Book excerpt: This new and fully updated edition of Principles of International Environmental Law offers a comprehensive and critical account of one of the fastest growing areas of international law: the principles and rules relating to environmental protection. Introducing the reader to the key foundational principles, governance structures and regulatory techniques, Principles of International Environmental Law explores each of the major areas of international environmental regulation through substantive chapters, including climate change, atmospheric protection, oceans and freshwater, biodiversity, chemicals and waste regulation. The ever-increasing overlap with other areas of international law is also explored through examination of the inter-linkages between international environmental law and other areas of international regulation, such as trade, human rights, humanitarian law and investment law. Incorporating the latest developments in treaty and case law for key areas of environmental regulation, this text is an essential reference and textbook for advanced undergraduate and postgraduate students, academics and practitioners of international environmental law.

Book excerpt: In the 21st century, anthropogenic (human-caused) environmental change is widespread and serious on the global, regional/transboundary, and local levels. Emphasizing the environmental, social, and human damage caused by non-sustainable development, International Environmental Law and Policy for the 21st Century, Second Revised Edition by Nanda and Pring, provides readers with an incisive and integrated approach to the political, economic, scientific, and technological realities and challenges facing international environmental law and policy today. This provocative new book offers innovative chapters on such crucial current imperatives as: • the nature and scope of the challenge; • first principles of international environmental law; • environment and human rights; • environment and the nexus of international trade, finance and debt; and • the unfinished agenda. Traditional subjects covered include the history of international environmental law, the law of the sea, international freshwater resources, cross-border air pollution, ozone depletion and climate change, the technology of chemicals manufacture and transport, disposal of hazardous waste, preservation ofand biodiversity, environmental impact analysis, and regulation of nuclear energy. The book also features a critical examination of the UN’s activities on the environment, starting from the 1972 Stockholm Convention on the Environment, up to and including the 2012 Rio+20 Conference on Sustainable Development. With new chapters devoted to critical energy and population issues, and a new section on corporate social responsibility, International Environmental Law & Policy for the 21st Century is an essential resource for students, scholars, lawyers, public officials, corporate decision-makers, and technical consultants concerned with environmental issues.

Available in PDF, EPUB and Kindle. Book excerpt: Waste management poses increasing challenges to both the protection of the environment and to human health. To face these challenges, this book claims that environmental law needs to shift attention from media-specific pollution regimes to integrative life-cycle approaches of waste management i.e., from the prevention of waste generation to the actual handling of wastes. Furthermore, the cooperation of States and the establishment of coordinated activities is essential because states can no longer have separate standards for wastes posing transboundary risks and for ‘purely domestic’ wastes. Drawing upon both International and EU law, the book provides a detailed analysis of the regimes set up to deal with the transboundary movement of wastes and ship-source pollution, so as to elucidate the obligations and legal principles governing such regimes. It concludes that treaty obligations concerning transboundary movements of wastes are inapplicable to ship wastes while on board ships and on land. However, despite the limitations of the transboundary movement of wastes regime, the principle of Environmentally Sound Management (ESM) embodied in this regime has gradually transformed into a legal principle. ESM works to address the legal gaps in the regulation of wastes, and consequently, it provides the desired coherence to the legal system since it acts as a bridge between several regulatory and sectoral levels. Furthermore, ESM offers a new light with which to understand and interpret existing obligations, and it provides a renewed impetus to regimes that directly and indirectly govern wastes. This impetus translates into greater coordination and the establishment of cross-sectional policies. By offering alternative ways to solve problems linked to the management of ship wastes in the sea-land interface, this book will appeal to anyone with an interest in International Environmental Law.

Available in PDF, EPUB and Kindle. Book excerpt: Ship recycling conserves resources, employs an unskilled workforce, and removes outdated tonnage. Operating mainly on the Indian subcontinent, this ‘primitive’ industry often results in loss of human life and pollution of the marine environment. Despite moral indignation, the international community has struggled to manage this industry and only recently completed the IMO International Convention for the Safe and Environmentally Sound Recycling of Ships. Using the Indian experience on shipbreaking as a case study, this book assesses the strengths and weaknesses of the Convention. The author argues that the Convention may not succeed because it fails to strike a balance between environmental protection, human rights, and commercial realities. The book offers recommendations for a holistic and integrated approach to a sustainable ship recycling industry.

Book excerpt: Environmental activists and academics alike are realizing that a sustainable society must be a just one. Environmental degradation is almost always linked to questions of human equality and quality of life. Throughout the world, those segments of the population that have the least political power and are the most marginalized are selectively victimized by environmental crises. This book argues that social and environmental justice within and between nations should be an integral part of the policies and agreements that promote sustainable development. The book addresses the links between environmental quality and human equality and between sustainability and environmental justice.

Book excerpt: The Law and Politics of Sustainability explores efforts made to address pressing environmental concerns through legislation, conventions, directives, treaties, and protocols. Articles explain the mechanics of environmental law, the concepts that shape sustainable development, case studies and rulings that have set precedents, approaches to sustainable development taken by legal systems around the world, and more. Experts and scholars in the field raise provocative questions about the effectiveness of international law versus national law in protecting the environment, and about the effect of current laws on future generations. They analyze the successes and shortcomings of present legal instruments, corporate and public policies, social movements, and conceptual strategies, offering readers a preview of the steps necessary to develop laws and policies that will promote genuine sustainability.
