Available in PDF, EPUB and Kindle. Book excerpt: Multinational Enterprises and the Law presents the only comprehensive, contemporary, and interdisciplinary account of the various techniques used to regulate multinational enterprises (MNEs) at the national, regional and multilateral levels. In addition it considers the effects of corporate self-regulation upon the development of the legal order in this area. Split into four parts the book firstly deals with the conceptual basis for MNE regulation, explaining the growth of MNEs, their business and legal forms, the relationship between them and the effects of a globalising economy and society upon the evolution of regulatory agendas in the field. Part II covers the main areas of economic regulation including the limits of national and regional jurisdiction over MNE activities, controls and liberalization of entry and establishment; tax and company, and competition law. Part III introduces the social dimension of MNE regulation covering labour rights, human rights, and environmental issues, and Part IV deals with the contribution of international law and organizations to MNE regulation and to the control of investment risks, covering the main provisions found in international investment agreements and their recent interpretation by international tribunals.

Book Synopsis The Oxford Handbook of International Investment Law by : Peter Muchlinski
Download or read book The Oxford Handbook of International Investment Law written by Peter Muchlinski and published by . This book was released on 2008 with total page 1349 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Oxford Handbook series is a major new initiative in academic publishing. Each volume offers an authoritative and state-of-the-art survey of current thinking and research in a particular subject area. Specially commissioned essays from leading international figures in the discipline give critical examinations of the progress and direction of debates. Oxford Handbooks provide scholars and graduate students with compelling new perspectives upon a wide range of subjects in the humanities and social sciences. The Oxford Handbook of International Investment Law aims to provide the first truly exhaustive account of the current state and future development of this important and topical field of international law. The Handbook is divided into three main parts. Part One deals with fundamental conceptual issues, Part Two deals with the main substantive areas of law, and Part Three deals with the major procedural issues arising out of the settlement of international investment disputes. The book has a policy-oriented introduction, setting the more technical chapters that follow in their policy environment within which contemporary norms for international foreign investment law are evolving. The Handbook concludes with a chapter written by the editors to highlight the major conclusions of the collection, to identify trends in the existing law, and to look forward to the future development of this field.
Book Synopsis The Rules of the Game in the Global Economy by : Lee E. Preston
Download or read book The Rules of the Game in the Global Economy written by Lee E. Preston and published by Springer Science & Business Media. This book was released on 2013-11-11 with total page 308 pages. Available in PDF, EPUB and Kindle. Book excerpt: This study has been long in the making, and the world has changed dramatically while we have been at work. We initially anticipated a substantial section on the Soviet-dominated Council for Mutual Economic Assistance (CMEA or "COMECON"), which offered an interesting contrast to the kind of international business regime typically found among market-oriented countries and industries. As we moved toward publi- tion, the CMEA vanished, and so we mention it only in passing. The USSR subsequently disintegrated into a Commonwealth of Independent States (CIS). On the other hand, we began with the assumption that the historic "rule of capture" no long played a significant role in international economic relations. The seizure of Kuwait's territory and wealth by the government of Iraq suggests that this assumption was heavily influenced by wishful thinking. Even though this seizure has been reversed by military action, the experience remains a challenge to generally held beliefs about the strength of "order" versus "chaos" in contemporary international affairs. Some readers of this volume have suggested that it gives insufficient attention to the fact that many of the important business and economic regimes of the postwar period are currently under significant pressure, perhaps even in danger of collapse. We acknowledge that there are many evidences of strain in, for example, the free trade and money exchange regimes, and in many areas of environmental protection.

Book Synopsis The Iran-United States Claims Tribunal by : Charles Nelson Brower
Download or read book The Iran-United States Claims Tribunal written by Charles Nelson Brower and published by Martinus Nijhoff Publishers. This book was released on 1998-02-12 with total page 958 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Iran-United States Claims Tribunal is arguably the most significant arbitral institution of the twentieth century. Although the completion of its last few cases could take a long time, the Tribunal's impressive work must be made available now as a guide to the resolution of ongoing disputes and for future tribunals. The Tribunal has, by this point, disposed of well over 98 percent of its caseload. Little more remains for its participants to learn, but the Tribunal shows no signs of fading away. Both of the two States Parties, for different reasons, see greater advantage in the Tribunal's prolongation than in its elimination. The authors have succeeded in dealing with all of the most deserving Tribunal subjects. Moreover, their intimate involvement in and knowledge of the Tribunal ensure that their book is a fascinating, important, and indispensable contribution to the literature of International Law. This is a definitive book on a monumental event in the law and in history at the close of a century. "The Iran-United States Claims Tribunal" was awarded the ASIL Certificate of Merit.

Book excerpt: This book aims to be an introduction and support to the carrying out of financial and economic analysis of a country's projects. It uses a case study of a joint venture between domestic and foreign investors in a developing country to show how the theoretical analysis relates to real life. The financial and economic analyzes are systematically linked. All aspects which are considered significant are treated in separate steps, thereby simplifying the evaluation process for the reader.
Book Synopsis The International Law of Expropriation as Reflected in the Work of the Iran-U.S. Claims Tribunal by : Allahyar Mouri
Download or read book The International Law of Expropriation as Reflected in the Work of the Iran-U.S. Claims Tribunal written by Allahyar Mouri and published by BRILL. This book was released on 2023-07-24 with total page 611 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book deals with expropriation and other measures affecting property rights as set out in the awards of the Iran-U.S. Claims Tribunal, and thus examines the relation between general international law and the lex specialis, viz., the provisions of the Algiers Declarations and the Treaty of Amity between the Governments of Iran and the United States. It studies what rights have been considered as property rights capable of being independently expropriated or affected by other measures, and what rights have not been so qualified, although they might have been considered as forming an element of valuation. Furthermore, the liability and attributability issues are discussed, as are the methods of compensation and of valuation.

Book Synopsis International Economic Transactions by : Peter Hooper
Download or read book International Economic Transactions written by Peter Hooper and published by University of Chicago Press. This book was released on 2009-02-15 with total page 512 pages. Available in PDF, EPUB and Kindle. Book excerpt: How the government arrives at its official economic statistics deeply influences the lives of every American. Social Security payments and even some wages are linked to import prices through official inflation rates; special measures of national product are necessary for valid comparisons of vital social indicators such as relative standards of living and relative poverty. Poor information can result in poor policies. And yet, federal statistics agencies have been crippled by serious budget cuts—and more cuts may lie ahead. Questioning the quality of current data and analytical procedures, this ambitious volume proposes innovative research designs and methods for data enhancement, and offers new data on trade prices and service transactions for future studies. Leading researchers address the measurement of international trade flows and prices, including the debate over measurement of computer prices and national productivity; compare international levels of manufacturing output; and assess the extent to which the United States has fallen into debt to the rest of the world.
