Book excerpt: Procedures for the Handling of Retaliation Complaints under Section 806 of the Sarbanes-Oxley Act of 2002 (US Occupational Safety and Health Administration Regulation) (OSHA) (2018 Edition) The Law Library presents the complete text of the Procedures for the Handling of Retaliation Complaints under Section 806 of the Sarbanes-Oxley Act of 2002 (US Occupational Safety and Health Administration Regulation) (OSHA) (2018 Edition). Updated as of May 29, 2018 This document provides the final text of regulations governing employee protection (retaliation or whistleblower) claims under section 806 of the Corporate and Criminal Fraud Accountability Act of 2002, Title VIII of the Sarbanes-Oxley Act of 2002 (Sarbanes-Oxley or Act), which was amended by sections 922 and 929A of the Dodd-Frank Wall Street Reform and Consumer Protection Act of 2010 (Dodd-Frank), enacted on July 21, 2010. An interim final rule (IFR) governing these provisions and request for comment was published in the Federal Register on November 3, 2011. Five comments were received. This rule responds to those comments and establishes the final procedures and time frames for the handling of retaliation complaints under Sarbanes-Oxley, including procedures and time frames for employee complaints to the Occupational Safety and Health Administration (OSHA), investigations by OSHA, appeals of OSHA determinations to an administrative law judge (ALJ) for a hearing de novo, hearings by ALJs, review of ALJ decisions by the Administrative Review Board (ARB) (acting on behalf of the Secretary of Labor), and judicial review of the Secretary of Labor's final decision. It also sets forth the Secretary of Labor's interpretations of the Sarbanes-Oxley whistleblower provision on certain matters. This book contains: - The complete text of the Procedures for the Handling of Retaliation Complaints under Section 806 of the Sarbanes-Oxley Act of 2002 (US Occupational Safety and Health Administration Regulation) (OSHA) (2018 Edition) - A table of contents with the page number of each section

Book excerpt: Procedures for the Handling of Retaliation Complaints under Section 806 of the Sarbanes-Oxley Act (US Occupational Safety and Health Administration Regulation) (OSHA) (2018 Edition) The Law Library presents the complete text of the Procedures for the Handling of Retaliation Complaints under Section 806 of the Sarbanes-Oxley Act (US Occupational Safety and Health Administration Regulation) (OSHA) (2018 Edition). Updated as of May 29, 2018 The Occupational Safety and Health Administration (OSHA) is amending the regulations governing employee protection ("retaliation" or "whistleblower") claims under section 806 of the Corporate and Criminal Fraud Accountability Act of 2002, Title VIII of the Sarbanes-Oxley Act of 2002 ("Sarbanes-Oxley" or "Act"), which was amended by sections 922 and 929A of the Dodd-Frank Wall Street Reform and Consumer Protection Act of 2010, enacted on July 21, 2010. Public Law 111-203. These revisions to the Sarbanes-Oxley whistleblower regulations clarify and improve the procedures for handling Sarbanes-Oxley whistleblower complaints and implement statutory changes enacted into law as part of the 2010 statutory amendments. These changes to the Sarbanes-Oxley whistleblower regulations also make the procedures for handling retaliation complaints under Sarbanes-Oxley more consistent with OSHA's procedures for handling complaints under the employee protection provisions of the Surface Transportation Assistance Act of 1982, 29 CFR part 1978; the National Transit Systems Security Act and the Federal Railroad Safety Act, 29 CFR part 1982; the Consumer Product Safety Improvement Act of 2008, 29 CFR part 1983; and the Employee Protection Provisions of Six Environmental Statutes and Section 211 of the Energy Reorganization Act of 1974, as amended, 29 CFR part 24. Book excerpt: Since the collapse of Enron Corp. in late 2001, there has been a series of scandals involving major U.S. corporations. Recurring elements in the scandals include improper or fraudulent accounting, self-enrichment by corporate officers, stock trading on inside information (insider trading), and the destruction or falsification of business records. A number of cases have resulted in criminal indictments, some followed by guilty pleas. This report tracks post-Enron criminal charges. Companies are listed alphabetically, and individuals who have been charged, indicted, or have pleaded guilty are identified. A longer list of companies with recent accounting problems (not all of which have resulted in criminal indictments) may be found in CRS Report RS21269, Accounting Problems Reported in Major Companies Since Enron, by Mark Jickling. The 107th Congress responded to the series of corporate scandals that began with Enron by passing the Sarbanes-Oxley Act of 2002. That law created a new oversight body for corporate auditors, imposed new disclosure requirements on corporations, including a mandate that CEOs personally certify the accuracy of their firms' public financial reports, and increased criminal penalties for a number of offenses related to securities fraud. For a summary of the legislation, see CRS Report RL31554, Corporate Accountability: Sarbanes-Oxley Act of 2002 (P.L. 107-204), by Michael V. Seitzinger and Elizabeth B. Bazan. This report will be updated regularly.

Available in PDF, EPUB and Kindle. Book excerpt: Applied ethics has been gaining wide attention in a variety of curriculums, and there is growing awareness of the need for ethical training in general. Well-publicized ethical problems such as the Challenger disaster, the Ford Pinto case and the collapse of corporations such as Enron have highlighted the need to rethink the role of ethics in the workplace. The concept of applied ethics originated in medicine with a groundbreaking book published in 1979. Business ethics books began to appear in the 1980s, with engineering ethics following in the 1990s. This volume now opens up a new area of applied ethics, comprehensively addressing the ethical issues confronting the civil aviation industry. Aviation is unique in two major ways: firstly it has a long history of government regulations, and secondly its primary focus is the safety of its passengers and crew. For decades commercial aviation was viewed in the same manner as public utilities, and thus it was highly regulated by the government. Since the Deregulation Act of 1978, aviation has been viewed as any other business while other experts continue to believe that the sudden switch to deregulation has caused problems, especially since many airlines were unprepared for the change. Ethical Issues in Aviation focuses on current concerns and trends, to reflect the changes that have occurred in this deregulated era. The book provides the reader with an overview of the major themes in civil aviation ethics. It begins with theoretical frameworks, followed by sections on the business side of aviation, employee responsibility, diversity in aviation, ground issues regarding airports, air traffic control and security, as well as health and the environment. The contributors to the volume include both academics doing research in the field as well as professionals who provide accounts of the ethical situations that arise in the workplace.

Book excerpt: Auditing has become an essential component in market societies and the need for auditing skills has risen in line with globalization. This textbook provides a comprehensive overview of the role of financial statement auditing in contemporary society, including the auditor’s role in evaluating the financial reporting of an auditee—a topic of central concern in the recent comprehensive review of the auditing profession in the Brydon Report (2019). The experienced authors provide insight into auditing research to help readers understand its function, regulation, and role in theory and practice. With focus on private sector financial statement auditing and its regulation, the book includes perspectives on social theory, history, and the importance of professional standards. The thought-provoking final chapter challenges students to consider the effectiveness of auditing in evaluating increasingly risky and complex accounting estimates involving assumptions about future events. A fundamental approach to auditing theory, this textbook will be useful reading for advanced undergraduate and postgraduate students across business and accounting fields.

Book excerpt: "The United States Code is the official codification of the general and permanent laws of the United States of America. The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The 2012 edition of the Code was prepared and published under the supervision of Ralph V. Seep, Law Revision Counsel. Grateful acknowledgment is made of the contributions by all who helped in this work, particularly the staffs of the Office of the Law Revision Counsel and the Government Printing Office"--Preface.
