Heavy caseloads and too few resources force many attorneys to seek quick plea bargains with little interest in actually defending their clients. This guide is meant to help the accused avoid becoming a victim of the California Plea Machine by teaching how to help your attorney help you prepare a defense instead of simply preparing to plead guilty. Available in PDF, EPUB and Kindle. Book excerpt: There is no end in sight to the frequency with which physicians, nursing professionals and other healthcare providers will become lawsuit targets in our litigious society. While politicians, practitioners, insurance companies and trial attorneys debate the nation's chronic malpractice crisis, suits continue to be filed. In addition, once COVID-19 is behind us and the unprecedented public support for health care providers wanes, as it will, it is anticipated that physicians and nurses will become malpractice defendants to a remarkable degree. National legislative fact-finding committees and investigative bodies, which may be charged with the responsibility of pursuing a solution, likely will never achieve a global remedy. Although curtailed by some states, national legislation has not addressed baseless malpractice suites or grossly excessive monetary verdicts. Another approach exists, however. Health care providers can impact the existing system and influence the malpractice environments in a tangible, positive and powerful fashion. Although there will be debate over tort reform in order to bring some degree of protection to the malpractice defendant, individual case success, defined from the defendant's perspective as a no-cause trial verdict, can be realized if well-credentialed and experienced health care professionals are willing to assist the malpractice defense bar as expert witnesses. The benefits to the health care community and the individuals who are willing to participate are innumerable and worth considering.

When you are accused of a crime, you go from being treated like a good citizen, neighbor, mother, father, co-worker, and friend to an accused criminal. Any interaction with the criminal justice system can you leave you feeling hopeless and helpless. Available in PDF, EPUB and Kindle. Book excerpt: Representing Radicals helps lawyers understand ways to work with radical defendants, with an explicit focus on how to help them achieve ends that go beyond traditional legal goals. For example, many radical defendants want to use their trials to discuss political issues even if doing so could lead to a conviction when a standard criminal defense might lead to an acquittal. Understanding radical defendants’ goals and political priorities is a crucial part of providing them with the most robust criminal defense while helping them strengthen and defend their social movements. This book and its precursor, A Tilted Guide to Being a Defendant, are based on the Tilted Scales Collective’s belief that lawyers and radical defendants can work together in shared struggle in ways that strengthen movements when fighting criminal charges.

In order to do this, attorneys must hold the jurors? attention, present the evidence in an understandable manner and make the juror see their side of the story. Demonstrative evidence is often used to accomplish these tasks. But what should the demonstrative evidence include? If it is too technical, there's a chance the jury will not understand it. If it doesn't include the right information, there's a change the jury will forget it. Demonstrative Evidence for Complex Litigation: A Practical Guide is a helpful resource that will provide you with quick, easy to understand tips on how to use demonstrative evidence and what should be included in your presentation. This is a great guide for the new trial attorney or anyone who wants to sharpen their skills.
