Ferguson in 1896, when he declared, "Our Constitution is color-blind." Corwin's text has been a basic reference in the study of U.S. Constitutional Law. The 14th edition, the first new edition since 1973, brings the volume up to date through 1977. In this classic work, historian Edward Corwin presented the text of the U.S. Constitution along with his own commentary on its articles, sections, clauses, and amendments. Corwin was a renowned authority on constitutional law and jurisprudence, and was hired at Princeton University by Woodrow Wilson in 1905. Far from being an impersonal textbook, Corwin's edition was full of opinion. Not afraid to express his own strong views of the development of American law, Corwin offered piquant descriptions of the debates about the meaning of clauses, placing recent decisions of the court "in the familiar setting of his own views." The favor of his style is evident in his comments on judicial review ("American democracy's way of covering its bet") and the cabinet ("an administrative anachronism" that should be replaced by a legislative council "whose daily salt does not come from the Presidential table"). Corwin periodically revised the book for nearly forty years, incorporating into each new edition his views of new Supreme Court rulings and other changes in American law. Although Corwin intended his book for the general public, his interpretations always gained the attention of legal scholars and practitioners. The prefaces he wrote to the revised editions were often controversial for the views he offered on the latest developments of constitutional law, and the book only grew in stature and recognition. After his death in 1963, other scholars prepared subsequent editions, fourteen in all.

The Journey to Separate but Equal offers the first complete exploration of Hall v. Decuir, with an in-depth look at the case’s record; the lives of the parties, lawyers, and judges; and the case’s social context in 1870s Louisiana. The book centers around the remarkable story of Madame Josephine Decuir and the lawsuit she pursued because she had been illegally barred from the cabin reserved for White women on the Governor Allen riverboat. The drama of Madame Decuir’s fight against segregation’s denial of her dignity as a human and particularly as a woman enriches our understanding of the Reconstruction era, especially in Louisiana, including political and legal changes that occurred during that time and the plight of people of color who were freed from slavery but denied their dignity and rights as American citizens. Hall v. Decuir spanned the pivotal period of 1872–1878, during which White segregationist Democrats “redeemed” the South from Republican control. The Supreme Court’s ruling in Hall overturned the application of an 1869 Louisiana statute prohibiting racial segregation in Madame Decuir’s case because of the status of the Mississippi River as a mode of interstate commerce. The decision represents a crucial precedent that established the legal groundwork for the entrenchment of Jim Crow in the law of the United States, leading directly to the Court’s adoption of “separate but equal” in Plessy v. Ferguson.

Book excerpt: Federalism has generally been characterized as a system of government that is friendly to liberty. It is not obvious, though, why this should be so. Federalism is a form of government where citizens simultaneously reside in at least two governments, each of which has independent authority to tax and to regulate. By contrast, in a unitary form of government citizens face only one government with independent authority to tax and regulate. At first glance, it would seem a bit strange to claim that liberty is more secure when citizens are members of two governments with independent authority than when they are members of only one such government. The relationship between federalism and liberty turns out to be a complex one, and one that is capable of working in either direction. Whether federalism supports or erodes liberty depends on importantly on the institutional framework within which federalist governance takes place. The essays in Federalist Government in Principle and Practice examine this institutionalist theme from both theoretical and practical perspectives.
