Benston, professor of Finance, Accounting, and Economics at Emory University's Goizueta Business School, died unexpectedly in January 2008. He was an impassioned advocate for corporate integrity and a unique scholar; his research interests were as broad as those of any recent academician. His colleagues have selected and organized his most important papers into two volumes. This first volume consists of his research in the banking and financial services industry. The editor has selected a broad range of papers from each of the major areas that are representative of Benston's work in that particular field. James D. Rosenfeld, Professor of Finance, Accounting, and Economics, Goizueta Business School, Emory University, serves as the editor and is assisted by an editorial advisory board including George Kaufman, Greg Waymire, Bob Eisenbeis, Larry Wall, Rashad Abdel-Kalik, and Lemma Senbet.

Available in PDF, EPUB and Kindle. Book excerpt: A distinguished Yale economist and legal scholar’s argument that law, of all things, has the potential to rescue us from the next economic crisis. After the economic crisis of 2008, private-sector spending took nearly a decade to recover. Yair Listokin thinks we can respond more quickly to the next meltdown by reviving and refashioning a policy approach whose proven success is too rarely acknowledged. Harking back to New Deal regulatory agencies, Listokin proposes that we take seriously law’s ability to function as a macroeconomic tool, capable of stimulating demand when needed and relieving demand when it threatens to overheat economies. Listokin makes his case by looking at both positive and cautionary examples, going back to the New Deal and including the Keystone Pipeline, the constitutionally fraught bond-buying program unveiled by the European Central Bank at the nadir of the Eurozone crisis, the ongoing Greek crisis, and the experience of U.S. price controls in the 1970s. History has taught us that law is an unwieldy instrument of macroeconomic policy, but Listokin argues that under certain conditions it offers a vital alternative to the monetary and fiscal policy tools that stretch the legitimacy of technocratic central banks near their breaking point while leaving the rest of us waiting and wallowing.

Book excerpt: The 2003 Special Issue of the Comparative Law Yearbook of International Business deals with issues relating to Corporate Governance. Following a series of scandals involving reporting by public companies in the United States, there has been an increase in the number of measures dealing with, among other things, the liability of directors and managers when submitting company financial returns. The first and most well-known piece of legislation to be introduced was, of course, the United States Sarbanes-Oxley Act of 2002. The Sarbanes-Oxley Act covers matters including the establishment of audit committees, disclosure committees, and codes of ethics, with an emphasis upon the disclosure of information and transparency. It describes, for example, the principle of ¿vicinity of Insolvency¿ and the relevant information to be disclosed to shareholders and creditors. The issue of directors¿ duties and responsibilities is addressed, together with the consequences of insider trading and conflicts of interests. The Act also contains provisions on whistleblowers and introduces new criminal sanctions for company wrongdoings, as well as enhancing those penalties already in place. As a result of the Sarbanes-Oxley Act, many countries have followed suit and adopted their own measures to combat corporate failings, corruption, and the misuse of power. Among those covered in this publication are South Africa, China, a number of eastern and western European states, and various Asian jurisdictions. Other specific topics discussed are, inter alia, generally accepted accounting principles, insolvency, the banking, securities and insurance industries, foreign issuers, and close private companies. Corporate Governance is an extremely topical subject which is of great importance and relevance to anyone involved in company affairs. Many corporate practitioners will, therefore, find this publication highly useful when advising clients on their various rights and responsibilities.

CryptoDad is Giancarlo's own personal story, detailing his forays into the world of Wall Street to his tenure as the 13th Chairman of the United States Commodity Futures Trading Commission (CFTC), where he pushed for the agency to recognize the digitization of markets. His growing fame as a Twitter presence in this essential debate has given Giancarlo a platform to makes a case for the future of cryptocurrencies as the natural successor to America’s current failing financial market infrastructure. CryptoDad provides readers with: A thorough exploration of digital change and how it affects the lives of everyone in a global economy A revolutionary consideration of regulatory responses to the rapid pace of technological innovation A call to update our aging financial organizations, particularly the infrastructure of money itself, and focus on renewed faith and confidence in free market innovation A foreword by Cameron and Tyler Winklevoss, two of the biggest names in cryptocurrencies CryptoDad argues that the next digital wave will be the coming Internet of Value, where cryptocurrencies will do the Internet of Information did to immaterial things: make them accessible, distributable, and movable instantly across the globe. This book is an ideal introduction to the importance of technology in the marketplace.
