Something over ten years ago I had occasion, in a paper read before the Ameri can Historical Association, ' to call attention to the fact that, whatever might be the general decline in importance of the individual commonwealths of our Union, a very great extension of their activities had taken place since the Civil War in respect to matters relating to the economic interests of their citizens. This intervention, as was then shown, was not in the way of the direct performance or even the promotion of works of public interest, but rather in the creation of boards, bureaus and commissions, having for their purpose, either the investigation and publication of economic conditions, as is done, for instance, by boards of agriculture, geological surveys, and bureaus Of statistics of labor, or the supervision of particular lines of industry, such as banking, insurance, transportation, and factory and mine work. Book excerpt: Excerpt from Experience With Works Councils in the United States In August, 1919, the number of Works Councils in industrial concerns in the United States was 225, according to a survey made at that time by the National Industrial Conference Board for its first report on the Works Council movement, which gave an account of substantially all that were then functioning. Since then, a number of employers have abandoned their employee representation plans, but a much larger number of employers have instituted Councils in their plants, so that in February, 1922, there were approximately 725 such organizations in operation in this country. The great majority of the Works Councils covered in the Boards first report on the subject 1 had at the time of its publication been functioning on an average for not more than one year. This was a year of business prosperity; production was in demand, labor was scarce and wages were high. Following this came a period of business adversity; the demand for goods fell off, working forces were reduced, and wages declined. Widespread interest was manifest as to how Works Councils would stand the strain of such a period of depression. Were employee representation plans practicable only in times characterized by high wages and high prices? Would employees lose interest in the Councils when wage reductions became necessary? These and similar questions were raised as to the status and value of Works Councils during a period of decreased production and falling wages. In order to answer these questions adequately, and ascertain the practical experience of employers with their Works Councils during such a period, the National Industrial Conference Board conducted a country-wide investigation. The great majority of the Works Councils treated in the present report have been in operation for periods varying from two to five years. An account of industry's experiences with these Works Councils during that period is presented herewith. Terminology The term Works Council as used in this report is taken to mean "a form of industrial organization under which the employees of an individual establishment, through representatives chosen by and Works Councils in the United States." One step in that direction would be the enactment of a workmen's compensation law based upon the principle of right and justice to wage-earners and those who employ them. Under present statutory conditions, when an accident occurs, in nine cases out of ten the victim is thrown upon his own resources With a workable compensation law, properly enforced, no matter who is to blame in the matter of an accident, the laborer would be protected during the period of disability. The employer would insure himself against accidents by the introduction of devices to prevent them. He would face a new kind of taxation, a species which it would be lawful for him to evade, for he could evade the tax on accidents by preventing the accidents. His claim agent would be converted into a safety expert, whose activities would be largely confined to the installation of proper safeguards rather than in scour ing releases from injured employees due oftentimes to defective ma chinery. Workmen's compensation introduces the idea not of mak ing the employer a petty criminal, but simply making him a taxpayer and giving him the option of getting rid of his tax by getting rid of accidents. He would put in safety departments and create safety committees from the employees to cooperate with the management. Forty-two states have provided workmen's compensation laws. Section 40 of the Immigration Act of February 20, 1909, provided for the organ ization Within the Bureau of Immigration, at that time an in tegral part of the Department of Commerce and Labor, of a Division of Information to assist immigrants and other persons in securing employment. The Bureau of Immigration, including the Division of Information, was made a part of the Department of Labor under authority of the Act of March 4, 1913, which created the department. Upon its organization in 1914, the department converted the Division of Information into a gen eral employment service to function in the placement of all kinds of labor. Sanction for this procedure was found in the Act creating the Division of Information, and especially in Section 1 of the organic Act of March 4, 1913, providing for a Depart ment of Labor, which stipulated that: The purpose of the Department of Labor shall be to foster, promote, and develop the welfare of the wage earners of the United States, to improve their working conditions, and to advance their opportunities for profitable employment. 12 This reorganized employment ser vice was called the United States Employment Service, and it functioned primarily through the Division of Information, which had been maintained as an integral part of the Bureau of Immigration.
