Available in PDF, EPUB and Kindle. Book excerpt: Can human rights be enforced against corporations? This work analyses different enforcement mechanisms. It examines one of the most powerful instruments: the Alien Tort Claims Act (ATCA) litigation in the United States. The ATCA has been used as one of the chief weapons in a 21st-century battle over corporate responsibility in the age of globalization. For instance, the ATCA has been invoked to seek compensation from German companies in respect of forced labor during the Holocaust. Further examples include claims relating to genocide against a Canadian company, forced labor claims against a US company and numerous others. The ATCA litigation often refers to the «law of nations», but do the US courts interpret this term consistently with other accepted interpretations of international law? The short answer to that question is 'no'. However, in the absence of enforceable international law mechanisms, this lacuna needs to be filled. Domestic litigation of matters that are inherently transnational in character, as occurs in ATCA human rights litigation, represents a viable mechanism to enforce human rights.

Book excerpt: `This timely collection contains contemporary case studies and critical analyses by leading writers in the study of white collar corporate crime. It makes an invaluable contribution to the ′criminology of the corporation′" - Professor Hazel Croall, Glasgow Caledonian University Corporate and White Collar Crime is an essential overview of this diverse subject area and encourages students to develop a broad understanding of the topic. Aimed primarily at undergraduate and postgraduate students in Criminology, Criminal Justice and Business and Management Studies, the book will cross-over into many other disciplines including Law and Social Policy. "This is an innovative and multidisciplinary analysis of corporate and white collar crime that is both theoretically and empirically rich. The text serves as a poignant reminder why research involving the powerful must be a central part of criminological inquiry and why this book is essential reading." Professor Reece Walters, The Open University "Again and again, pension funds are pillaged, investors fleeced, commuters killed, workers maimed, and communities poisoned. Why is it that so few of these acts are defined as crimes, and why is it that, even when they are, prosecution is so rarely effective? Corporate Crime and White Collar Crime addresses these very questions through its rigorous, well-developed analysis and its wide ranging empirical focus - on Europe, North America, Asia and beyond. The book can help all of us to re-examine our understanding of the nature of crime and of criminals, and to reassess the costs as well as the benefits of our current economic, political and social order." Professor Frank Pearce, Queen′s University, Canada

Available in PDF, EPUB and Kindle. Book excerpt: Humanism in business is not only an alternative to economism but a way to human excellence. Humanism presented here revolves around the rich notion of “human person”, keystone of modern personalist philosophy and Catholic Social Teaching. From this perspective this book is offered to everyone, believer and nonbeliever alike. The person-centered humanism considers the human-wholeness, individual and relational, with subjectivity, self-determination, openness to transcendence, and with capacity not only to possess but also to give. It also highlights the uniqueness of each person, endowed with a high constitutive dignity and in continuous process of flourishing toward human plenitude. An attitude of respect and good will is due to non-personal beings, while persons deserve to be treated with justice and even with love of benevolence. The book is prepared in dialogue with mainstream of thought in business and business ethics and focused on exploring ways to improve some conventional views. It includes some proposals such as a person-based ethics, ethics understood as intrinsic to business activity, the consideration of the company as an organized community of persons, and the purpose of the company oriented toward the common good through a double mission, internal and external. It is also suggested substituting the notion of “stakeholder” for the richer one of “relationholder.”
