Available in PDF, EPUB and Kindle. Book excerpt: The incorporation of intellectual property protection into the WTO international trading system has been a milestone in international economic law and has added a new dimension to trade regulation — new rights and obligations and new challenges alike. The contributors, leading scholars and practitioners in the field, provide insights into the legal relationship of the TRIPs Agreement to the GATT 94 and the GATS. The book widens the debate with a thorough discussion on pending and unresolved relations of TRIPs, the WTO, UPOV, the Convention on Biodiversity and Farmers' Rights contained in the FAO International Undertaking, and efforts of the World Bank GCIAR system, including IPGRI. What will be the impact of TRIPs on ownership of plant genetic resources? Largely a victory for OECD countries, the present state of intellectual property rights has important implications for developing countries. The incorporation of intellectual property rights into the WTO system will eventually change the relationship of trade, competition, and intellectual property. It will equally have to assist in providing equitable sharing of benefits in the use of plant genetic resources. All of these issues are essential for the revision of exclusions from patenting in TRIPs. This volume offers insights into how this difficult task could and should be approached in a balanced manner and will be essential reading for economists and trade and intellectual property lawyers interested in the subject. Moreover, the volume will be relevant to agricultural economists as it addresses complex problems in the interstices of trade, intellectual property, plant genetic resources, and sustainable development. Thomas Cottier is Professor of European and International Economic Law, University of Bern, and Managing Director, World Trade Institute, University of Bern. Petros C. Mavroidis is Professor of Law, University of Neuchâtel. He formerly worked in the Legal Affairs Division of the World Trade Organization. Marion Panizzon is Research Fellow, University of Bern. Simon Lacey is Research Fellow, University of Bern.

Available in PDF, EPUB and Kindle. Book excerpt: In an age when everyone aspires to teach critical thinking skills in the classroom, what does it mean to be a subversive law teacher? Who or what might a subversive law teacher seek to subvert – the authority of the law, the university, their own authority as teachers, perhaps? Are law students ripe for subversion, agents of, or impediments to, subversion? Do they learn to ask critical questions? Responding to the provocation in the classic book Teaching as a Subversive Activity, by Postman and Weingartner, the idea that teaching could, or even should, be subversive still holds true today, and its premise is particularly relevant in the context of legal education. We therefore draw on this classic book to discuss, in the present volume, the consideration of research into legal education as lifetime learning, as creating meaning, as transformative and as developing world-changing thinking within the legal context. The volume offers research into classroom experiences and theoretical and historical interrogations of what it means to teach law subversively. Primarily aimed at legal educators and doctoral students in law planning careers as academics, its insights speak directly to tensions in higher education more broadly.

Available in PDF, EPUB and Kindle. Book excerpt: Hunger, disease, poverty, environmental insecurity, illegitimate governance, civil war, and international conflict are only a few of the causes of today's global turmoil and gross human suffering. Written in honour of Ivan Head, foreign affairs advisor to former Prime Minister Pierre Trudeau, past president of Canada's International Development Research Centre, and professor emeritus of International law at the University of British Columbia, this collection of distinguished essays addresses the imperative to enhance human dignity and protect human life by humanizing our global order and improving international relations - goals Professor Head strove for throughout his career. The authors argue that the search for possible solutions to these challenges, which has so far tended to proceed without due recognition of the needs, demands, and solutions that emanate from the geo-political South, must in future be conducted with alternate visions that take these factors into account. Each essay seeks to re-assess and re-imagine a specific topic that relates in some significant way to our current global circumstance in ways that advance the book's thematic. With essays grappling with such issues as Multilateral Environmental Agreements, the Use of Force, the Prevention of Civil War through Minority Protection, Common Heritage of Humankind, and the Civil Dimensions of Strategy, the volume deals with a range of diverse topics that are as crucial as they are topical.

Book excerpt: The first-ever look at all 65 Toronto mayors — the good, the bad, the colourful, the rogues, and the leaders — who have shaped the city. Toronto’s mayoral history is both rich and colourful. Spanning 19 decades and the growth of Toronto, from its origins as a dusty colonial outpost of just 9,200 residents to a global business centre and metropolis of some three million, this compendium provides fascinating biographical detail on each of the city’s mayors. Toronto’s mayors have been curious, eccentric, or offbeat; others have been rebellious, swaggering, or alcoholic. Some were bigots, bullies, refugees, war heroes, social crusaders, or bon vivants; still others were inspiring, forward looking, or well ahead of their time. One Toronto mayor attempted to kill a predecessor, but his pistol jammed. Another simply beat up the councillors he didn’t like. One committed murder, while another carried out a home invasion. And under the threat of capture and certain death, two mayors were forced to escape the city and live for years in exile, while another had 18 kids and cried poor, yet died on a luxury European vacation (minus the kids). One mayor was involved in the brutal torture of an opposition candidate. Another went insane while in office due to acute third stage syphilis. Each mayor is the inheritor of a rich legacy of hopes and dreams, ambitions and efforts, successes and failures. From the first mayor in 1834 — the firebrand rebel William Lyon Mackenzie — to those of the 21st century — Mel Lastman, David Miller, Rob Ford, and John Tory — Toronto Mayors looks at where each came from, how they came to lead the city, what issues they dealt with, and how they steered Toronto’s City Council.
