Book excerpt: HM Revenue & Customs has improved its approach to tackling error and fraud in tax credits but has not yet achieved a sustainable reduction in the level of losses. In 2009, HMRC announced a target to reduce error and fraud to 5 per cent by 2010-11, down from 9 per cent. HMRC missed this target. Error and fraud losses for 2010-11 were just over 8 per cent, amounting to almost £2.3 billion, around £850 million higher than if HMRC had achieved the target. HMRC has been innovative in how it tackles error and fraud, developing a wide range of activities to tackle specific types of risk and monitoring their effectiveness. HMRC believed it was on track to meets its target, but had overestimated the impact of its activities to tackle error and fraud. It estimated that it had prevented £1.4 billion of error and fraud in 2010-11, but has revised this to under £500 million. HMRC has not yet developed an effective response to stop error and fraud recurring after it has corrected a claim. It has also been less effective in tackling certain types of risk, such as the misreporting of hours worked by claimants. Despite HMRC increasing the number of checks to tackle error and fraud, there remain a substantial number of incorrect awards at the end of each year. The Government has stated that an IT system (the Integrated Risk and Intelligence Service (IRIS)) will allow it to cross-check data and provide similar safeguards against fraudulent claims under Universal Credit as are currently operated by local authorities within the Housing Benefit system. However, the National Audit Office found that IRIS was 'missing' from the UC Pathfinders, and it remains unclear how or when DWP will achieve automated access to the range of property data currently available to local authorities. The official estimated benefit fraud rate is 0.7% of total benefits expenditure. The general public's misperception is that it is some 34 times higher. To reduce the risk of confusion or conflation in media reporting, DWP should publish statistics relating to the estimated level of benefit fraud on a separate day from those related to error in the benefits system. Fraud and error rates have plateaued from 2005/06 to 2012/13 and DWP must employ innovative approaches which are aligned with the known risk factors associated with each benefit to achieve reductions. Biometric identity systems could have an important role to play in identity verification processes across government. The Single Fraud Investigation Service (SFIS), which will investigate all social security benefit fraud across DWP, HMRC and local authorities, should be implemented in line with the roll out of Universal Credit.

The law and structures of social security are highly complex, made more so by constant adjustments as government pursues its often conflicting economic, political and social policy objectives. It contributes to errors in decision-making and to increased administrative costs and is seen as disempowering for citizens, thereby weakening enjoyment of a key social right. Current and previous administrations have committed to simplifying the benefits system. It is a specific objective of the Welfare Reform Act 2012, which provides for the introduction of Universal Credit in place of diverse benefits. However, it is unclear whether the reformed system will be either less complex legally or more accessible for citizens. This book seeks to explain how and why complexity in the modern welfare system has grown; to identify the different ways in which legal and associated administrative arrangements are classifiable as 'complex'; to discuss the effects of complexity on the system's administration and its wider implications for rights and the citizen-state relationship; and to consider the role that law can play in the simplification of schemes of welfare. While primarily focused on the UK welfare system it also provides analysis of relevant policies and experience in various other states.

HM Revenue & Customs (HMRC) and the Department for Work & Pensions (DWP) have made some progress in tackling fraud and error, but both departments have shown a paucity of ambition. HMRC has reduced fraud and error, but does not fully understand how it has achieved this, or how much further it can go. DWP did not meet its 2014-15 target for reducing fraud and error, and is relying on welfare reforms to make future improvements. These reforms will not solve all the problems, and DWP expects fraud and error to still be £5.8 billion in 2020-21, once Universal Credit has been fully rolled-out. While the departments can recover some of the money overpaid, this can create huge difficulties for people as they struggle to pay back money paid to them in error. During the next few years both departments must improve their understanding of what reductions are possible, and increase their focus on preventing both underpayments and overpayments due to fraud and error. We intend to return to the issue often during this Parliament

Book excerpt: There are around 30 different types of benefits and pensions, and £148 billion was paid out to 20 million people in 2009-10. The Department for Work and Pensions estimates that £2.2 billion of overpayments and £1.3 billion of underpayments were made in 2009-10 as a result of administrative errors by its staff and mistakes by customers. Efforts to tackle error have had little success and levels of error have remained constant since 2007. A joint HM Revenue and Customs and Department for Work and Pensions fraud and error strategy announced in October 2010, along with additional funding of £425 million over four years, is an opportunity to inject a new impetus. Importantly, the Department has not addressed underpayments, despite the hardship that benefit underpayments can create for people in need. Interventions to reduce error must be targeted where they are most likely to get the greatest return. Progress on reducing error requires a better understanding of where and why errors arise, and a greater focus on preventing errors occurring in the first place. The Department is not making use of all available sources of information to identify the reasons why staff make mistakes, where guidance and training efforts should be directed, and to identify which customers are most likely to make mistakes on their benefit claims. Wider welfare reforms have the potential to reduce errors in the long term by simplifying benefits administration, but waiting for the implementation of the Universal Credit is not an option.

