Available in PDF, EPUB and Kindle. Book excerpt: "Capital is the defining feature of modern economies, yet most people have no idea where it actually comes from. What is it, exactly, that transforms mere wealth into an asset that automatically creates more wealth? The Code of Capital explains how capital is created behind closed doors in the offices of private attorneys, and why this little-known fact is one of the biggest reasons for the widening wealth gap between the holders of capital and everybody else. In this revealing book, Katharina Pistor argues that the law selectively "codes" certain assets, endowing them with the capacity to protect and produce private wealth. With the right legal coding, any object, claim, or idea can be turned into capital - and lawyers are the keepers of the code. Pistor describes how they pick and choose among different legal systems and legal devices for the ones that best serve their clients' needs, and how techniques that were first perfected centuries ago to code landholdings as capital are being used today to code stocks, bonds, ideas, and even expectations--assets that exist only in law. A powerful new way of thinking about one of the most pernicious problems of our time, The Code of Capital explores the different ways that debt, complex financial products, and other assets are coded to give financial advantage to their holders. This provocative book paints a troubling portrait of the pervasive global nature of the code, the people who shape it, and the governments that enforce it."--Provided by publisher.

Book excerpt: A Foreign Affairs Best Book of the Year “An intellectual excursion of a kind rarely offered by modern economics.” —Foreign Affairs Thomas Piketty’s Capital in the Twenty-First Century is the most widely discussed work of economics in recent years. But are its analyses of inequality and economic growth on target? Where should researchers go from there in exploring the ideas Piketty pushed to the forefront of global conversation? A cast of leading economists and other social scientists—including Emmanuel Saez, Branko Milanovic, Laura Tyson, and Michael Spence—tackle these questions in dialogue with Piketty. “A fantastic introduction to Piketty’s main argument in Capital, and to some of the main criticisms, including doubt that his key equation...showing that returns on capital grow faster than the economy—will hold true in the long run.” —Nature “Piketty’s work...laid bare just how ill-equipped our existing frameworks are for understanding, predicting, and changing inequality. This extraordinary collection shows that our most nimble social scientists are responding to the challenge.” —Justin Wolfers, University of Michigan

Book excerpt: In Marx ́s Capital, Method and Revolutionary Subjectivity, Guido Starosta develops a materialist inquiry into the social and historical determinations of revolutionary subjectivity. Through a methodologically-minded critical reconstruction of the Marxian critique of political economy, from the early writings up to the Grundrisse and Capital, this study shows that the outcome of the historical movement of the objectified form of social mediation, which has turned into the very alienated subject of social life (i.e., capital), is to develop, as its own immanent determination, the constitution of the (self-abolishing) working class as a revolutionary subject. A crucial element in this intellectual endeavour is the focus on the intrinsic connection between the specifically dialectical form of social science and its radical transformative content.

Available in PDF, EPUB and Kindle. Book excerpt: The United States has long epitomized capitalism. From its enterprising shopkeepers, wildcat banks, violent slave plantations, huge industrial working class, and raucous commodities trade to its world-spanning multinationals, its massive factories, and the centripetal power of New York in the world of finance, America has come to symbolize capitalism for two centuries and more. But an understanding of the history of American capitalism is as elusive as it is urgent. What does it mean to make capitalism a subject of historical inquiry? What is its potential across multiple disciplines, alongside different methodologies, and in a range of geographic and chronological settings? And how does a focus on capitalism change our understanding of American history? American Capitalism presents a sampling of cutting-edge research from prominent scholars. These broad-minded and rigorous essays venture new angles on finance, debt, and credit; women’s rights; slavery and political economy; the racialization of capitalism; labor beyond industrial wage workers; and the production of knowledge, including the idea of the economy, among other topics. Together, the essays suggest emerging themes in the field: a fascination with capitalism as it is made by political authority, how it is claimed and contested by participants, how it spreads across the globe, and how it can be reconceptualized without being universalized. A major statement for a wide-open field, this book demonstrates the breadth and scope of the work that the history of capitalism can provoke.

Book excerpt: In 1937 the Supreme Court revolutionized American constitutionalism, sharply restricting the states' powers and expanding those of the national government. In following years the civil rights movement caused further change, challenging American life with its demands for equal rights under the Constitution and protection by the federal government. The Vietnam War expanded and then contracted presidential power. In 2001, attacks organized by followers of Osama bin Laden on American cities revived presidential power, leading to new challenges to America's constitutional heritage. This volume assembles the most important documents from American constitutional history from the depths of the Great Depression to the terrorist attacks on New York and Washington, D.C. on September 11, 2001. Through these important documents, American constitutional power can be seen surging and waning, but always responding to the drama of world events.

