This book was released on 2021-08-20 with total page 492 pages. Available in PDF, EPUB and Kindle.

Available in PDF, EPUB and Kindle. Book excerpt: Since it appeared in 1971, John Rawls's A Theory of Justice has become a classic. The author has now revised the original edition to clear up a number of difficulties he and others have found in the original book. Rawls aims to express an essential part of the common core of the democratic tradition--justice as fairness--and to provide an alternative to utilitarianism, which had dominated the Anglo-Saxon tradition of political thought since the nineteenth century. Rawls substitutes the ideal of the social contract as a more satisfactory account of the basic rights and liberties of citizens as free and equal persons. "Each person," writes Rawls, "possesses an inviolability founded on justice that even the welfare of society as a whole cannot override." Advancing the ideas of Rousseau, Kant, Emerson, and Lincoln, Rawls's theory is as powerful today as it was when first published.

Book excerpt: Penal Abolitionism and Transformative Justice in Brazil discusses how penal abolitionism provides fundamental theoretical bases and practical references for the construction of a transformative justice in Brazil, supporting the claim that justice is a socially constructed conception and that victims do not unanimously stand for punishment. The book explores how the active participation of the protagonists of a conflict in a face-to-face negotiation of symbolic reparation, can produce a sense of justice without the need to punish or impose suffering on anyone. Mapping the ways that restorative justice in Brazil has distanced itself from the potential of transformative justice, to the extent that it fails to politicize the conflict and give voice to victims, the book shows how it has resulted in becoming just a new version of penal alternatives with correctionalist content. Moving away from traditional criminal justice language and also from conservative approaches to restorative justice, the author argues that the communicative potential of the transformative kind of redress can be dissociated from the unproved assumption that legal punishment is essential or even likely to achieve justice or deterrence. The arguments are grounded in the Brazilian reality, where life is marked by deep social inequalities and a high level of police violence. By providing a review of the literature on restorative justice, transformative justice, and abolitionism, the book contextualizes the abolitionist debate in Brazil and its history in the 19th century. Penal Abolitionism and Transformative Justice in Brazil is important reading for students and scholars who study punishment and penal abolitionism, to think about what it is possible to do in societies so deeply marked by social injustice and a history of oppression.

Book excerpt: Starting from the assertion that crisis is part of the essence of labour law, this volume brings together researchers in the field who accepted the challenge to critically reflect on this branch of the discipline. As the COVID-19 pandemic has had a global impact, labour law across the world must come to terms with a new reality. In this context, it would be prudent to adapt to new circumstances by taking known paths. To this end, this book reflects on what effectively constitutes labour law, considering questions which are not usual within labour law. Insights from philosophical, sociological and even economic standpoints are mobilised to reconcile the past with the future of labour law.

Book excerpt: This timely special issue looks at a current pressing societal challenge that is truly global in its existence but very local in the way it plays out in various geographical, social and political contexts. Terrorism and extremism are undoubtedly among the biggest problems the world is facing today and is leaving in its wake a trail of death and destruction where the human and social costs are perhaps more significant than wars fought between countries on the world stage. These realities breed suspicion, hatred and feelings of revenge and invariably result in a spiral of violence that seemingly has no end. Not only is there a need to explore the various factors leading to violent youth radicalisation, it is clear that young people need to be considered not as victims ‘at risk’ but rather as responsible agents of positive change. This issue focuses on violent youth radicalisation in the context of Professor Gavrielides’ ‘The Youth Empowerment and Innovation Project (YEIP)’ which looked at the problem of violent youth radicalisation across seven European Countries. The project sought to propose a uniquely different way of combatting violent youth radicalisation by proposing an alternative to punitive means so often favoured by governments. That alternative proposed was to use Positive psychology and the Good Lives model to intervene with young people at risk of violent radicalisation focusing on positive identity and well-being on the premise that young people who had a positive view of themselves would be less likely to be drawn into violent radicalisation.

Available in PDF, EPUB and Kindle. Book excerpt: This book explores developments in international law regarding the relationship between human rights law and international humanitarian law and their coapplicability in armed conflict situations. The work examines the jurisprudence of the international human rights courts and looks at the Inter-American and European Courts of Human Rights case law in dealing with new emergencies in armed conflicts. It argues that a new interpretation and application of the law is required to deal with current needs while remaining faithful to moral commitments made in the international arena. In this way, the book deals with recent cases and their rationale to build a new understanding of law and international policy that complies with the globalization process and progress towards an enhancement of the international community’s legal framework. Combining the emergencies in armed conflicts with the mutual enforcement of human rights law and humanitarian law, this book holistically develops concepts and theories to present a pragmatic solution to moral quandaries over the targeting of civilians during armed conflict situations. The book will be a valuable resource for academics, researchers and policy-makers in the areas of international human rights and international humanitarian law.

Book excerpt: Justice is one of the most debated and reinterpreted of concepts within the fields of law, criminology and criminal justice. Bringing together 35 leading thinkers, analysts and campaigners from around the world, this collection presents a range of on-going struggles for justice from abolitionist, transitional, transformative, indigenous, green and restorative perspectives. Against a background of contemporary concerns about dark money, plutocracies and populism, these chapters raise questions about the relationships between social justice and criminal justice and between democracy, knowledge and justice. Overall, the chapters also demonstrate the breadth, variety and vibrancy of contemporary criminology and include, amongst other cutting-edge contributions, chapters by John Braithwaite, Michelle Brown, Ian Loader, Pat O’Malley, Joe Sim, Susanne Karstedt, Phil Scraton, Richard Sparks, Loïc Wacquant and Sandra Walklate. Justice Alternatives is essential reading for students of criminology, criminal justice and law, as well as for other scholars and activists concerned about social justice, policing, courts, imprisonment, mass supervision, rights and privatized justice. The book’s emphasis upon the importance of imagination, experimentation, innovation and debate aims to promote an optimism that there are always alternatives to inequality, domination and oppression.

Available in PDF, EPUB and Kindle. Book excerpt: Theories and practices of justice do not meet the socio-political challenges of our times. For those theorists attempting to develop an alternative to the criminal justice system, restorative justice has provided an alternative horizon. The restorative justice approach involves meeting people, understanding and recognising their vulnerability through participatory and deliberative forums and practices. The aim of this collection is to bridge the distance between restorative justice and the critical theory tradition. It, on the one hand, takes into account the limits of restorative justice as they have been articulated, or can be articulated through critical social theory, and on the other hand emphasises the ground-breaking potential that restorative justice can bring to this tradition as a way to address crimes, conflicts and injustices, and to pursue justice.
