Book excerpt: Many European Union Directives seek to minimize the potential for harm to humans and the environment arising from the use of chemicals. This book takes an interdisciplinary, selective look at the effector mechanisms employed in such directives. It covers the pre-marketing use of toxicology to identify the hazardous properties of chemicals, acknowledging its shortcomings, while contrasting the scientific method with the precautionary principle in developing risk-management practices. The book then goes on to describe the use of bio-indicators, chemical analyses and mathematical modelling for prediction, or to determine the adequacy of chemical safety legislation. The environmental risk assessment of priority chemicals is described and the impact of pesticides on sustainability in agriculture is discussed from the differing standpoints of agronomy and economics. Audience: All professionals concerned with the safe management of chemicals and their use, including teachers, practitioners, policy makers or legislators.

Book excerpt: It is a commonplace that pollution knows no borders, and that environmental law must allow for cross-border implementation. The European Union specifies this principle in EC directives on integrated pollution prevention and control (IPPC), on environmental impact assessment (EIA), and on the control of major accident hazards involving dangerous substances (Seveso II). This is the first book to investigate from both empirical and normative perspectives the effectiveness of these directives at the national level. It provides by far the most extensive comparative analysis and evaluation of the industrial permitting and inspections, EIA, and major accident prevention in the EU. Offering an in-depth study of the transposition and implementation of EC environmental directives in eight EU member states (Denmark, France, Germany, Italy, the Netherlands, Spain, Sweden, and the United Kingdom), the author who has played a significant role in the formulation of environmental legislation and regulation at both the national (German) and EU levelsand¿provides a stable base for an assessment of the benefits and costs of the integrated approach to environmental protection. Among the factors considered are the following: key features of national constitutional, administraand¬tive, and judicial systems which provide the framework for environand¬mental regulations and their implementation in the eight countries under study; procedures and substantive requirements transposing the IPPC, EIA and Seveso II directives into national laws; and evaluation of national deficiencies and the extent of muddling through. The empirical part of Dr Bohne's analysis draws on 138 expert interviews with public and private actors, a survey of 178 public authorities, and document analyses of selected industrial permits and environmental impact statements. His comparative analysis of procedural, organizational, and substantive integration makes it possible to identify and compare national accomplishments in regulatory integration, and offers new insights into the effectiveness and limits of EC law. The study concludes with a discussion of the implications of the findings for European governance and better regulation after the enlargement of the EU. This thoroughly researched, rigorous, and insightful study will be of great interest and value to policymakers, regulators, business people, environmental NGOs, consultants, and lawyers, as well as to students of environmental policies and European governance.

Book excerpt: Featuring an original introduction by the editors, this important collection of essays explores the main issues surrounding the regulation of the environment. The expert contributors illustrate that regulating the environment in the UK is conceptually complex, involves a diverse range of institutions, techniques and methodologies and crosses geographical and national boundaries. In the USA it is more formalised, juridical, adversarial and formally dependent upon legal rules. The articles highlight the fact that despite differences in the UK and the USA's regulatory styles, environmental regulation today has much in common with both traditions.

Available in PDF, EPUB and Kindle. Book excerpt: The production and use of chemical substances can have negative impacts on the environment. To avoid and/or limit these negative impacts the EU has adopted a large body of rules and implementing measures regulating chemical substances, their use, and their release into the environment. The REACH Regulation is the cornerstone of this acquis, inter alia, with a wide array of sectoral and compartmental EU environmental legislation on water, waste, air pollution, industrial emissions, and specific chemical products (e.g., biocidal and plant protection products). Despite this comprehensive and advanced EU acquis on chemical matters there is a growing concern among the scientific community that this acquis lacks the relevant mechanisms to adequately address emerging chemical risks to the environment in a timely manner. There are numerous examples of the long-time span between early signal and the adoption of adequate measures to address emerging risks as described in the EEA report "Late lessons early warnings report". The difficulty to get emerging chemical risks such as nanomaterials, PFAS and endocrine disruptors, on the radar of policy makers and governmental risk assessors exemplify the need for an EU-wide early warning and action system. As highlighted by the Council of the EU in its conclusions of the 2019 chemicals strategy, the identification of new, emerging risks constitutes a major challenge to tackle. Indeed, while ensuring the prevention of existing risks, it is also essential to be able to anticipate as soon as possible unforeseen consequences related to the use of chemicals and their release into the environment and to ensure that these emerging risks are properly addressed in a timely manner by EU policy and decision makers. Early warning systems (EWSs) thus appear to be relevant instruments to complement/support the implementation of the EU legislation on chemical matters by adopting a proactive and systematic approach to the identification of emerging risks, while fostering cooperation and knowledge-sharing among countries and scientific communities and improving the science and policy interface on such risks. Several initiatives on EWS have been developed in the EU such as the emerging risks exchange network (EREN) which is the EFSA EWS related to food and food safety and covering emerging chemical risks for human health and biodiversity). There is however no official systematic, permanent, and coordinated early warning system in place at EU level focusing on emerging chemical risks to the environment. This is considered in the new Commission Chemical Strategy for Sustainability Towards a Toxic-Free Environment3 which mentions that the 'Commission will develop an EU early warning and action system for chemicals to ensure that EU policies address emerging chemical risks as soon as identified by monitoring and research'. As part of the implementation of the Chemicals Strategy, the Commission has also set up an expert group on 'One substance, one assessment' with Commission services, Member States and EU Agencies to improve efficiency, effectiveness, coherence and transparency of the delivery of safety assessments of chemicals across legislation. Amongst its different tasks, the group shall also monitor, discuss and exchange views on early warning signals on chemicals within the framework of the early warning and action system on chemicals announced under the Chemicals Strategy.