Available in PDF, EPUB and Kindle. Book excerpt: A New York Times Book Review Editors' Choice An innovative account of Abraham Lincoln, constitutional thinker and doer Abraham Lincoln is justly revered for his brilliance, compassion, humor, and rededication of the United States to achieving liberty and justice for all. He led the nation into a bloody civil war to uphold the system of government established by the US Constitution—a system he regarded as the “last best hope of mankind.” But how did Lincoln understand the Constitution? In this groundbreaking study, Noah Feldman argues that Lincoln deliberately and recurrently violated the United States’ founding arrangements. When he came to power, it was widely believed that the federal government could not use armed force to prevent a state from seceding. It was also assumed that basic civil liberties could be suspended in a rebellion by Congress but not by the president, and that the federal government had no authority over slavery in states where it existed. As president, Lincoln broke decisively with all these precedents, and effectively rewrote the Constitution’s place in the American system. Before the Civil War, the Constitution was best understood as a compromise pact—a rough and ready deal between states that allowed the Union to form and function. After Lincoln, the Constitution came to be seen as a sacred text—a transcendent statement of the nation’s highest ideals. The Broken Constitution is the first book to tell the story of how Lincoln broke the Constitution in order to remake it. To do so, it offers a riveting narrative of his constitutional choices and how he made them—and places Lincoln in the rich context of thinking of the time, from African American abolitionists to Lincoln’s Republican rivals and Secessionist ideologues. Book excerpt: Excerpt from A Plea for the Introduction of Responsible Government: And the Representation of Capital Into the United States, as Safeguards Against Communism and Disunion Here, Hamilton ascribes the fact that' the Crown had long since ceased to veto bills, not to the fact that the Constitution compelled the Crown to modify its cabinet and its policy to agree with the bill, but to the art with which the Crown succeeded in controlling elections and Parliament. Whether this were true when Hamilton wrote it, or not, it certainly would not be true to-day. To - day, ' if a bill which the government opposes passes the Heuse of Commons, the cabinet must either resign or dissolve the Parliament, and call an election, in which election the people will decide whether to sustain the old cabinet or the bill. If they elect a new house favorable to the old cabinet, then the bill is dropped. If they elect a new house favorable to the bill, then the old cabi net goes out, and a new one, favorable to the bill, goes in; and hence no bill ever passes both houses, so as to reach the Queen for the royal assent, until her cabinet approve it and are ready to advise her to sign it. As Blackstone's Commentaries, written a few years earlier than The Fed eralist, nowhere utter this doctrine, that the Crown must modify its cabinet to agree with the House of Commons, though, in practice, it had for some time been the usage, it is probable that it had not then become a doctrine of the English Constitution, but was regarded as most of the features of the English Constitution in their origin were - as a privilege accorded by the favor and grace of the Crown. Certainly there is nothing in the writings of the framers of our Constitution to indicate that they regarded it as a doctrine of English constitutional law at that time. Book excerpt: Classic Books Library presents this brand new edition of “The Federalist Papers”, a collection of separate essays and articles compiled in 1788 by Alexander Hamilton. Following the United States Declaration of Independence in 1776, the governing doctrines and policies of the States lacked cohesion. “The Federalist”, as it was previously known, was constructed by American statesman Alexander Hamilton, and was intended to catalyse the ratification of the United States Constitution. Hamilton recruited fellow statesmen James Madison Jr., and John Jay to write papers for the compendium, and the three are known as some of the Founding Fathers of the United States. Alexander Hamilton (c. 1755–1804) was an American lawyer, journalist and highly influential government official. He also served as a Senior Officer in the Army between 1799-1800 and founded the Federalist Party, the system that governed the nation’s finances. His contributions to the Constitution and leadership made a significant and lasting impact on the early development of the nation of the United States.

The book also covers: the establishment of the Territory and the history of its government since 1911; a detailed examination of the Commonwealths constitutional power to make laws for the government of the Territory and the extent to which the power in s. 122 of the Constitution is qualified by other provisions of the Constitution; the granting of self-government in 1989; the constitutional framework for the Legislative Assembly and the power of the Assembly to make laws and the scope of executive and judicial power in the Territory, and the division of responsibilities for land management in the Territory between the Commonwealth and Territory governments.--
