Available in PDF, EPUB and Kindle. Book excerpt: The leave procedure is used primarily by lawyers and the courts as a necessary first step to obtaining judicial review of government acts. It is, therefore, in the forefront of the regulation of public officials that touches the social, economic and political well-being of the people. The procedure for instituting judicial review actions under Order 16 of the National Court Rules, however, is a relatively new field of legal practice in Papua New Guinea. The novelty as well as the technical nature of this procedure presents many problems to judges and legal practitioners. This book addresses these problems and provides a critical insight into the judicial review process. Most importantly, it offers a practical guide to judges and lawyers. It is an important and unique contribution to the legal literature of Papua New Guinea, which should impact positively on advocacy and fairness in the judicial system.

Book excerpt: In 1991 the Lord Chancellor announced that the Law Commission would undertake a comprehensive review of the procedures and remedies available through judicial review. Coinciding with this announcement, the Public Law Project, in collaboration with Maurice Sunkin of the University of Essex, launched an empirical study of access to and the use of judicial review. This second edition updates the original report and presents the results of further analysis of the original data on the progress of leave applications considered by individual judges to their final outcome. It also updates data on legal aid applications to take judicial review proceedings.

Available in PDF, EPUB and Kindle. Book excerpt: A Guide to Expert Witness Evidence is a uniquely comprehensive exploration of expert witness evidence in Ireland. This new book places the expert witness in context, giving an overview of the Irish legal system both civil and criminal, and the different types of quasi-judicial tribunals and arbitration/mediation procedures. Once placed in this context, the practicalities of the expert witness' role are explored. The book explains who can be an expert witness, the scope and the limits of evidence given by expert witnesses, and the function and duty of expert witnesses. A key part of the book examines the role of the expert in a pre-trial context, including report writing, as well as the expert giving evidence in court. The book then examines experts in various contexts, whether in the commercial courts, family law, local authority disputes, or criminal, medical and engineering trials. The book is not only aimed at lawyers but also potential expert witnesses. In this way the book is a truly comprehensive guide to expert witness evidence, detailing not only the background and the logistics but also the practicalities.

Book excerpt: Traditional separation of powers theories assumed that governmental despotism will be prevented by dividing the branches of government which will check one another. Modern governments function with unexpected complicity among these branches. Sometimes one of the branches becomes overwhelming. Other governmental structures, however, tend to mitigate these tendencies to domination. Among other structures courts have achieved considerable autonomy vis-à-vis the traditional political branches of power. They tend to maintain considerable distance from political parties in the name of professionalism and expertise. The conditions and criteria of independence are not clear, and even less clear are the conditions of institutional integrity. Independence (including depolitization) of public institutions is of particular practical relevance in the post-Communist countries where political partisanship penetrated institutions under the single party system. Institutional integrity, particularly in the context of administration of justice, became a precondition for accession to the European Union. Given this practical challenge the present volume is centered around three key areas of institutional integrity, primarily within the administration of justice: First, in a broader theoretical-interdisciplinary context the criteria of institutional independence are discussed. The second major issue is the relation of neutralized institutions to branches of government with reference to accountability. Thirdly, comparative experience regarding judicial independence is discussed to determine techniques to enhance integrity.

It begins with an overview of the structure of a typical MD/PhD program as well as student outcomes and career choices of MD/PhD graduates. Next is an outline of the academic and extracurricular prerequisites as well as the basic components of the application itself. The authors then address the factors that MD/PhD students should consider when selecting schools to which to apply. Continuing to the main application, examples are provided of all the different essay types that MD/PhD applicants will encounter along with comments on how to address the deliberately vague and abstract prompts while tailoring the responses to the combined-degree program. Most uniquely, included is a very detailed explanation of the many types of interviews that applicants will encounter and how to prepare for them by integrating extensive personal experience and first-hand discussions with MD/PhD program leaders. Lastly, there will be a discussion on how to cope with the year-long timeline that constitutes this application process and provide guidance regarding properly responding to acceptances and waitlist offers. Written by a team of authors each experienced with the MD/PhD application, this book aids the prospective applicant with navigating this challenging process.
