Book excerpt: This book presents findings from a process evaluation carried out at a problem-solving court located in England: Manchester Review Court. Unlike the widely documented successes of similar international models, there is no detail of Manchester Review Court in the accessible literature, not in any policy document, nor is there a court handbook or website outlining objectives and expected practice. In adopting the seminal ‘wine’ and ‘bottle’ analytical framework propounded by therapeutic jurisprudence scholars, and by carrying out a detailed comparative analysis comparing the court to successful international problem-solving courts, the original empirical data brings clarity to an overlooked area. A fidelity analysis is also offered for the forerunning English and Welsh drug courts, which were established during the early 2000s, but then shortly fell by the wayside without satisfactory explanation for why. Findings from the book shed new light on the causes of the English and Welsh drug court downfalls pending recent calls to roll out a fresh suite of problem-solving courts. In light of the international evidence base and national struggles in the field, the book proposes a renewed, UK-specific, fidelity matrix to forge the impetus for new practice in this area, whilst accounting for past failures and acknowledging current issues. Therefore, this book not only breaks new ground by advancing knowledge of a significantly uncharted area but provides important inroads for helping policymakers with their strategies in tackling recidivism, addiction, victimisation, and austerity, as widespread social and human issues currently facing both Manchester and the UK more broadly. Presenting significant advancements in theory, policy, and practice at both national and international scale, the book will be a valuable resource for academics and practitioners working in the fields of Therapeutic Justice, Criminal Law, Criminology, Criminal Justice, and Socio-Legal Studies.

Available in PDF, EPUB and Kindle. Book excerpt: Moving away from criminal behaviour can be fraught with difficulties. Often it can involve leaving behind old habits, customs, and even friends, while at the same time adopting a new way of life. How do individuals go about making a decision to give up crime? How do they plan to sustain this decision? And in what ways does probation help? This book explores these questions. Based on in-depth interviews with a group of men under probation supervision, Sam King investigates the factors associated with making a decision to desist from crime. The book examines strategies for desistance, and explores the factors that individuals consider when they are thinking about how they will desist. In doing so, the book sheds new light on existing understandings of desistance from crime and helps to develop our understandings of the role that individuals play in constructing their own desistance journeys. This book also highlights the role of probation in this process, offering a timely and critical review of the nature of probation under the New Labour government in the UK between 1997-2010. The findings indicate that we should allow Probation Officers greater autonomy and discretion within their roles, and that we should free them from the bureaucracy of risk assessment and targets. Moreover, the book warns against the potential fragmentation of community supervision. As such, the book will be of interest to criminology students, researchers, academics, policymakers and practitioners, particularly those who work with ex-offenders in the community.

Book excerpt: Why do we punish? Is it because only punishment can achieve justice for victims and 'right the wrong' of a crime? Or is it justified because it reduces crime, by deterring potential offenders, offering rehabilitative treatment to others and incapacitating the most dangerous? The complex answers to this enduring question vary across time and place, and are directly linked to people's personal, cultural, social, religious and ethical commitments and even their sense of identity. This unique introduction to the philosophy of punishment provides a systematic analysis of the themes of retribution, deterrence, rehabilitation, incapacitation and restorative justice. Integrating philosophical, sociological, political and ethical perspectives, it provides a thorough and wide-ranging discussion of the purposes, meanings and justifications of punishment for crime and the extent to which punishment does, could or should live up to what it claims to achieve. Why Punish? challenges criminology and criminal justice students as well as policy makers, judges, magistrates and criminal justice practitioners to think more critically about the role of punishment and the moral principles that underpin it. Bridging abstract theory with the realities of practice, Rob Canton asks what better punishment would look like and how it can be achieved.

Available in PDF, EPUB and Kindle. Book excerpt: Substance misuse (including alcohol) and mental health problems constitute a significant proportion of the work carried out in the criminal justice system. Approaches to these often intractable problems have seen the rise of a dominant risk paradigm concerned with public protection and the use of coercion through court orders to access treatment. This original and valuable book considers notions of risk and rehabilitation in detail within the practice of those court orders, whilst contextualising them within a wider comparative literature and research base. The efficacy of these approaches, practice issues and innovations including for example therapeutic jurisprudence are analysed. Risk and rehabilitation also includes discussions of the implications for partnership working and the importance of reconfiguring the nature of rehabilitative relationships. This is a timely book as probation practice in the UK and elsewhere moves into a post 'what works' era, providing opportunities to review the evidence base for effective interventions.