This has enabled the Coalition Government to prioritise the NHS, schools, early years' provision and the capital investments designed to support long term economic growth. Departmental budgets other than health and overseas aid will be cut by an average of 19 per cent over four years. Key areas of Annually Managed Expenditure (AME) in addition to Departmental Expenditure Limits (DELs) for each government department and for the devolved administrations are covered. The Review sets out departmental spending plans for the four years until 2014-15 and further savings and reforms to welfare, environmental levies and public service pensions. The Review protects high value transport maintenance and investment, maintains the science budget, invests in apprenticeships and the low carbon economy and allows universities to increase fees from the 2012-13 academic year. Fundamental reforms will simplify the welfare system and make net savings of �7 billion a year. Social housing will be reformed and social care will receive an additional �2 billion by 2014-15. Public service reform underpins the Review: decentralisation of power; cutting burdens and regulations on front-line staff; improving transparency, efficiency and accountability of local services. Local government will have greater freedom but must work within reduced allocations. Public sector pensions will be reformed in line with Lord Hutton's recommendations. Central government administration costs will be cut by 34 per cent by 2014-15. Government departments will produce business plans later in 2010 detailing reform plans and priorities.

In 2006-07, the Department for Work and Pensions estimated that it spent some £154 million on tackling fraud, identifying £106 million of overpaid benefit, against total benefit expenditure of £120 billion. The Department estimates that fraud fell from £2 billion in 2001-02 to £800 million in 2006-07, which is 0.6% of benefit expenditure. But the Department must do more to reverse the rise in official and customer error. Estimated error rose from £1 billion in 2001-02 to £1.9 billion in 2006-07. Benefit complexity is believed to be a major cause of error. Increasing the volume of pre-payment checks and encouraging customers to receive benefit payments directly into their bank accounts has prevented some fraud. The Department now works closely with the police, the Serious Organised Crime Agency and local authorities to prevent, identify and act against fraud. But it could make more effective use of its powers and resources. While the Department successfully prosecutes 90 per cent of the cases it takes to court, the Prosecution Division has lost 17 per cent of its staff since 2003. Debt recovery is an essential part of tackling fraud, yet in 2006-07 the Department only recovered £22 million of fraud debt out of a known fraud debt stock of £339 million. The Department has been slow to improve its management information systems, hampering its ability to measure the cost-effectiveness of counter-fraud activities. It has taken from 2003 until February 2008 to roll out a new national management information system, known as FRAIMS, at a cost of £65 million.

In the 2006-07 period, £154 million was spent on six strategies to reduce fraud, with a Departmental estimate of £106 million of benefit overpayments identified as a result of fraud investigation and compliance activity. Also in the 2006-07 period, the Department recovered £22 million of the total £339 million outstanding fraud debt. Although the NAO has identified that fraud has fallen from an estimated £2 billion in 2001-02 to an estimated £0.8 billion in 2006-07, official error has risen in the same period from £1 billion to £1.9 billion. Tackling fraud is a key priority for the Department for Work and Pensions, and the report examines the main anti-fraud initiatives, recognising that: tackling benefit is inherently difficult; that the UK has levels of social security fraud and error which are similar to those of comparable countries; that the Department has made good progress in tackling fraud, but will find it increasingly difficult to secure further year on year reductions. The NAO has also set out a number of recommendations, including: that the Department's management information on fraud could be improved, with greater communication between the various departmental directorates responsible for counter-fraud work; that a review of the cost effectiveness of the Customer Compliance approach (which deals with lower risk cases of fraud) should be done; that a record of the outcomes of prosecution activities should be taken by case type to provide better Departmental information; that the Department must review recovery of overpayments in fraud cases and consider setting appropriate targets for recovery from customers who have committed fraud.

HMRC needs a more realistic target for the amount of savings it should achieve from reducing error and fraud. The support provided to claimants, in writing and through its helpline, also needs to be improved. This will help ensure claimants receive the correct amount and avoid overpayments. In 2011-12, HMRC wrote off £1.7 billion of tax credits debt. HMRC must work more closely with organisations that represent claimants to get a better understanding of where claimants need help so it can make improvements to the support it provides. Greater checking of awards led to an increase in appeals against decisions to reduce or terminate the amount of tax credit paid. But insufficient resources to deal with the appeals resulted in delays and caused unnecessary distress and hardship to claimants. Better use of data to identify patterns and trends in claimant behaviouris crucial. HMRC also needs to improve its understanding of why claimants do not always report changes to their circumstances as this is when the majority of error happens.
