Available in PDF, EPUB and Kindle. Book excerpt: Written by two leading practitioners, this comprehesive and practical guide to the law of higher education in the UK provides extensive analysis of the complex legal framework in which universities work and the remedies which may be sought in the event of disputes. The Law of Higher Education has been fully updated to take account of the many legislative changes which have come into force since the publication of the first edition in 2006. The impact of new charity law; changes in governance structures; developments in the law of employment; academic freedom issues; and the increasing presence of academies and other private Higher Education Institutions are all dealt with in detail, with reference to and analysis of the relevent case law throughout. Although focussing on UK laws, the new edition includes expanded material on the international context, which has become particularly important as institutions are increasingly involved in international exchanges and collaborations, as well as being subject to the increasing globalisation of higher education. The text is linked to the updating service on the Oxford Centre for Higher Education Policy Studies website, ensuring that readers are kept up-to-date with developments, even after publication.

Book excerpt: Social Policy Review provides students, academics and all those interested in welfare issues with detailed analyses of progress and change in areas of major interest during the past year. Bringing together a selection of commissioned papers, the Review is organised in three parts. First, it concentrates on the main policy developments during 2005 in relation to five key areas of welfare provision, both in the UK and internationally. The second part, this year concentrating on the theme of health and well-being, draws on current research to explore key policy issues and challenges. The final section explores employment and later life - an often neglected area of social policy, yet one that will increasingly dominate the contemporary news agenda and that has long term implications for social policy.

Available in PDF, EPUB and Kindle. Book excerpt: The UK Government is undertaking a major cross-government programme of analysis prior to the referendum on Scottish independence in 2014. The aim is to provide a comprehensive and detailed analysis of Scotland's place in the UK. This paper, the first of a series to be published in 2013 and 2014, examines the UK's constitutional set-up and the legal implications of independence. The UK Government is convinced that the current devolution offers the best for Scotland: the Scottish Parliament and Government are empowered to take decisions on a range of domestic policy areas - such as health, education, policing - while Scotland continues to benefit from decisions made for the UK as a whole - defence and security, foreign representation, economic affairs. Independence is very different to devolution. Based on independent expert opinion (published as Annex A), the paper concludes that if there were to be a vote in favour of leaving the UK, Scotland would become an entirely new state whilst the remainder of the UK would continue as before, retaining the rights and obligations of the UK as it currently stands. Any separation would have to be negotiated between both governments. Legal and practical implications of independence, both at home and abroad, are addressed. An independent Scotland would have to apply to and/or negotiate to become a member of whichever international organisations it wished to join, including the EU and NATO. Scotland would also have to work through its positions on thousands of international treaties to which the UK is currently party.
