Book excerpt: On 15 August 1990 the Vatican issued Pope John Paul's Apostolic constitution Ex corde Ecclesiae (From the Heart of the Church) concerning Catholic higher education. Promulgated as law, the document deal firstly with the Catholic identity and mission of the college or university, and secondly with the general norms for all institutes of higher studies. The document also reflects and reaffirms the mandatum of c. 812. This study looks at the mandatum and how the norms of Ex corde Ecclesiae are implemented at a Catholic college in the United States that is sponsored by a religious institute by attempting to place the discussion in the context of the American culture. Beginning with a canonical look at the defining moment when one becomes a Catholic and an historical examination of the university system and the Catholic Church, this study shows the intimate relation that religious institutes have had with higher education. In the United States there are over 230 Catholic colleges and universities and other such institutions of higher studies, most of which are canonically and civilly connected to a religious institute. The question is what role does the sponsoring religious institute have in the canonical compliance of their separately incorporated apostolate in the implementation of the norms of Ex corde Ecclesiae? Discussed in this work are the canonical obligations and rights of the diocesan bishop, the religious institute, the college (administrators and trustees) and the professors of theological disciplines. This study also looks at some of the issues of concern that were raised by theologians, canonists, colleges and universities, religious institutes and bishops relating to the implementation of Ex corde Ecclesiae. It took ten years for the bishops of the United States to receive the Vatican recognitio for "The Application of Ex corde Ecclesiae for the United States" to be used in the implementation of Ex corde Ecclesiae for American Catholic colleges and universities. On 3 May 2001 the Application became particular law for the United States. St. Norbert College, a Norbertine sponsored college in De Pere, Wisconsin, USA, is used as the case study for this work.

Book excerpt: Hans Reichenbach (1891-1953) was a formidable figure in early-twentieth-century philosophy of science. Educated in Germany, he was influential in establishing the so-called Berlin Circle, a companion group to the Vienna Circle founded by his colleague Rudolph Carnap. The movement they founded--usually known as "logical positivism," although it is more precisely known as "scientific philosophy" or "logical empiricism"--was a form of epistemology that privileged scientific over metaphysical truths. Reichenbach, like other young philosophers of the exact sciences of his generation, was deeply impressed by the far-reaching changes in physics brought about by Einstein's special and general theories of relativity. Reichenbach responded to scientific advances by doing fundamental work in space-time theories, in quantum mechanics, in statistical mechanics, and in the development of probability theory--making him the most important philosopher of physics in the first generation of logical empiricism. Forced from his academic position by the Nazi race laws in 1933, Reichenbach wrote Experience and Prediction at the University of Istanbul, where had had fled, expressly to introduce logical positivism to English speakers. In the two decades following World War II, during the explosion of scientific advances in North America, logical positivism was the reigning theory of the philosophy of science and Reichenbach was at the peak of his career. But, inevitably, support for logical positivism began to wane as it became obvious that the justification of scientific theories could not be entirely resolved by relying on strictly formal, technical processes. The growth of the discipline of the history of philosophy of science, which has created an audience of scholars eager for seminal classics in scientific philosophy, and the evidence supporting a historicist paradigm within logical positivism are two important reasons to make Experience and Prediction available once again.

These assessments examined presidents and academicians against central principles set forth by the United States Conference of Catholic Bishops (usccb) on how "Ex Corde Ecclesiae" can, and in some instances, should be applied to the American Catholic College. Additionally, this research explored the Catholic university's relationship with the local ecclesial community, how this relationship is sustained, and whether there is mutual trust and consistent dialogue between the ecclesial community and the university. In particular, the unique relationship between the local Bishop and the president was explored. This study utilized a dominant-less dominant design. Presidents and academicians received a survey in the spring of 2011 and results were summarized and presented to a sample of presidents and theologians for interviews. Research findings confirm that presidents believe their institutions are subscribing to "Ex Corde Ecclesiae" and are more optimistic in their beliefs than academicians. In addition, results show a majority of Catholic theologians surveyed have received the mandatum from their bishop. Moreover, the research suggests presidents have trusting but not clear relationships with their bishop. Other results suggest presidents have a strong desire to hire for mission but lack critical information in this regard, and theologians face self-imposed and external challenges toward achieving the ideals of "Ex Corde Ecclesiae." Book excerpt: Heresy in the Heartland is a narrative case study of the 'Heresy' Affair at the University of Dayton, a series of events predominantly in the philosophy department that occurred when tensions between the Thomists and proponents of new philosophies reached crisis stage in fall 1966. The controversy culminated in a letter written by a lay assistant professor to the Cincinnati archbishop, Karl J. Alter. In the letter, the professor cited a number of instances where “erroneous teachings” were “endorsed” or “openly advocated” by four lay faculty members. Concerned about the pastoral impact on the University of Dayton community, the professor asked the archbishop to conduct an investigation. How the University weathered this controversy, the second of three major controversies to hit Catholic higher education within three years (St. John’s University, University of Dayton and the Curran affair at Catholic University of America), is of interest to faculty and administrators in Catholic higher education who continue to struggle with defining what it means to be a “Catholic” university, with the relationship of Catholic universities to the Church at large and the hierarchy in particular, and with Church teachings that conflict with the culture we live in such as immigration, the environment and sexual ethics. The story is told in chronological order by the participants in the controversy - faculty, administrators, students and clergy - using the words of those involved. Heresy in the Heartland concludes with a synopsis of what happened at the University of Dayton and draws some lessons for the future of Catholic higher education.
