Available in PDF, EPUB and Kindle. Book excerpt: Before OPEC took center stage, one state agency in Texas was widely believed to set oil prices for the world. The Texas Railroad Commission (TRC) evolved from its founding in 1891 to a multi-divisional regulatory commission that oversaw not only railroads but also a number of other industries central to the modern American economy: petroleum production, natural gas utilities, and motor carriers (buses and trucks). William R. Childs's unprecedented study of the TRC from its founding until the mid-twentieth century extends our knowledge of commission-style regulation. It focuses on the interplay between business and regulators, between state and national regulatory commissions, and among the three branches of government through a process of "pragmatic federalism." Drawing on extensive primary research, Childs demonstrates that the alleged power of regulatory commissions has been more constrained than most observers have recognized. As he shows, the myth of power was devised by the agency itself as part of building a civil religion of Texas oil. Together, the myth and the civil religion enabled the TRC to convince Texas oil operators to follow production controls and thus stabilized the American oil industry by the 1940s. The result of this fascinating study is a more nuanced understanding of federalism and of regulation, the forces shaping it, and its outcomes.

Book excerpt: The Landman Lease and Title Manual is designed to impart upon the new and lightly experienced landman the essential skills and knowledge necessary to work in the oil and gas industry. The manual is not designed as a substitute for the traditional mentor-type learning characteristic of the oil and gas industry, nor is the manual a treatise on the law of oil and gas or land titles. The Landman Field Manual, rather, is structured to aid in development of essential title research skills and in understanding Texas oil, gas and land title law as it relates to the work performed by field landmen.

Available in PDF, EPUB and Kindle. Book excerpt: Nineteenth-century editorial cartoons often pictured government and industry hand-in-hand. Yet as early as 1889 Texas had enacted an antitrust law to curb the power of monopolies, and in the first years of the industry that would bring untold riches to the state, the attorney general used that law against oil trusts to a surprising extent. Ironically, for most of the first twenty-five years following the enactment of the Sherman Antitrust Act, federal enforcement efforts were extremely limited, leaving the field to the states. Texas was one of several states that had strong antitrust laws and whose attorneys general prosecuted antitrust violations with vigor. Political ambition was a factor in the decisions to investigate and prosecute cases against a highly visible target, the petroleum industry, but there was also a genuine belief in the goals of antitrust policy and in the efficacy of enforcement of the laws. In Broken Trusts, Jonathan Singer offers the definitive study of the formative period of antitrust enforcement in Texas. His analysis of the state attorney general’s use of antitrust law against the oil industry in this time of transition from agricultural to industrial society provides insights into the litigation process, the gap between the rhetoric of trust-busting and the reality of antitrust enforcement, and also the changing roles of state government in the late nineteenth and early twentieth centuries. The experience of Texas undermines the view that federal action has always dominated antitrust enforcement efforts and that antitrust litigation against Standard Oil was ineffectual. Rather, the results of the Texas attorney general’s litigations suggest that some states took their role in the dual enforcement scheme seriously and that the measure of success of antitrust enforcement goes beyond the amount of monetary penalties collected and the number of companies permanently ousted from a state. This volume will be valuable to those interested in the effects of the Sherman Antitrust Act, as well as those concerned with the evolution of the Texas attorney general’s office.

Available in PDF, EPUB and Kindle. Book excerpt: In the 1920s, the law of oil and gas in Texas was a frontier: raw and unsettled. As Assistant Attorney General in charge of the land desk, Edgar Smith found himself a fascinated observer and an active player in some the most important cases in the history of Texas land and oil law. This is Edgar Smith's legal autobiography. In it, he lays out the the facts of the cases he argued and why he won, while presenting the arguments of his opponents in a fair light. The cases he covers include Capitol Syndicate case, Red River Boundary case, Relinquishment Act, case of the "So-called Oil Leases" and more. Smith went on to work for Baker, Botts & Parker & Garwood (now Baker Botts) and includes a concise history of the firm, as well as an excellent character sketch of Judge Garwood.

Book excerpt: Knowing all the ins and outs of property law from state to state can be a difficult and time-consuming task. When issues arise related to ownership and tenancy of property, it is important for lawyers, real estate brokers and agents, and landmen to have an efficient and comprehensive way to both understand and clarify the precedents, regulations, and rights associated with state property laws. Lytton's Handbook on Texas Property Law covers a broad expanse of various aspects of Texas property law, and it offers a range of comprehensive perspectives on many topics related to property, ownership, sovereignty, and landlord/tenant rights. Containing thirty chapters with extensive citations to legal authority, it provides law and real estate professionals with a user-friendly and practical guidebook for quickly and efficiently navigating and understanding Texas property law, codes, and legal precedent. When legal disputes arise related to owning and leasing property; maintaining estates; managing residential or commercial tenancies and condominiums; handling deeds, mortgages, and covenants; and controlling rights to waters, soils, and products of the land, this comprehensive handbook can help both professionals and laypersons better understand both the laws and how to approach resolution.
