Book excerpt: Excerpt from State Aid State Interference: State Illustrated by Results in Commerce and Industry There come upon nations epochs when, rising superior to all experience, a blind dash is made in some unlooked-for direction. This is an infatuation of the national brain which destroys, in the brief period of its rage, the hard-won results of centuries of toil and progress. A nation comes into being and grows with surprising rapidity till it attains to great stature: it puts on and uses the strength of a Samson. But, in those days it not unfrequently happens that the nation suddenly sets itself to sap all the foundations of its greatness: to permit the cutting off of the seven locks of its mightiness. And the Delilah of its destruction is Government Interference. Has England, in these latter days, fallen under the glamour of such an influence? Available in PDF, EPUB and Kindle. Book excerpt: Interest in international law has increased greatly over the past decade, largely because of its central place in discussions such as the Iraq War and Guantanamo, the World Trade Organisation, the anti-capitalist movement, the Kyoto Convention on climate change, and the apparent failure of the international system to deal with the situations in Palestine and Darfur, and the plights of refugees and illegal immigrants around the world. This Very Short Introduction explains what international law is, what its role in international society is, and how it operates. Vaughan Lowe examines what international law can and cannot do and what it is and what it isn't doing to make the world a better place. Focussing on the problems the world faces, Lowe uses terrorism, environmental change, poverty, and international violence to demonstrate the theories and practice of international law, and how the principles can be used for international co-operation.

Book excerpt: "The United States Code is the official codification of the general and permanent laws of the United States of America. The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The 2012 edition of the Code was prepared and published under the supervision of Ralph V. Seep, Law Revision Counsel. Grateful acknowledgment is made of the contributions by all who helped in this work, particularly the staffs of the Office of the Law Revision Counsel and the Government Printing Office"--Preface.

Available in PDF, EPUB and Kindle. Book excerpt: When this classic volume first appeared, academic freedom was a crucially important issue. It is equally so today. Hofstadter approaches the topic historically, showing how events from various historical epochs expose the degree of freedom in academic institutions. The volume exemplifies Richard Hofstader's qualities as a historian as well as his characteristic narrative ability. Hofstadter first describes the medieval university and how its political independence evolved from its status as a corporate body, establishing a precedent for intellectual freedom that has been a measuring rod ever since. He shows how all intellectual discourse became polarized with the onset of the Reformation. The gradual spread of the Moderate Enlightenment in the colonies led to a major advance for intellectual freedom. But with the beginning of the nineteenth century the rise of denominationalism in both new and established colleges reversed the progress, and the secularization of learning became engulfed by a tidal wave of intensifying piety. Roger L. Geiger's extensive new introduction evaluates Hofstadter's career as a historian and political theorist, his interest in academic freedom, and the continuing significance of Academic Freedom in the Age of the College. While most works about higher education treat the subject only as an agent of social economic mobility, Academic Freedom in the Age of the College is an enduring counterweight to such histories as it examines a more pressing issue: the fact that colleges and universities, at their best, should foster ideas at the frontiers of knowledge and understanding. This classic text will be invaluable to educators, university administrators, sociologist, and historians.

Available in PDF, EPUB and Kindle. Book excerpt: Russian interference in the 2016 US presidential election produced the biggest political scandal in a generation, marking the beginning of an ongoing attack on democracy. In the run-up to the 2020 election, Russia was found to have engaged in more “information operations,” a practice that has been increasingly adopted by other countries. In Election Interference, Jens David Ohlin makes the case that these operations violate international law, not as a cyberwar or a violation of sovereignty, but as a profound assault on democratic values protected by the international legal order under the rubric of self-determination. He argues that, in order to confront this new threat to democracy, countries must prohibit outsiders from participating in elections, enhance transparency on social media platforms, and punish domestic actors who solicit foreign interference. This important book should be read by anyone interested in protecting election integrity in our age of social media disinformation.

This book was released on 2018-11-28 with total page 314 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book analyses the recent modernisation of EU State aid law from various perspectives, and considers both substantive and procedural aspects. It also discusses the reasons for, and the goals and future implications of the modernisation programme, including the evolution of the concept of State aid. The ambitious reform programme was launched in 2012 and has now been almost fully implemented by virtue of the adoption of new rules of procedure in July 2013, and exemption in June 2014. The book highlights the main aspects of this sector reform, which include the Commission’s change of attitude towards so-called positive aid, i.e. those able to promote economic growth, and the intention to focus on matters of greater systematic extent. These objectives also imply a third aspect: increasing the intensity of the control powers conferred on the Commission with regard to that aid that prove to be harmful to competition and the internal market. The book also examines the greater responsibility given to States for self-assessment of their economic policy measures, and explores the resulting impact on, and challenges posed to the administrations of the Member States. The book’s second part is devoted to the application State aid rules in the area of services of general economic interest, with a special focus on aid in the field of social health and infrastructure.
