Book Synopsis Bureaucrats as Law-makers by : Frank M. Häge
Download or read book Bureaucrats as Law-makers written by Frank M. Häge and published by Routledge. This book was released on 2013 with total page 242 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Council of Ministers is one of the most powerful institutions of the European Union (EU) and plays a major role in the European policy-making process. Drawing on formal theory and combining quantitative and qualitative methods in an innovative fashion, this book provides novel insights into the role of national bureaucrats in legislative decision-making of the Council of the EU. The book examines and describes the Council of Ministers' committee system and its internal decision-making process. Relying on a wide quantitative dataset as well as six detailed case studies in the policy areas of Agriculture, Environment, and Taxation, it provides a comprehensive and systematic assessment of the extent to which national bureaucrats act as law-makers in the Council. It also examines the degree to which theories on collective decision-making, delegation, and international socialization can account for variation in the involvement of bureaucrats. Investigating how often and why national officials in working parties and committees, rather than ministers, make legislative decisions in the EU, this book addresses the implications of bureaucratic influence for the democratic legitimacy of Council decision-making. The author finds that ministers play a generally more important role in legislative decision-making than often assumed, alleviating, to some extent, concerns about the democratic legitimacy of Council decisions. Bureaucrats as Law-Makers will be of interest to students, scholars and practitioners in the field of European Union politics and policy-making, legislative decision-making, intergovernmental negotiations and international socialization.

Book Synopsis Breaking the Bargain by : Donald Savoie
Download or read book Breaking the Bargain written by Donald Savoie and published by University of Toronto Press. This book was released on 2003-12-15 with total page 358 pages. Available in PDF, EPUB and Kindle. Book excerpt: Canada's machinery of government is out of joint. In Breaking the Bargain, Donald J. Savoie reveals how the traditional deal struck between politicians and career officials that underpins the workings of our national political and administrative process is today being challenged. He argues that the role of bureaucracy within the Canadian political machine has never been properly defined, that the relationship between elected and permanent government officials is increasingly problematic, and that the public service cannot function if it is expected to be both independent of, and subordinate to, elected officials. While the public service attempts to define its own political sphere, the House of Commons is also in flux: the prime minister and his close advisors wield ever more power, and cabinet no longer occupies the policy ground to which it is entitled. Ministers, who have traditionally been able to develop their own roles, have increasingly lost their autonomy. Federal departmental structures are crumbling, giving way to a new model that eschews boundaries in favour of sharing policy and program space with outsiders. The implications of this functional shift are profound, having a deep impact on how public policies are struck, how government operates, and, ultimately, the capacity for accountability.

Book Synopsis Council of Europe Law by : Florence Benoît-Rohmer
Download or read book Council of Europe Law written by Florence Benoît-Rohmer and published by Council of Europe. This book was released on 2005-01-01 with total page 248 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since its foundation, the Council of Europe has established a common legal system for European states, based on democracy, the rule of law and human rights. Its standard-setting texts have helped its members meet the challenges of changing societies and now apply all over Europe given the organisation¿s unprecedented geographical enlargement since 1989. In this connection, the Council of Europe has played a key role in the accession of the new member states to the European Union. The first section of the book deals with the "constitutional" law of the Council of Europe, or its internal statutes in the broad sense. It covers the 1949 Statute, which, along with related texts, lays down the Council¿s aims and determines its membership and operating methods. The second section concerns the role played by the Council of Europe - which has always been very active in standard-setting - in the harmonisation of European states¿ domestic law. The third section situates Council of Europe law in the European context. For instance, it studies the extent to which Council of Europe conventions have been incorporated in domestic law and how Council of Europe law and European Union law co-exist.
