GAO noted that: (1) although the Superfund program has had limited success in cleaning up hazardous waste sites and responding to emergency releases on hazardous substances, EPA needs to address streamlining the cleanup process, controlling program costs, the effectiveness of cleanup actions, and what level of federal funding is appropriate; (2) the cleanup process has remained slow due to delays in site evaluation, technological limitations, and cleanup site complexity; (3) the cost of cleanup is high as a result of high administrative costs, poor contract administration, limited recovery of cleanup costs from responsible parties, high operational and maintenance costs, and legal costs; and (4) EPA lacks the ability to assess the effectiveness of Superfund cleanup efforts because few cleanup sites have been completed and unreliable cost and efficacy data hamper its use of innovative technologies.

This report provides an overview of the Superfund program, its legal basis, and its sources of funds; presents a concise description of incentives and the major administrative steps taken in their application; provides an overview of the major indicators of program effect based on public data available from the Environmental Protection Agency and other selected sources; presents a short interpretation of some of the most interesting or puzzling findings; and outlines statistics and attempts to capture costs and activities for each of the major groups participating in the Superfund process. It also considers the transaction-cost issue, focusing on two of the key players in the cleanup process: very large companies (potentially responsible parties) and insurers that are brought into the hazardous-waste cleanup process by their policy holders' indemnity claims. It describes their experiences with Superfund and Superfund-type sites, and shows the division of their expenses between cleanup and transaction costs.

GAO noted that: (1) the cost and scope of Superfund have greatly exceeded initial projections of $1.6 billion for the cleanup of 406 hazardous waste sites in 1980 to $40 billion for 1,275 sites, with a projected increase of 700 sites needing attention by 2000; (2) the program has taken more than 2,800 emergency actions, sometimes at non-Superfund sites, to address immediate, serious site threats; (3) EPA has improved its enforcement of laws to make responsible parties clean up contaminated sites or pay for government-funded cleanups; (4) administrative and support costs account for 41 percent of Superfund appropriations; (5) Superfund contract management controls and oversight do not adequately provide for cost control, contractor review, or protection against program abuses and waste; (6) the pace of Superfund cleanups is sluggish due to the lengthy site study and remedy evaluation process; (7) with increased emphasis on faster and more cost-efficient cleanups, EPA will need to ensure the effectiveness and integrity of site cleanups; and (8) the lack of solid information on the health and environmental dangers posed by Superfund sites makes it difficult to assess the risks and determine the most effective use of the scarce resources available for environmental protection.
