Available in PDF, EPUB and Kindle. Book excerpt: John C. Domino examines Texas Supreme Court Justice Bob Gammage’s progressive jurisprudence during the most tumultuous period in Texas judicial history. This era witnessed numerous seismic shifts, including the manner in which judicial campaigns were conducted, the rise of million dollar judicial races, a dramatic change in the partisan and ideological composition of the Texas Supreme Court, the Court of Criminal Appeals, and most of the fourteen intermediate appellate courts, as well as the birth of the judicial reform movement in Texas. Gammage, who served as a court of appeals judge and as a state supreme court justice, forged a solid liberal record arguing for robust individual rights, including the right to privacy, freedom of expression, due process, and equal protection, whether those rights were implied in the Texas constitution, rooted in an evolving common law, or set out in state and federal judicial precedent.

Available in PDF, EPUB and Kindle. Book excerpt: The laws that governed the institution of slavery in early Texas were enacted over a fifty-year period in which Texas moved through incarnations as a Spanish colony, a Mexican state, an independent republic, a part of the United States, and a Confederate state. This unusual legal heritage sets Texas apart from the other slave-holding states and provides a unique opportunity to examine how slave laws were enacted and upheld as political and legal structures changed. The Laws of Slavery in Texas makes that examination possible by combining seminal historical essays with excerpts from key legal documents from the slave period and tying them together with interpretive commentary by the foremost scholar on the subject, Randolph B. Campbell. Campbell's commentary focuses on an aspect of slave law that was particularly evident in the evolving legal system of early Texas: the dilemma that arose when human beings were treated as property. As Campbell points out, defining slaves as moveable property, or chattel, presented a serious difficulty to those who wrote and interpreted the law because, unlike any other form of property, slaves were sentient beings. They were held responsible for their crimes, and in numerous other ways statute and case law dealing with slavery recognized the humanness of the enslaved. Attempts to protect the property rights of slave owners led to increasingly restrictive laws—including laws concerning free blacks—that were difficult to uphold. The documents in this collection reveal both the roots of the dilemma and its inevitable outcome.

Available in PDF, EPUB and Kindle. Book excerpt: This book is the first study of late Hanafism in the early modern Ottoman Empire. It examines Ottoman imperial authority in authoritative Hanafi legal works from the Ottoman world of the sixteenth to nineteenth centuries CE, casting new light on the understudied late Hanafi jurists (al-muta'akhkhirun). By taking the madhhab and its juristic discourse as the central focus and introducing "late Hanafism" as a framework of analysis, this study demonstrates that late Hanafi jurists assigned probative value and authority to the orders and edicts of the Ottoman sultan. This authority is reflected in the sultan's ability to settle juristic disputes, to order specific opinions to be adopted in legal opinions (fatawa), and to establish his orders as authoritative and final reference points. The incorporation of sultanic orders into authoritative Hanafi legal commentaries, treatises, and fatwa collections was made possible by a shift in Hanafi legal commitments that embraced sultanic authority as an indispensable element of the lawmaking process.

Book excerpt: The Nazi Viewpoint on the Position and Responsibilities of the Physician in the German National Socialist Society. This work is translated, annotated and introduced by Melvin Wayne Cooper. This is the first translation in English of Rudolf Ramm’s textbook Ärztliche Rechts- und Standeskunde: Der Arzt als Gesundheitserzieher, translated and introduced by Melvin Wayne Cooper. Medical Jurisprudence and Rules of the Medical Profession has been reported to be an influential manual for medical ethics in Nazi Germany and is commonly quoted as representing the Nazi viewpoint of the position and responsibilities of the physician in the National Socialist society. It interprets the National Socialist Weltanschauung, i.e. the National Socialist Philosophical Worldview, and makes explicit how this world view was to be actuated by the true National Socialist physician. It is a good text to attempt to see the National Socialist medical world view from the perspective of its practitioners. Ramm’s text could be viewed as being analogous to an Army Field Manual for the practicing National Socialist physician. It dictates the specific applications of the legal values and rules which emanate from this Weltanschauung to the developing medical students and practicing National Socialist physicians. According to some scholars Ramm’s book, which was written not only for students but also for postgraduates, and which received positive reviews in German medical journals, is the most important known historical source pertaining to the instruction of Nazi medical ethics. The 1942 edition sold out within a year, and a second edition published in 1943 included an extended appendix of medical laws. Through this book Ramm’s unique text is now available for an English language audience, thanks to the thorough translation and accessible introduction by Melvin Wayne Cooper.

Available in PDF, EPUB and Kindle. Book excerpt: In Reinventing American Jurisprudence: Law through the Lens of Value, George David Miller and Laura Brown unfurl an original approach to value and an imaginative landscape in philosophy of law. Value essentialism identifies value formations such as a sacred cow and scapegoat tandem and the intensification of “oughtness” as it approaches sacred zenith values. Readers learn how Occam’s razor has been responsible for the death of many ideas; how the celebrated Other gains nuance as near and remote; and where a spectral assessment of probability and necessity leads. Analyses of Supreme Court cases grow out in different and exciting directions. Buck was not about eugenics, but another iteration of the value of efficiency and Yo Wick was decided less on law and more on a justice’s finding humanity in Chinese laundry mat proprietors. Lochner involved not an ideological binary but three distinct value schemes. “Separate but equal” was refined as parallelism and exploitative tangents. In Brown, the Fourteenth Amendment took a significant subjective turn. In Heller, the communitarian position of stopping violence before it began could be contrasted with the individualistic position of waiting until you see the whites of their eyes in your bedroom. Citizens United was distilled into the question: was the First Amendment designed to maximize participation or maximize democracy?
