Sharlet, a noted authority on Soviet law and constitutional development, demonstrates the gradual transformation of law from an instrument of Communist Party rule into the new "rules of the game" for nonauthoritarian political development. In effect, he argues, one of Gorbachev's most durable achievements may be his redefinition of Soviet politics into a legal idiom along with his relocation of policymaking from behind the closed doors of Party conclaves into the more open, emergent arena of constitutional government. In analyzing the politics of law from the Brezhnev era to the rise of Yeltsin, the author takes account of the "war of laws", the symbolic uses of the Soviet constitution, and even the fact that the leaders of the failed coup attempted to justify their seizure of power on constitutional grounds. Constitutionalism has sufficiently suffused Soviet public life, the book concludes, that most of the sovereign republics as successors to the former USSR, have begun designing their futures - to varying degrees - in constitutional forms.

Book excerpt: To date, the world can lay claim to little more than 190 sovereign independent entities recognized as nation-states, while by some estimates there may be up to eight hundred more nation-state projects underway and seven to eight thousand potential projects. Why do a few such endeavors come to fruition while most fail? Standard explanations have pointed to national awakenings, nationalist mobilizations, economic efficiency, military prowess, or intervention by the great powers. Where Nation-States Come From provides a compelling alternative account, one that incorporates an in-depth examination of the Russian Empire, the Soviet Union, and their successor states. Philip Roeder argues that almost all successful nation-state projects have been associated with a particular political institution prior to independence: the segment-state, a jurisdiction defined by both human and territorial boundaries. Independence represents an administrative upgrade of a segment-state. Before independence, segmental institutions shape politics on the periphery of an existing sovereign state. Leaders of segment-states are thus better positioned than other proponents of nation-state endeavors to forge locally hegemonic national identities. Before independence, segmental institutions also shape the politics between the periphery and center of existing states. Leaders of segment-states are hence also more able to challenge the status quo and to induce the leaders of the existing state to concede independence. Roeder clarifies the mechanisms that link such institutions to outcomes, and demonstrates that these relationships have prevailed around the world through most of the age of nationalism.

He interprets the Soviet regime as a product of three different influences: the Tsarist tradition of nondemocratic rule, the revolutionary movement that overthrew Tsarism, and the Stalinism of 1924-1953. Since the death of Stalin, the Soviet regime has slowly evolved from a personal dictatorship into an oligarchical system. According to the author, this transformation has permitted the great Soviet bureaucracies, such as the military high command and the economic managers, to increase their power and influence over policymaking and to pursue their own interests in addition to those of the regime. From this perspective, the role of party leaders in the Politburo appears to be that of political brokers among conflicting interests, allocating resources among the various bureaucracies. This second edition has been completely revised and updated to reflect the realities of the Soviet system through the 27th Party Congress, which met in February 1986. Dr. Hammer applies the model of bureaucratic pluralism in the areas of public policy and economic planning, illustrating the theme that the evolution of a powerful bureaucratic organization has prevented the achievement of the original Leninist vision. He discusses specific features of the Soviet society that deviate from original principles (often based on dissident sources from within the USSR) and examines the role of party leaders in this ideological transition.
