C. Malale, 5558. The defendant, a. Kangany, was charged by Labor the complainant (tucker) with gross neglect of duty and disobedience Ordinance of orders. It appeared from the evidence that, on the 3rd of Decem ber last, the accused had been ordered after the day's work to watch the store all night, being promised a holiday on the morrow, and that he had refused to do so, never having acted as a watcher before. The Magistrate (penney), having held that the order in question was a reasonable one, and that no justification was proved for the defence, convicted the defendant, and sentenced him to one month's hard labor.
