Book excerpt: Almost all western and other developed states use Principles of War as guiding ideas for military practitioners (especially those who serve at the operational and tactical levels) on how best to use combat power in order to gain maximum advantage. These Principles of War are virtually ubiquitous in cadet and officer colleges and in doctrine manuals. Islamic law, on the other hand, has nothing comparable, and least nothing from the modern world. It has always seriously and proactively engaged with ideas about how to ensure that war is fought for morally just causes. Yet, since the medieval period, Islam has not updated its thoughts on what principles might best enhance combat effectiveness in order to win battles and wars with the maximum effectiveness, the minimum use of force and the minimum likelihood of harm to the innocent. This study investigates whether one can draw such principles from the Qur’an and the life of the Islamic Prophet Muhammad that might serve as guidelines for Islamic armed forces in the twenty-first century, an era dominated by careless disregard for human life and by what is euphemistically called Collateral Damage. Within the earliest extant Arabic sources, this study identifies nine principles—these being Virtuous Objective, Legitimacy, Unity of Command and Effort, Consultative Decision-Making, Offensive Action, Defensive Security, Morale, Restraint, and Deception—that were integral in the warfighting of the Prophet. The author hopes that the analysis might, if widely read in the right circles, prompt further thought and research within Islamic states and their militaries so that something like an agreed set of Islamic Principles of War could eventually emerge and be of utility.

Islamic Jurisprudence (Fiqh) has yet to develop its conceptualization of this modality of financing. Thus far, it has become a norm for large financing projects to rely on a complex structure of interconnected bilateral contracts that in totality becomes opaque, complex and costly. An unfortunate result of the unavailability of an efficient Fiqhi model applicable to modern multilateral and multi-counterparty contracts has been the fact that the present Islamic finance has been forced to replicate conventional risk-transfer (interest rate based) debt contracts thus drawing severe criticisms of duplicating conventional finance. In 2012, a gathering of some of the Muslim world’s most prominent experts in Jurisprudence (Fuqaha) and economists issued the Kuala Lumpur Declaration (Fatwa) in which they identified risk sharing as the essence of Islamic finance. The Declaration opened the door for a new Fiqh approach to take the lead in developing the jurisprudence of multilateral and multi-counterparty transactions. This Declaration (Fatwa) provides a prime motivation to search for a comprehensive model of risk sharing that can serve as an archetypal contract encompassing all potential contemporary financial transactions. From the perspective of Islamic Jurisprudence (Fiqh), the technicalities of the concept of risk sharing in contemporary finance have yet to be defined in Islamic literature. This book attempts to clarify and shed light on these technicalities from the perspective of Fiqh. It is a comprehensive study that relies on the fundamental Islamic sources to establish a theoretical and practical perspective of Fiqh encompassing risk-sharing Islamic finance as envisioned in the Kuala Lumpur Declaration of 2012. This new paradigm should lead to a more efficient approach to multilateral and multi-counterparty Islamic contracts which, here-to-fore has been lacking in the current configuration of Islamic finance.

Book excerpt: This volume of al-Ṭabarī's History covers nearly a quarter of a century, and after covering the very brief caliphate of al-Hādī, concentrates on that of Hārūn al-Rashīd. During these years, the caliphate was in a state of balance with its external foes; the great enemy, Christian Byzantium, was regarded with respect by the Muslims, and the two great powers of the Near East treated each other essentially as equals, while the Caucasian and Central Asian frontiers were held against pressure from the Turkish peoples of Inner Eurasia. The main stresses were internal, including Shī'ite risings on behalf of the excluded house of 'Alī, and revolts by the radical equalitarian Khārijites; but none of these was serious enough to affect the basic stability of the caliphate. Hārūn ar-Rashīd's caliphate has acquired in the West, under the influence of a misleading picture from the Arabian Nights, a glowing image as a golden age of Islamic culture and letters stemming from the Caliph's patronage of the exponents of these arts and sciences. In light of the picture of the Caliph which emerges from al-Ṭabarī's pages, however, this image seems to be distinctly exaggerated. Al-Rashīd himself does not exhibit any notable signs of administrative competence, military leadership or intellectual interests beyond those which convention demanded of a ruler. For much of his reign, he left the business of government to the capable viziers of the Barmakīd family--the account of whose spectacular fall from power forms one of the most dramatic features of al-Ṭabarī's narratives here--and his decision to divide the Islamic empire after his death between his sons was to lead subsequently to a disastrous civil war. Nevertheless, al-Ṭabarī's story is full of interesting sidelights on the lives of those involved in the court circle of the time and on the motivations which impelled medieval Muslims to seek precarious careers there.
