In default of being beneficial in that case, it was desired to put the result of this work in such form as to renew, in the attention of the profession and the reading public, the great rules for the administration of trusts. In their actual application, they have recently been so disregarded as to lead, in many cases, to the erroneous opinion that practice had established these rules adversely to the principles. As is well known to many, the labor indicated has been made almost the exclusive business of the author of this compilation, from the inception of the suit, in 1864-5, to the present time. In the selection of Leading Cases, I have taken such as have been the result of the most deliberate consideration and labor of the judicial minds whose opinions have given shape and weight to the laws of England and America. In the choice of other cases, I have selected those especially lately decided, which, it is hoped, will prove of practical use to the profession, and still further illustrate the principles of those that have become leading, and are the productions of the "great masters," as it were. The subjects of resulting and constructive trusts, which were not treated in the second edi tion of Ames's Cases, and the subject of charitable trusts, which was not treated in either edition, are of great importance. In these subjects, and indeed in all the subjects treated herein, there has been during the last twenty-five years a wealth of new material from which to draw. The editor cannot adequately express the great debt that he owes to Professor Ames under whom he had the privilege of studying for three years. Only those who have had the same privilege can realize the extent of that debt. The matter con tained in Ames's Cases and also the invaluable ms. Notes which Professor Ames was accustomed to take with him to the class room have been put at the editor's disposal. Book excerpt: Excerpt from Outline of the Law of Trusts, Prepared for the Use of Students This outline is designed for the use of the students of the Brooklyn Law School. It is intended to serve mainly as a guide to the reading of cases, and is in no sense a treatise on the subject. It lacks both the fullness of treatment and original research necessary to such a work. It follows to a considerable extent the lines of two works, Ames' Cases on Trusts and Reeves on Real Property, from both of which many valuable suggestions and ideas have been drawn. In Article III. The plan of the former work has been adopted, and in Articles VIII, IX. And X. It has been followed very closely, the heads and sub-heads having been quoted therefrom as indicated. I am also indebted to the same work for many of the cases cited. Reeves on Real Property has been largely followed in the discussion of express trusts for special purposes, and constructive trusts. Much assistance has also been received from Perry on Trusts, Lewin on Trusts, and the American and English Encyclopedia of Law. The use made of the works of Professor Ames and Professor Reeves, as above stated, has been by their permission, and my thanks are hereby extended for the help thus afforded.
