Download or read book A Mere Machine written by Anna Harvey and published by Yale University Press. This book was released on 2013-11-28 with total page 385 pages. Available in PDF, EPUB and Kindle. Book excerpt: Introductory textbooks on American government tell us that the Supreme Court is independent from the elected branches and that independent courts better protect rights than their more deferential counterparts. But are these facts or myths? In this groundbreaking new work, Anna Harvey reports evidence showing that the Supreme Court is in fact extraordinarily deferential to congressional preferences in its constitutional rulings. Analyzing cross-national evidence, Harvey also finds that the rights protections we enjoy in the United States appear to be largely due to the fact that we do not have an independent Supreme Court. In fact, we would likely have even greater protections for political and economic rights were we to prohibit our federal courts from exercising judicial review altogether. Harvey’s findings suggest that constitutional designers would be wise to heed Thomas Jefferson’s advice to “let mercy be the character of the law-giver, but let the judge be a mere machine.&rdquo
Book Synopsis The Constitution of Sint Maarten by : Hensley G.A. Plantijn
Download or read book The Constitution of Sint Maarten written by Hensley G.A. Plantijn and published by WestBow Press. This book was released on 2020-04-11 with total page 100 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since the birth of Sint Maarten on October 10, 2010, the constellation of the parliament of Sint Maarten has changed multiple times. In The Constitution of Sint Maarten, author Hensley G. A. Plantijn offers a look at the country and its laws and regulations. An expert in constitutional law, Plantijn reviews some key points, providing a look at: • the history of the parliament of Sint Maarten; • maintaining transparency in the elections; • election rights and the election ordinance: • what happens after the elections; and • Article 59 of the constitution. Plantijn discusses that free, transparent, and secret elections are the cornerstones of democracy, and that Article 59 is also part of the system of checks and balances in the parliamentary system. He contends the electorate needs to be aware of the relevant laws and regulations regulating the elections and functioning of the representative parliamentary system.

Download or read book The First Wave written by Loke Hoe Yeong and published by Epigram Books. This book was released on 2019-09-30 with total page 344 pages. Available in PDF, EPUB and Kindle. Book excerpt: Based on extensive interviews and archival material, The First Wave tells the story of the opposition in Singapore in its critical first thirty years in Parliament. Democratisation has been described to occur in waves. The first wave of a democratic awakening in post-independence Singapore began with J. B. Jeyaretnam’s victory in the Anson by-election of 1981. That built up to the 1984 general election, the first of many to be called a “watershed”, in which Chiam See Tong was also elected in Potong Pasir. After their successes in 1991, the opposition began dreaming of forming the government. But their euphoria was short-lived. Serious fault lines in the leading Singapore Democratic Party (SDP) rose to the surface almost immediately after the opposition victories of 1991, and the party was wiped out of Parliament by 1997. The opposition spent the next decade experimenting with coalition arrangements, to work their way back to victory.
Book Synopsis Electoral Justice and Political Culture by : Dai zhicheng
Download or read book Electoral Justice and Political Culture written by Dai zhicheng and published by European University Press. This book was released on 2021-12-15 with total page 186 pages. Available in PDF, EPUB and Kindle. Book excerpt: The election process reflects the essence of the electoral system. The justice of the electoral process can best reflect whether the electoral system is legitimate and democratic. The democratic and legal shortcomings of China's electoral system can be solved by rationalizing and democratizing the electoral process, which is consistent with the realization of justice under the electoral process. In this book, procedural justice is combined with the electoral process to find the conditions and elements needed to achieve more justice in elections. “The electoral system is still based on the political will of the political party to rule, and the electoral system itself has serious legislative problems, which shows that the foundation of China's electoral system has problems. Then China's electoral system cannot truly represent the political voices and political interests of the people in the implementation, and at the same time cannot reflect the fairness of the election in the electoral procedure and the determination of the election results. The People's Congress system and the Political Consultation system simply cannot elect the right representatives who truly represent the interests of the people. The elected government and state power organs are separated from the people's political status, political interests, and development interests in the operation of their duties and the exercise of power.” By analyzing the problems in China's electoral system and election procedures, the book concludes the conditions for the realization of more justice, rationalization, and democratization of China's electoral system and election procedures through procedural justice. The spiritual connotation of procedural justice under the electoral system and election procedures are combined with the traditional Chinese democratic political culture to construct an electoral political culture adapted to the contemporary Chinese political environment, advancing the development of procedural justice in China's electoral system to realize the rationality, legitimacy, and democracy of elections.
