This book was released on 2021-09-08 with total page 274 pages. Available in PDF, EPUB and Kindle.
Book Synopsis The Latin American Casebook by : Juan F. Gonzalez-Bertomeu
Download or read book The Latin American Casebook written by Juan F. Gonzalez-Bertomeu and published by Routledge. This book was released on 2016-04-20 with total page 297 pages. Available in PDF, EPUB and Kindle. Book excerpt: Traditionally relegated because of political pressure and public expectations, courts in Latin America are increasingly asserting a stronger role in public and political discussions. This casebook takes account of this phenomenon, by offering a rigorous and up-to-date discussion of constitutional adjudication in Latin America in recent decades. Bringing to the forefront the development of constitutional law by Latin American courts in various subject matters, the volume aims to highlight a host of creative arguments and solutions that judges in the region have offered. The authors review and discuss innovative case law in light of the countries’ social, political and legal context. Each chapter is devoted to a discussion of a particular area of judicial review, from freedom of expression to social and economic rights, from the internalization of human rights law to judicial checks on the economy, from gender and reproductive rights to transitional justice. The book thus provides a very useful tool to scholars, students and litigants alike.

Book Synopsis Decrypting Power by : Ricardo Sanín-Restrepo
Download or read book Decrypting Power written by Ricardo Sanín-Restrepo and published by Rowman & Littlefield. This book was released on 2020-05-19 with total page 374 pages. Available in PDF, EPUB and Kindle. Book excerpt: Decrypting Power aims to reach a unifying concept that allows the connection of the fundamental theses stemming from critical legal studies, Subaltern studies, decolonization, law and society, global political economy, critical geopolitics and theories of de-coloniality. This volume proposes that this concept is the ‘encryption of power’, a category of analysis that reveals the weakness of political liberalism when it takes the place of the legitimate fundament of democracy, as well as its consummate capacity to conceal new mechanisms of global power. The theory of encryption of power understands that there is only a world where difference exists as the fundamental and sole order, but also that such a possibility is heavily obstructed by the concentration of power in forms of oppression. The world hangs on the thread of this entangled reality, made up of difference and its denial, of democracy and its simulations, of truth and its codifications. The decryption of power is then, above all, a theory of justice essential to radical democracy, which comes fully-equipped to prevail over the conditions that deny the possibility of an egalitarian world.
Book Synopsis Constitutional Reasoning in Latin America and the Caribbean by : Johanna Fröhlich
Download or read book Constitutional Reasoning in Latin America and the Caribbean written by Johanna Fröhlich and published by Bloomsbury Publishing. This book was released on 2024-09-05 with total page 615 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the reasoning practice of 15 constitutional courts and supreme courts, including the Caribbean Commonwealth and the Inter-American Court of Human Rights. Enriched by empirical data, with which it strives to contribute to a constructive and well-informed debate, the volume analyses how Latin American courts justify their decisions. Based on original data and a region-specific methodology, the book provides a systematic analysis utilising more than 600 leading cases. It shows which interpretive methods and concepts are most favoured by Latin American courts, and which courts were the most prolific in their reasoning activities. The volume traces the features of judicial dialogue on a regional and sub-regional level and enables the evaluation and comparison of each country's reasoning culture in different epochs. The collection includes several graphs to visualise the changes and tendencies of the reasoning practices throughout time in the region, based on information gathered from the dataset. To better understand the current functioning and the future tendencies of courts in Latin America and the Caribbean, the volume illuminates how constitutional and supreme courts have actually been making their decisions in the selected landmark cases, which could also contribute to future successful litigation strategies for both national constitutional courts and the Inter-American Court for Human Rights. This project was made possible due to the collaboration and funding provided by the Rule of Law Programme for Latin America of the Konrad Adenauer Foundation and the Law School of the University of San Francisco de Quito.
Book Synopsis Marxismo norteamericano (American Marxism Spanish Edition) by : Mark R. Levin
Download or read book Marxismo norteamericano (American Marxism Spanish Edition) written by Mark R. Levin and published by Simon and Schuster. This book was released on 2022-08-02 with total page 352 pages. Available in PDF, EPUB and Kindle.

Book Synopsis South America and Peace Operations by : Kai Michael Kenkel
Download or read book South America and Peace Operations written by Kai Michael Kenkel and published by Routledge. This book was released on 2013-07-18 with total page 265 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume is the first English-language work to focus specifically on South America in the context of peace operations. The region of South America has been undergoing significant changes recently with regard to its attitudes towards participation in peace operations. Leaving behind a strong reluctance with regard to intervention, the states have recently taken on a much stronger presence among UN peacekeepers. The foremost showcase of this more robust and responsible stance has been MINUSTAH, the current UN mission in Haiti. South American contributors provide over half the operation’s troops, and the Force Commander is provided by Brazil. This book is intended as an introduction for researchers to the nexus of issues surrounding South America’s increasing influence as a contributor to peace operations. The authors provide the reader with a historically and theoretically grounded understanding of what motivates defence policy and decisions on intervention in the region. Featuring contributions from prominent thinkers in the field and a broad range of case studies, this volume successfully combines practical applicability with diversity of analysis. This book will be of much interest to students of peacekeeping, South American politics, peace and conflict studies, security studies and International Relations in general.
