Book excerpt: Excerpt from Outlines of the Constitutional History of the United States This work is designed to be a beginning book for students, or general readers, who desire to learn some thing of the character and history of the Constitution of the United States. It is an elementary account of government in the United States. It gives a brief state ment of the main facts of our constitutional history but it does not profess to be a constitutional history in the full meaning of the term. For the general reader or for high-school use it prob ably covers sufficient ground. For the college student it attempts simply to point the way to extended study by a brief but connected review of the main facts, showing what is of chief importance for further study, and embracing those political documents which every student of our history must thoroughly understand. Book excerpt: Excerpt from The Constitutional and Political History of the United States, Vol. 1: 1750-1833, State Sovereignty and Slavery As to my American predecessors I have one great ad vantage over all of them: I am a foreigner. This I con sider to be an advantage, though, during my sojourn in the United States (1867 I had frequently to hear: You are a foreigner, you cannot fully understand our sys tem of government. I, of course, do not deny that there is a certain something in the character of every nation which a foreigner will never be able to completely understand, because it cannot be grasped by the judgment; it can only be felt, and in order to feel it, one's flesh and blood must be filled with the national sentiment. But, however often my shot may have missed the mark in consequence of this lack of the national sentiment, though it might greatly impair the value of the work for other foreigners, it cannot possibly be fatal to it with regard to American readers, for they have the necessary corrective in their American feeling. Book excerpt: Excerpt from Constitutional History of the United States Important additions have been made to the original Constitution by way of amendment, but scarcely more so than those which have come to it through the process of the gradual unfolding of its unexpressed meaning, which has naturally followed the expansion of our national domain, the development of our national re sources, the meeting of new responsibilities in govern ment, the contending with new difficulties which have confronted us in the execution of our newly acquired powers. While we have a written, and therefore, in a certain sense, a settled Constitution, it is an elastic one. Had the original Constitution of 1787 been so limited by its own terms that it could not have been construed to mean more than was actually and clearly expressed by the language in which it was clothed, our Government would soon have gone to wreck or have remained a feeble and insignificant member of the sisterhood Of nations, unless by amendment of the old, or by the adoption of a new constitution new power had been given it. Fortunately it was not so framed. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from Political and Constitutional Law of the United States of America The principles fundamental to political self-government, should doubtless be clearly understood by every vo'rnn or macros. For his status, in this country, is no less than that of one of a body of absolute sovereigns.l The three fundamentally different and mu tually opposing theories of our political system, - one or another of which every voter must necessarily sanction, and consequently, -one or another of which must furnish the key to every administra tion of government, state and federal, - are therefore severally and distinctly presented, so that every voter may judge for himself, as he ought to do, which of these theories should receive his assent and support. Attention is also directed to the different foundations of govern ment, to the rise and development of the system peculiar to Amer ica, to the sovereign legislation by the People themselves from the dawn of the Revolution to the xvth Amendment, and to the views and doctrines of the original framers of our Constitutions; ever so little reflection upon which will enable any voter to form his own independent opinion, regardless of partisan strifes, and to cast his vote with a clear understanding of what it involves. Book excerpt: Excerpt from The Story of the Constitution of the United States The story of the Constitution is of truth stranger than fie tion. It is natural to attribute to an institution throughout its history that reputation which it bears in our own day. Many men are yet living who remember with startling dis tinctness a time when the Constitution seemed merely a piece of parchment; when the fate of the nation was as uncertain as the course of battle; when stern necessity compelled so liberal an interpretation of the supreme law of the land that states men refrained from forming conclusions on the tendency Of national administration, and, looking hopefully forward, sought new meanings in events where before they had sought interpretation by a construction Of words. Then, and not till then, in our history was the Constitution of the United States understood in its spirit as being the expression of the nation's mind, Whatever that mind might be. But no man now living can remember the angry days when the Constitu tion was yet a hope or a proposition debated between jealous States and still more jealous political leaders. NO one can re member the living opinions which, at the close of the eight eenth century, so nearly triumphed, and whose triumph would have dissolved a feeble union of States and encouraged the horrors of an anarchy only possible in a democracy. When the Opinions on national government in America to-day and opinions Of a century ago are contrasted, it is difficult to be lieve that we are the children of our fathers. Book excerpt: Excerpt from An Introduction to the Local Constitutional History of the United States, Vol. 1 Since the appearance of Freeman's Comparative Politics the theory of an English local constitution whose origin is coeval with the origin of the race has become familiar to every scholar. In that work the real extent and the real limitations of our common Aryan heritage were first disclosed. Already an extensive monographic literature, every day increasing, bears witness to the high value set upon the study of local institutions. But it is a noteworthy fact that local constitutional history, as a unity deserving of sustained and comprehensive treatment, has as yet found few expounders. Bishop Stubbs, it is true, in his account of the higher organism has assigned to the lower its proper space and rank. George Waitz has rendered a similar service for Germany; and the evolution of the mark, village, and other communities on the Continent, has been described at great length by George L.v. Maurer. But the treatise of Dr. Gneist is the only work of first rate importance which has yet been devoted exclusively to the history of local self-government in England. This book, however, is a practical demonstration that the history of the local constitution, for weight and dignity, may rightly take its place on a level with that of the state itself. No compendious treatise on the development of local institutions in the United States has yet appeared. Indeed, until recently, the attempt to produce such a work, if not premature, would at least have proved extremely difficult. Book excerpt: Excerpt from Constitutional Government in the United States MY object in the following lectures-is to examine the government of the United States as a constitutional system as Simply and directly as possible, with an eye to practice, not to theory. And yet at the very outset it is necessary to pause upon a theory. The government of the United States cannot be intelligently discussed as a constitutional system until we clearly determine what we mean by a constitutional government; and the answer to that question is in effect a theory of politics.
