Book excerpt: The Constitution of Papua New Guinea is both a document in legal theory -- stating the goals and basic premises of the society -- and a set of laws: the fundamental laws of the nation. It is a 'home grown' political and legal roadmap for the nation's development, underpinned by ideas of national self-respect, democracy and equality. This book contains the text of the Constitution of Papua New Guinea, annotated with the authors' comments and references to relevant reports and judgments. It is an essential reference book not only for lawyers, law students and judges but also for Members of Parliament and members of the State Services who, in the performance of their duties to the people, must be guided by the laws of the country.

Available in PDF, EPUB and Kindle. Book excerpt: This book explores critical issues about how courts engage with questions of fact in public law adjudication. Although the topic of judicial review - the mechanism through which individuals can challenge governmental action - continues to generate sustained interest amongst constitutional and administrative lawyers, there has been little attention given to questions of fact. This is so despite such determinations of fact often being hugely important to the outcomes and impacts of public law adjudication. The book brings together scholars from across the common law world to identify and explore contested issues, common challenges, and gaps in understanding. The various chapters consider where facts arise in constitutional and administrative law proceedings, the role of the courts, and the types of evidence that might assist courts in determining legal issues that are underpinned by complex and contested social or policy questions. The book also considers whether the existing laws and practices surrounding evidence are sufficient, and how other disciplines might assist the courts. The book reconnects the key practical issues surrounding evidence and facts with the lively academic debate on judicial review in the common law world; it therefore contributes to an emerging area of scholarly debate and also has practical implications for the conduct of litigation and government policy-making.

Available in PDF, EPUB and Kindle. Book excerpt: Twenty-five years after independence, Papua New Guinea is beset by social, economic, and political problems: poverty and inequality, a young and expanding population, a stagnant economy, corruption, and rising crime. The state has not only failed to contain these problems but has become progressively implicated in their persistence. Escalating levels of violence and lawlessness are seen by many as the most serious challenge facing the young country. This book examines these problems of order in light of Papua New Guinea’s remarkable social diversity and the impact of rapid and pervasive processes of change. Three original and strategic case studies involving urban gangs, mining security, and election violence form the core of the work. Each case study looks at particular forms of conflict, and the responses these engender, across different socioeconomic contexts and geographic locations. Empirical data are analyzed through a common framework that employs material, cultural and institutional perspectives, allowing readers to view the three cases through different theoretical prisms, identify linkages between them, and, in the process, build a larger picture of the post-colonial social order. Law and Order in a Weak State charts not only the problems of crime and lawlessness in Papua New Guinea but also the possibilities for constructive, pragmatic solutions. It will be of great interest to scholars, aid and policy officials, and others concerned with understanding the social complexities and challenges of contemporary Papua New Guinea.

Book excerpt: If ordering outside Australasia (ie from UK, Europe, Nth and Sth America and Africa) please contact Zed Books (UK) directly: www.zedbooks.co.uk.Pat Howley tells the extraordinary story of how, in the 1990s, in the crisis of civil war, the people of the island of Bougainville returned to their traditional peace making and conflict resolution processes as the western court system collapsed. Prominent are the ordinary people who experienced the crisis - the victims, the freedom fighters, and the women who took a leading part in the peace process. Howley writes mostly through their eyes, in their words.Howley, Executive Director of the PEACE Foundation Melanesia, was with them through most of the war. He oversaw a marriage of Western learning on restorative justice and win-win mediation with custom law. The success was so extraordinary that the processes set up are now being used in most village communities as the norm for conflict resolution, even for serious matters such as murder. Howley analyses the effectiveness of this marriage and how it can be used in the future when Bougainville achieves autonomy. He also discusses the devastation to Bougainville's culture and identity caused by the giant copper mine which dominated the PNG economy, and how the islanders are coping with the residue of trauma from the civil war."A landmark study of reconciliation and restorative justice in action, profound and inspiring in its holistic view of justice ... Bougainville shows the world how indigenous people can reclaim their justice system ... This book shows how a people's peace can prevail over a war that was a product of colonisation."Professor John Braithwaite, Australian National University

Available in PDF, EPUB and Kindle. Book excerpt: SECURING VILLAGE LIFE: DEVELOPMENT IN LATE COLONIAL PAPUA NEW GUINEA examines the significance for post-World War II Australian colonial policy of the modern idea of development. Australian officials emphasised the importance of bringing development for both the colony of Papua and the United Nations Trust Territory of New Guinea. The principal form that development took involved securing smallholders against the tendencies of other forms of capitalist development that might have separated households from land. In order to make household occupation of their holdings more secure and at higher standards of living, the colonial administration coordinated and supervised increases in production of crops and other agricultural produce. Contrary to suggestions that colonial policy and practice ignored indigenous agriculture and concentrated on plantation crops grown by international firms and expatriate owner-occupiers, the study shows how the main focus was instead upon increasing smallholder output for immediate consumption as well as for local and international markets. Simultaneously development stimulated increases in consumption, including of goods produced through manufacturing processes and imported into the colony. Only as Independence approached was the pre-eminence of the earlier focus upon smallholders weakened. In part the change occurred due to the political advance of the indigenous capitalist class and their allies seeking to extend their base in largeholding agriculture and related commercial activities. This advance and the uncertainty over which form of development would prevail once indigenes held state power in post-colonial Papua New Guinea stood in marked contrast to the definite direction pursued under the colonial administration of the 1950s and early 1960s.
