Book Synopsis Law and Identity in Colonial South Asia by : Mitra Sharafi
Download or read book Law and Identity in Colonial South Asia written by Mitra Sharafi and published by Cambridge University Press. This book was released on 2014-04-21 with total page 369 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book explores the legal culture of the Parsis, or Zoroastrians, an ethnoreligious community unusually invested in the colonial legal system of British India and Burma. Rather than trying to maintain collective autonomy and integrity by avoiding interaction with the state, the Parsis sank deep into the colonial legal system itself. From the late eighteenth century until India's independence in 1947, they became heavy users of colonial law, acting as lawyers, judges, litigants, lobbyists, and legislators. They de-Anglicized the law that governed them and enshrined in law their own distinctive models of the family and community by two routes: frequent intra-group litigation often managed by Parsi legal professionals in the areas of marriage, inheritance, religious trusts, and libel, and the creation of legislation that would become Parsi personal law. Other South Asian communities also turned to law, but none seems to have done so earlier or in more pronounced ways than the Parsis.

Book Synopsis The Prosecutor and the Judge by : Heikelina Verrijn Stuart
Download or read book The Prosecutor and the Judge written by Heikelina Verrijn Stuart and published by Amsterdam University Press. This book was released on 2009 with total page 193 pages. Available in PDF, EPUB and Kindle. Book excerpt: Earlier this year, the Praemium Erasmianum Foundation bestowed its annual award—the Erasmus Prize—on Benjamin Ferencz and Antonio Cassese, two pioneers in the field of international law. Ferencz, a leading American prosecutor, author, and lecturer, was present at the American war crimes trials in Dachau and was the chief prosecutor in the Einsatzgruppen trials in Nuremburg. Like Ferencz, Cassese was a key figure in the development of international criminal law, serving as the first president of the International Criminal Tribunal for the former Yugoslavia and president of the European Committee for the Prevention of Torture, and chairman of the UN Commission of Inquiry into Violation of Human Rights and Humanitarian Law in Darfur. Cassese is currently the president of the Special Court for Lebanon. In The Prosecutor and the Judge, Heikelina Verrijn Stuart and Marlise Simons provide in-depth, revealing interviews with these two advocates of international law. Supplementing the interviews are several key articles written by Ferencz and Cassese that highlight the two men’s achievements and set the development of international law in context.

Book Synopsis Precedent in Law by : Laurence Goldstein
Download or read book Precedent in Law written by Laurence Goldstein and published by Oxford University Press, USA. This book was released on 1987 with total page 304 pages. Available in PDF, EPUB and Kindle. Book excerpt: It has been said that precedent is the life blood of legal systems. Certainly, an understanding of precedent is vital to an understanding of the workings of law. The principle that decisions should follow those of past similar cases seems simple enough, yet it turns out to be beset with difficulties. What is the justification for following precedents? Do we want absolute, unswerving following of past decisions or a weaker implementation that allows for limited departures? What social and theoretical forces wrought changes in the doctrine? Are judicial pronouncements on precedent rules or just conventions? How do we identify the ratio decidendi of a case? What are the means by which a general "projectable" conclusion may be elicited from a particular judgment? These are some of the problems addressed by contributors to this volume.

Book Synopsis Shipping and Globalization in the Post-War Era by : Niels P. Petersson
Download or read book Shipping and Globalization in the Post-War Era written by Niels P. Petersson and published by Springer Nature. This book was released on 2019-11-21 with total page 292 pages. Available in PDF, EPUB and Kindle. Book excerpt: This open access book belongs to the Maritime Business and Economic History strand of the Palgrave Studies in Maritime Economics book series. This volume highlights the contribution of the shipping industry to the transformations in business and society of the postwar era. Shipping was both an example and an engine of globalization and structural change. In turn, the industry experienced and pioneered, mirrored and enabled key developments that led to the present-day globalized economy. Contributions address issues such as the macro-level shift of shipping’s centre of gravity from Europe to Asia, the political and legal frameworks within which it developed, the strategies and performance of both successful and unsuccessful firms, and the links between the shipping industry and the wider economy and society. Without shipping and its ability to forge connections and networks of a global reach, the modern world would look very different. By bringing together scholars from various disciplinary and national backgrounds, this book advances our understanding of the linkages that bind economies and societies together.

Book Synopsis Women and the Labour Movement in Scotland, 1850-1914 by : Eleanor Gordon
Download or read book Women and the Labour Movement in Scotland, 1850-1914 written by Eleanor Gordon and published by . This book was released on 1991 with total page 338 pages. Available in PDF, EPUB and Kindle. Book excerpt: A study of working women in Scotland in the late 1900s, this book uncovers the patterns of employment, involvement in and relationship to trade unions, and the forms of workplace resistance and struggles in which these women engaged. Focusing particularly on women working in Dundee's jute industry, Gordon integrates labor and gender history, which challenges many assumptions about the organizational apathy of women workers and the inevitable division between workplace and domestic ideologies. This book makes an important contribution to current historiographical debate over the sexual division of labor, working-class consciousness, domestic ideologies, and to the history of women in Scotland.
