White and Chiles et als. is the result of investigations begun in 1912 for a seminar paper in American History at Columbia University. At the suggestion of Professor William A. Dunning and urged by his own feeling that there was a place for an extended study of the great case, the writer expanded and amplified those preliminary investigations. A large part of the present essay was published in 1915 in the Southwestern Historical Quarterly, and is now reproduced through the courtesy of the editors of the publication. For the purpose of its present form, however, it has been subjected to thorough revision and has been somewhat enlarged. In large part, the monograph deals with certain aspects of American political theory, about which there has been and is much bitter controversy. In view of this fact, he admits feeling some hesitancy in submitting the section on "The Location of Sovereignty in the United States." While this section is presented as setting forth the ideas and theory of the court, it is but right to say that in the writer's conception this theory is the best explanation of the Union. If the essay may serve to throw more light upon this theory, it shall have largely achieved its purpose. It is doubtless unnecessary to disavow any intention of theorizing or speculating about the nature of sovereignty. The writer has been greatly aided by the suggestions and comments of friends to whom he returns sincere thanks. Book excerpt: The history of voting rights in America is a checkerboard marked by dogged progress against persistent prejudice toward an expanding inclusiveness. The Supreme Court decision in Smith v. Allwright is a crucial chapter in that broader story and marked a major turning point for the modern civil rights movement. Charles Zelden's concise and thoughtful retelling of this episode reveals why. Denied membership in the Texas Democratic Party by popular consensus, party rules, and (from 1923 to 1927) state statutes, Texas blacks were routinely turned away from voting in the Democratic primary in the first decades of the twentieth century. Given that Texas was a one-party state and that the primary effectively determined who held office, this meant the total exclusion of Texas blacks from the political process. This practice went unchecked until 1940, when Lonnie Smith, a black dentist from Houston, fought his exclusion by election judge S. E. Allwright in the 1940 Democratic Primary. Defeated in the lower courts, Smith finally found justice in the U.S. Supreme Court, which ruled 8-1 that the Democratic Party and its primary were not "private and voluntary" and, thus, were duly bound by constitutional protections governing the electoral process and the rights of all citizens. While the initial impetus of the case may have been the wish of one man to exercise his right to vote, the real meaning of Smith's challenge to the Texas all white primary lies at the heart of the entire civil rights revolution. One of the first significant victories for the NAACP's newly formed Legal Defense Fund against Jim Crow segregation, it provided the conceptual foundation which underlay Thurgood Marshall's successful arguments in Brown v. Board of Education. It was also viewed by Marshall, looking back on a long and storied career, as one of his most important personal victories. As Zelden shows, the Smith decision attacked the intractable heart of segregation, as it redrew the boundary between public and private action in constitutional law and laid the groundwork for many civil rights cases to come. It also redefined the Court's involvement in what had been a hands-off area of "political questions" and foreshadowed its participation in voter reapportionment cases. A landmark case in the evolution of Southern race relations and politics and for voting rights in general, Smith also provides a telling example of how the clash between national concerns and local priorities often acts as a lightning rod for resolving controversial issues. Zelden's lucid account of the controversies and conflicts surrounding Smith should refine and reinvigorate our understanding of a crucial moment in American history.

Book excerpt: The demise of the Confederacy left a legacy of legal arrangements that raised fundamental and vexing questions regarding the legal rights and status of former slaves and the status of former Confederate states. As Harold Hyman shows, few individuals had greater impact on resolving these difficult questions than Salmon P. Chase, chief justice of the United States Supreme Court from 1865 to 1873. Hyman argues that in two cases—In Re Turner (1867) and Texas v. White (1869)—Chase combined his abolitionist philosophy with an activist jurisprudence to help dismantle once and for all the deposed machineries of slavery and the Confederacy. In these cases, Chase sought to consolidate the gains of the Civil War era, while demonstrating that the war had both preserved the precious core characteristics of the federal union of states and fundamentally improved the nature of both private and public law. In Re Turner was a private law case decided at the federal circuit level. It involved a black woman's claim that she, a recent slave, was being held in involuntary servitude. Elizabeth Turner's mother had apprenticed Elizabeth to their former master, who had not abided by his contractual obligations to provide Elizabeth with training and compensation, substantively keeping her in slavery. Chase's decision, which relied upon due process and equal protection implications in the thirteenth amendment and 1866 Civil Rights Act, confirmed the rights of emancipated slaves to bargain and contract with employers on a parity with white workers. Texas v. White was a public law case decided in the Supreme Court. It revolved around the issue of whether the holders of U.S. bonds seized and sold by the Confederate state of Texas could demand payment after the war from that state's newly reconstructed government. In effect, Chase and his associate justices were asked to determine the legality of actions committed by all former Confederate states and, thus, to define what constituted a state. Chase's opinion reaffirmed the Union's permanence, and that of the constituent states in the federal union, and the states' duty to respect the legal rights and obligations of all citizens because states were people as well as acreages and institutions. Hyman's exemplary analysis of these cases reveals how their political, legal, and constitutional aspects were so inextricably interwoven. They secured for Chase a rostrum for both moral and legal reform from which he asserted his strong views on the fundamental rights of individuals and states in an era of sporadically increasing federal power. Hyman's study provides a much-needed reevaluation of those cases both in the context of Chase's life and in terms of their mark on history.
