Book excerpt: The Department of Defense (DOD) has long relied on contractors to provide the U.S. military with a wide range of goods and services, including weapons, food, uniforms, and operational support. Without contractor support, the United States would be currently unable to arm and field an effective fighting force. Understanding costs and trends associated with contractor support could provide Congress more information upon which to make budget decisions and weigh the relative costs and benefits of different military operations -- including contingency operations and maintaining bases around the world. Obligations occur when agencies enter into contracts, employ personnel, or otherwise commit to spending money. The federal government tracks money obligated on federal contracts through a database called the Federal Procurement Data System-Next Generation (FPDS). There is no public database that tracks DOD contract outlays (money spent) as comprehensively as obligations. This book examines how much money DOD obligates on contracts; what DOD is buying; and where that money is being spent. This book also examines the extent to which these data are sufficiently reliable to use as a factor when developing policy or analyzing government operations. In addition, this book provides background information and identifies issues for Congress on the use of contractors to support military operations. DOD's extensive use of contractors poses several potential policy and oversight issues for Congress and has been the focus of numerous hearings. Congress' decisions on these issues could substantially affect the extent to which DOD relies on contractors in and is capable of planning for and overseeing contractors in future operations.

Book excerpt: The nation's long-term fiscal imbalances will likely make DOD's 1.6 trillion planned investment in new weapon systems unsustainable. Thus, it is critical that DOD retains the flexibility to end programs and contracts when necessary and appropriate. Although the federal government generally has the legal right to terminate contracts for convenience, defense stakeholders have sometimes expressed concerns that it will cost more to terminate a contract than to complete it. To address this perception, GAO examined (1) how expected contract termination costs and other factors affect DOD decisions on whether to end programs and contracts; (2) the circumstances under which it would cost more to terminate a contract for convenience than to complete it; and (3) the options DOD has for retaining value or reducing costs, when DOD ends programs or contracts. To do this, GAO examined DOD data on terminated contracts over $100 million; reviewed laws, regulations, and guidance; and met with key DOD officials. GAO recommends that DOD review, and as needed amend, guidance on terminations across the military services and DOD agencies to ensure that termination guidance identifies the conditions under which it is appropriate to end programs or contracts, and provides knowledge needed to use terminations as an investment portfolio tool. DOD agreed.

Book excerpt: The DoD¿s U.S. Army Corps of Engineers awarded the $2.5 billion Restore Iraqi Oil (RIO I) contract to Kellogg Brown & Root in March 2003 in an effort to re-establish Iraq¿s oil infrastructure, & to ensure adequate fuel supplies inside Iraq. RIO I was a cost-plus-award-fee type contract that provided for payment of the contractor¿s costs, a fixed fee determined at inception of the contract, & a potential award fee. The Defense Contract Audit Agency (DCAA) reviewed the 10 RIO I task orders & questioned $221 million in contractor costs. This report determines: how DoD addressed DCAA¿s RIO I audit findings & what factors contributed to DoD¿s decision; & the extent to which DoD paid award fees for RIO I & followed the planned process for making that decision. Book excerpt: In a time of austerity, the U.S. Department of Defense has drawn budgetary savings primarily from reductions in private-sector contracting. The 2000-2012 edition of this report by National Security Program for Industry and Resources (NSPIR) at the Center for Strategic and International Studies (CSIS) examines this trend as well as its broader implications for defense industrial policy. The report analyzes contracting for products, services, and research and development by the U.S. Department of Defense overall and by key components. The 2000-2012 report investigates seven key facets of the defense industrial base and provides detailed answers to pressing acquisition policy questions.
