L'ouvrage est émaillé de cas pratiques, de références bibliographiques et de suggestions de lectures qui permettront aux praticiens et aux étudiants d'approfondir la matière. Il tient compte non seulement de la loi du 19 janvier 2022 portant notamment le livre 4 “Les successions, donations et testaments” du Code civil, qui apporte, en la matière, plusieurs modifications non négligeables, mais aussi des lois qui ont été adoptées ultérieurement comme la loi du 30 juillet 2022 visant à rendre la justice plus humaine, plus rapide et plus ferme II, la loi du 22 novembre 2022 portant modification de la loi du 16 mars 1803 contenant organisation du notariat ou la loi du 6 décembre 2022 visant à rendre la justice plus humaine, plus rapide et plus ferme IIbis. La matière des successions et des libéralités forme, par ailleurs, avec celle des régimes matrimoniaux, le « droit patrimonial de la famille », qui se situe à la croisée du droit des biens, du droit des obligations et du droit familial. Partant, la réforme des dispositions générales de droit privé, celle du droit patrimonial des couples, celle du droit des biens, celle du droit des obligations et celle du droit de la preuve, qui ont été coulées dans les livres 1er, 2, 3, 5 et 8 du Code civil marquent évidemment aussi de leur empreinte le régime des libéralités et des successions. Le présent ouvrage, qui est à jour au 1er septembre 2023, prend donc ces réformes en considération et montre l'impact qu'elles ont sur le droit des libéralités et des successions.

Yet there have been consistent warning signs that a global economy and free trade might not always be advantageous. Where are the pressure points? What could be done about them? Dani Rodrik examines the back-story from its seventeenth-century origins through the milestones of the gold standard, the Bretton Woods Agreement, and the Washington Consensus, to the present day. Although economic globalization has enabled unprecedented levels of prosperity in advanced countries and has been a boon to hundreds of millions of poor workers in China and elsewhere in Asia, it is a concept that rests on shaky pillars, he contends. Its long-term sustainability is not a given. The heart of Rodrik’s argument is a fundamental 'trilemma': that we cannot simultaneously pursue democracy, national self-determination, and economic globalization. Give too much power to governments, and you have protectionism. Give markets too much freedom, and you have an unstable world economy with little social and political support from those it is supposed to help. Rodrik argues for smart globalization, not maximum globalization.

The book structures its analysis and argument around the stories of disappointed promisees and their unfulfilled expectations of a future inheritance, and how they might seek redress. It maps and compares the various, and often very diverse range of legal responses that a promisee can avail herself of across different legal areas of the law (ranging from contract law to property law, employment law, unjust and unjustified enrichment law, and succession law) and in both common and civil law traditions. Braun asks how these responses protect the interests of promisees and whether they are sensitive to the context in which such promises are expressed. In doing so, the focus rests on the level of protection the various forms of redress grant, their scope, and the challenges promisees face when brining a claim, but also on the values and interests that are at stake when granting relief. This book argues that due to the social and legal context within which promises of a future inheritance are normally made, promisees are usually in a vulnerable position that can easily by exploited.
