Book excerpt: This research explored the role of the dual-status commander (DSC) construct during imminent and no-notice disasters through the lens of state-level civilian emergency managers through one primary and three subquestions. The main research question was: What are state-level civilian emergency managers? views about the role of the DSC during imminent and no-notice disasters? The DSC construct is designed to improve the unity of effort among federal and National Guard military forces when they are operating within a state during domestic disasters. The DSC has only recently been employed during imminent and no-notice disasters in support of civil authorities. Little research is available regarding the views civilian emergency managers have of DSCs when they are used in these types of disasters. Addressing this gap adds value to the emergency management profession because civilian emergency managers who have not had a complex disaster in their state may lack familiarity with the DSC construct. Through a qualitative method, a purposefully selected sample of state-level civilian emergency managers were surveyed and interviewed. The data informed the research questions, and results provide emergency management and military professions greater understanding of expectations emergency managers have of DSCs. Emergency managers should know in advance how to work with DSCs assigned to support them because DSCs are supposed to improve delivery of military resources in support of relief priorities and objectives. The results from the study are also intended to improve emergency management doctrine and emergency managers? Defense Support of Civil Authorities (DSCA) education programs.

This monograph does exactly that as it carefully and comprehensively analyzes the DSC-led military response to Hurricane Sandy in New York. Through this lens, it illustrates and discusses the perspectives of the DSC construct and offers recommendations for leveraging existing capabilities and improving those deemed insufficient. Using a case study approach, this analysis addresses notable issues of constitutionality, legality, policy, financial considerations, and even politics, all uniquely situated between individual states' interests and those of the federal government. To provide military and defense officials with a greater understanding of the benefits and limitations of the DSC arrangement during a no-notice/limited-notice incident, this monograph offers objective and systematic documentation of the Sandy response. It concludes by offering a series of actionable recommendations aimed at improving operational decisionmaking, policy, and legislation specifically related to DSCs during no-notice/limited-notice incidents.

Why is unity of command important during response operations? Joint Publication 3-0, offers the following guidance, 'Unified action is a comprehensive approach that synchronizes, coordinates, and when appropriate, integrates military operations with the activities of other governmental and nongovernmental organizations to achieve unity of effort.' The absence of unity of command creates second and third order effects that detract from the accomplishment of assigned missions and may lead to mission failure. The primary impediment to achieving unity of command is a reluctance of the individual state governors and the president to relinquish control of their assigned forces. Through case studies, this paper examines the reluctance of civil authorities to relinquish control of their assigned forces. It also looks at the current Dual Status Commander (DSC) authorities and proposes an updates - an evolution - of these authorities. In conclusion, a structure is introduced, Domestic Control (DOCON), that intends to address the statutory limitations to unity of command. Achieving unity of command culminates in unity of effort. Following any large-scale domestic incident, a unified effort is required to resolve the incident successfully and to minimize loss of life and property"--Abstract.

The 2007 National Defense Authorization Act attempted to correct the shortcomings in C2, especially with regard to the ability of the President to call the National Guard in times of natural disaster. However, the legislation was not acceptable to the state governors, which led to the removal of the legislation. It is only a matter of time until a disaster forces the federal and state governments to consider C2 while in a complex environment. This paper will examine the challenges of command and control when considering the use of Title 10 and Title 32 forces operating in a coordinated response to a natural or man-made disaster. Taking into account the differing points of view between the federal and state governments, the paper will examine the current proposal to create a Contingency Dual Status Commander during the execution of consequence management operations, the possible points of friction resulting from this solution and a longer-term solution to better align the state and federal military response.

This structure revolves around a formal hierarchy allowing for orders to be disseminated up and down the chain of command. Hierarchy also ensures a streamlined process to direct large military units. If this structure did not exist within the military, there would be confusion among the roles and responsibilities of those personnel who operate within the construct. Even within a direct, streamlined process that allows for orders and tasks to be relayed, challenges exist. This is true especially when two similar organizations, such as the Federal military and the State military, operate under different legal restrictions, structures, and chains of command, but share common objectives and goals. This interaction between military forces operating under different legal frameworks has caused confusion as to how they approach national disasters, emergencies, and catastrophic events within the United States.
