Available in PDF, EPUB and Kindle. Book excerpt: This study compares the impact of OSHA inspections on manufacturing industries using data from three time periods: 1979-85, 1987-91, and 1992-98. We find substantial declines in the impact of OSHA inspections since 1979-85. In the earliest period we estimate that having an OSHA inspection that imposed a penalty reduces injuries by about 15%; in the later periods it falls to 8% in 1987-91 and to 1% (and statistically insignificant) in 1992-98. Testing for different effects by inspection type, employment size, and industry, we find differences across size classes, but these cannot explain the overall decline. In fact, we find reductions in OSHA's impact over time for nearly all subgroups we examine, so shifts across subgroups cannot explain the whole decline. We examine various other hypotheses concerning the declining impact, but in the end we are not able to provide a clear explanation for the decline.

We use measures of general deterrence (expected inspections at plants like this one) and specific deterrence (actual inspections at this plant). Both measures of deterrence are found to affect accidents, with a 10% increase in inspections with penalties predicted to reduce accidents by 2%. The existence of specific deterrence effects, the importance of lagged effects, the asymmetrical effects of probability and amount of penalty on accidents, and the tendency of injury rates to self-correct over a few years support a behavioral model of the firm's response to enforcement rather than the traditional expected penalty' model of deterrence theory

Kleiner brings us a book that expands our knowledge of occupational regulation by showing how varying stages of regulation impact those in the occupations, closely related occupational practitioners, and, ultimately, consumers through the quality and cost of services provided. In Stages of Occupational Regulation: Analysis of Case Studies, Kleiner examines seven occupations at various stages of government regulation. From the least regulated to the most regulated, they are: interior designers, mortgage brokers, preschool teachers, construction tradesmen—specifically plumbers and electricians—dental hygienists, and dentists. Kleiner shows that occupations that have been regulated for the shortest periods of time and that have minimal entry requirements, such as interior designers, are usually unable to achieve their economic goals of better compensation and less competition. For more heavily regulated occupations that have a longer history of regulation and have more rigorous entry requirements, such as dentists, higher earnings and greater control over job-related tasks are more likely. The book also presents new analysis on a long-standing debate in law and economics—i.e., whether litigation or regulation is better for society. Kleiner shows that the growth of occupational licensing suggests that some form of regulation may be gaining as the dominant type of public policy. Furthermore, Kleiner examines how regulations may influence the number of workplace injuries and deaths incurred by plumbers and electricians in the construction industry—the most hazardous industry, as determined by the total number of workplace accidents in the United States.
