Book excerpt: La sustracción parental de menores representa un tema de reciente actualidad, con algunos casos que han alcanzado gran repercusión mediática, aumentando sobre todo en el aspecto internacional−lo que se ha denominado como legal kidnapping o secuestro parental−, causado principalmente por el aumento de matrimonios mixtos y las frecuentes rupturas de pareja, suscitando conflictos culturales entre un deber jurídico y un deber moral, en la que los progenitores “se toman la justicia por su mano”, incumpliendo una resolución judicial o administrativa. De ahí cabe inferir que la sustracción parental de menores sea un fenómeno de enorme complejidad jurídica, dado que en su regulación nacional e internacional se ven afectadas dos jurisdicciones, la civil y la penal, con procedimientos propios en función de cada caso concreto. En el ámbito penal, el Código Penal de 1995 suprimió como delito con sustantividad propia, la sustracción de menores de siete años, y agravó, en cambio, el marco punitivo para los delitos de detención ilegal o secuestro cuando la víctima fuera menor de edad o incapaz. Sin embargo, existía una laguna de punibilidad para los casos en que la conducta de sustracción o de negativa a restituir al menor fuere ejecutada por uno de sus progenitores, cuando las facultades inherentes a la custodia del menor han sido atribuidas legalmente al otro progenitor o a alguna persona o institución en interés del menor. Con relación a esta cuestión se planteó un amplio debate doctrinal sobre la conveniencia político-criminal de sancionar estos conflictos familiares, soslayado por el legislador penal a través de la LO 9/2002 , redactando el artículo 225 bis CP, previendo una respuesta penal clara, distinta del delito de desobediencia genérico, para aquellos supuestos donde quien verifica la conducta de sustracción o de negativa a restituir al menor es uno de los progenitores, cuando las facultades inherentes a la custodia del menor han sido atribuidas legalmente al otro. El presente trabajo aborda el estudio de las cuestiones dogmáticas más relevantes que el delito de sustracción parental de menores suscita, tales como la delimitación del bien jurídico protegido, la conducta típica, la cualidad del sujeto activo, la posibilidad del delito continuado y, los problemas concursales, entre otras; completando este análisis con los pronunciamientos judiciales más recientes, particularmente de las Audiencias Provinciales y del Tribunal Supremo.

Precisamente, la obra que se presenta al lector constituye un estudio transversal y multidisciplinar de la sustracción internacional de menores, comenzando en primer lugar, con una aproximación teórico-práctica delimitando conceptualmente lo que sea “sustracción ilícita”, tomando como referencia el Convenio de la Haya de 1980, sobre Aspectos Civiles de la Sustracción Internacional de Menores(CH 1980) y el Reglamento Bruselas II Bis, que facilita el retorno del menor en caso de su traslado o retención ilícitos. Conexo a lo anterior, se analizan las medidas legislativas de prevención ante la sustracción parental de menores, destacando el papel fundamental del Fiscal, resultando de obligada referencia la Orden Europea de Detención y Entrega (Euroorden), y el exhorto europeo de obtención de pruebas, en los casos en que el país receptor del menor sustraído pertenezca a la Unión Europea.
