Book excerpt: This is the introductory chapter in 'The Constitutional System of Thailand: A Contextual Analysis' - the chapter seeks to provide an historical overview and analysis of Thai constitutionalism. First we look at Thai constitutional history leading up to the 1932 coup against the absolute monarchy, before reflecting on the main developments that followed in its wake. This historical prelude is of fundamental importance to understanding how Thailand's hyper-constitution-making, as set out in the Preface and discussed further in this chapter, can be assessed. We turn next to consider the significance of the 1997 Constitution which, despite its limited duration, redefined the parameters of the contemporary debate because it not only recognized most aspects of the present institutional architecture but also placed great emphasis on protecting human rights and combating corruption. The later sections proceed to discuss matters which are not dealt with in an explanatory way in the constitutional texts, namely the military coups and the constitutional role of the military, and the monarchy.

This volume analyzes the economic, social, and political challenges that emerging states confront today. Notwithstanding the growing importance of the ‘emerging states’ in global affairs and governance, many problems requiring immediate solutions have emerged at home largely as a consequence of the rapid economic development and associated sociopolitical changes. The middle-income trap is a major economic challenge faced by emerging states. This volume regards interest coordination for technological upgrading as crucial to avoid the trap and examines how various emerging states are grappling with this challenge by fostering public-private cooperation, voluntary associations of market players, and/or social networks. Social disparity is another serious problem. It is deeply rooted in history in the emerging states such as South Africa and many Latin American countries. However, income distribution is recently deteriorating even in East Asia that was once praised for its high economic growth with equity. Increasing pressure for political opening is another challenge for emerging states. This volume argues that the economic, social, and political problems are interwoven in the sense that the emerging states need to build political consensus in order to tackle the economic and social difficulties. Democratic institutions have not always been successful in this respect.

Since the change from an absolute monarchy to a constitutional democracy in 1932, Thailand has had 17 charters and constitutions, reflecting the high degree of political instability and frequency of military coups faced by the nation. After successful coups, military regimes abrogated existing constitutions and promulgated new ones. All of Thailand's charters and constitutions have allowed a constitutional monarchy, but with widely differing balances of power between the branches of government. Most of them have stipulated parliamentary systems. However, several of them also called for dictatorships, e.g., the 1957 Charter. Both unicameral and bicameral parliaments have been used, and members of parliament have been both elected and appointed. The direct powers of the monarch have also varied considerably. Thailand's current constitution was promulgated in 2007, replacing an interim constitution promulgated in 2006 after an army-led coup. The 2007 Constitution was written by a junta-appointed group of drafters, but was approved by a public referendum. Prior to the referendum, the junta passed a law making it illegal to publicly criticize the draft.
