Section 33 deals with the requirements for security certificates submitted by the Inspector General, CSIS to the Solicitor General of Canada, and Section 40 vests the Security Intelligence Review Committee with authority to compel reviews of CSIS operational activities. The report examines the language of the statute, its legislative history, case law, and Parliament’s intent to “provide adequate external review machinery to ensure that the Service does not abuse it powers ... and that the Government does not misuse the Service”. The report recommends that “unreasonable” should be interpreted as related to the wisdom or, appropriateness of ends chosen to be pursued by the Service, while “unnecessary relates to the means chose to pursue those ends.

It then reviews the work of the 1977 McDonald Commission appointed to inquire into certain activities of the Royal Canadian Mounted Police (RCMP), which was responsible at that time for national security services. The Commission's philosophy concerning accountability is examined along with the specific recommendations that flowed from this in order to assess accountability innovations in the CSIS Act. One of these innovations was the establishment of an independent review body, the Security Intelligence Review Committee, and the mandate & operations of this Committee are discussed along with the evolution of the review process and the relationship between the Committee & CSIS over 1984-2001. This is followed by a review of the role of another accountability mechanism for another security agency: the Communications Security Establishment Commissioner. Final sections discuss national security review & accountability mechanisms provided through the Auditor General, the Information Commissioner & Privacy Commissioner, and parliamentary committees.
