Book excerpt: Winner of the Professional/Scholarly Publishing Award in Economics from the Association of American Publishers Within a few months of assuming the position of curator of medieval coins at the American Numismatic Society in 1980, Alan M. Stahl was presented with a plastic bag containing a hoard of 5,000 recently discovered coins, most of which turned out to be from medieval Venice. The course of study of that hoard (and a later one containing more than 14,000 coins) led him to the Venetian archives, where he examined thousands of unpublished manuscripts. To provide an even more accurate account of how the Zecca mint operated in Venice in the thirteenth through fifteenth centuries, Stahl commissioned scientific analyses of the coins using a variety of modern techniques, uncovering information about their content and how they had been manufactured. The resulting book, Zecca: The Mint of Venice in the Middle Ages, is the first to examine the workings of a premodern mint using extensive research in original documents as well as detailed study of the coins themselves. The first of the book's three sections traces the coinage of Venice from its origins in the ninth century as a minor, and unofficial, regional Italian coinage to its position at the dawn of the Renaissance as the dominant currency of Mediterranean trade. Lester addresses a central issue in the history of the medieval church: the role of women in the rise of the religious reform movement of the thirteenth century. Focusing on the county of Champagne in France, Lester reconstructs the history of the women’s religious movement and its institutionalization within the Cistercian order. The common picture of the early Cistercian order is that it was unreceptive to religious women. Male Cistercian leaders often avoided institutional oversight of communities of nuns, preferring instead to cultivate informal relationships of spiritual advice and guidance with religious women. As a result, scholars believed that women who wished to live a life of service and poverty were more likely to join one of the other reforming orders rather than the Cistercians. As Lester shows, however, this picture is deeply flawed. Between 1220 and 1240 the Cistercian order incorporated small independent communities of religious women in unprecedented numbers. Moreover, the order not only accommodated women but also responded to their interpretations of apostolic piety, even as it defined and determined what constituted Cistercian nuns in terms of dress, privileges, and liturgical practice. Lester reconstructs the lived experiences of these women, integrating their ideals and practices into the broader religious and social developments of the thirteenth century—including the crusade movement, penitential piety, the care of lepers, and the reform agenda of the Fourth Lateran Council. The book closes by addressing the reasons for the subsequent decline of Cistercian convents in the fourteenth century. Based on extensive analysis of unpublished archives, Creating Cistercian Nuns will force scholars to revise their understanding of the women’s religious movement as it unfolded during the thirteenth century.

Eppure seguire il percorso di questa branca del diritto risulta di particolare importanza in quanto mette in luce i conflitti tra gli interessi dei diversi soggetti economici. Attraverso la lettura di testi legislativi, dei progetti di riforma e dei contributi della dottrina, il libro segue le varie tappe del diritto commerciale, ossia il diritto privato della borghesia capitalistica, dal primo Codice di commercio, quello francese del 1807, che rappresentò il modello per la maggior parte delle codificazioni europee, fino al Codice civile italiano del 1942. Se il Code de commerce non conteneva una disciplina dei contratti commerciali, con il primo codice dell’Italia unita (1865) si assiste al progressivo affermarsi di regole diverse da quelle previste dal Codice civile e idonee a soddisfare le esigenze di celerità degli scambi e di tutela del credito proprie delle attività produttrici di nuova ricchezza. Tra la fine dell’Ottocento e l’inizio del Novecento, l’attenzione viene rivolta ai dibattiti sulla riforma del diritto commerciale, in un periodo in cui lo sviluppo della grande impresa industriale sollevava problemi inediti e faceva emergere nuovi interessi meritevoli di tutela. Successivamente, sotto il fascismo, si aprirà un’ampia discussione su come avrebbe dovuto essere il nuovo diritto commerciale nell’ordine giuridico del regime fascista. L’autore infine analizza il Codice del 1942, che realizzerà l’unificazione all’insegna della «commercializzazione del diritto privato»: quelle che un tempo erano regole riservate ai soli rapporti commerciali diventavano regole generali per i rapporti privati.
