibilities rather than individual rights, cause increased social risks for exposed groups. Among the specific aspects covered are the following: Measuring the reduction of earnings capacity; rights and obligations attached to reintegration into the labour market; work capability assessment procedures; "rehabilitation chains" with fixed time limits; the real and increased risk of poverty faced by long-term incapacitated persons; constitutional concerns raised by increased dependency on means-tested benefits; conditionality of benefits on work-related activities, participation in training programmes, or active job searching; and sanctions that can be applied if the claimant fails to comply with activation measures. The European dimension is explored with particular reference to anti-discrimination legislation, health and safety law as well as the Open Method of Coordination.
