Available in PDF, EPUB and Kindle. Book excerpt: The Conservative party remains the longest-established major political party in modern British history. This collection makes available 19th century documents illuminating aspects of Conservatism through a critical period in the party’s history, from 1830 to 1874. It throws light on Conservative ideas, changing policies, party organisation and popular partisan support, showing how Conservatism evolved and responded to domestic and global change. It explores how certain clusters of ideas and beliefs comprised a Conservative view of political action and purposes, often reinforcing the importance of historic institutions such as the Anglican Church, the monarchy and the constitution. It also looks at the ways in which a broadening electorate required the marshalling of Conservative supporters through greater party organisation, and how the Conservative party became the embodiment and expression of durable popular political sentiment. The collection examines how the Conservative party became a body seeking to deliver progress combined with stability. The documents brought together in this collection give direct voice to how Conservatives of the period perceived and extolled their aspirations, aims, and the values of Conservatism. Introductory essays highlight the main themes and nature of Conservatism in a dynamic age of change and how the Conservative axiom, in an imperfect world of successful adaptation, being essential to effective preservation informed and defined the Conservative party, the views of its leaders, the beliefs of its supporters, and the political outlook they espoused. This second volume continues covering the period 1830-1850.

Available in PDF, EPUB and Kindle. Book excerpt: In the 2015 UK General Election, the Conservative party pledged to reset the UK's relations with Europe, holding an in-out referendum on membership of the European Union and repealing the Human Rights Act, to be replaced with a UK Bill of Rights. With the decision now taken to leave the EU, the future of the Human Rights Act and the UK's relations to the European Convention on Human Rights remains uncertain. Conor Gearty, one of the country's leading experts on human rights, here dissects the myths and fantasies that drive English exceptionalism over Europe, and shape the case for repealing the Human Rights Act. He presents a passionate case for keeping the existing legal framework for protecting human rights and our relationship with the European Convention. Analysing the reform agenda from the perspective of British law, history, politics, and culture, he lays bare the misunderstandings of the human rights system that have driven the debate so far. Structured in three parts, the book first exposes the myths that drive the anti-Human Rights Act argument. Second, Gearty outlines how the Act operates in practice and what its impact really is on the ground. Third, he looks to the future and the kind of Britain we want to live in, and how, for all its modesty, the survival or otherwise of the Human Rights Act will play a pivotal part in that future.

Available in PDF, EPUB and Kindle. Book excerpt: If one counts the production of constitutional documents alone, the nineteenth century can lay claim to being a 'constitutional age'; one in which the generation and reception of constitutional texts served as a centre of gravity around which law and politics consistently revolved. This volume critically re-examines the role of constitutionalism in that period, in order to counter established teleological narratives that imply a consistent development from absolutism towards inclusive, participatory democracy. Various aspects of constitutional histories within and outside of Europe are examined from a comparative, transnational, and multidisciplinary historical perspective, organized around five key themes. The first part looks at constitutions as anti-revolutionary devices, and addresses state building, monarchical constitutionalism, and restorations. The second part takes up constitutions and the justification of new social inequalities, focusing on women's suffrage, human rights, and property. The third part uses individual country studies to take on questions of how constitutions served to promote nationalism. The use of constitutions as instruments of imperialism is covered in the fourth part, and the final part examines the ways that constitutions function simultaneously as legal and political texts. These themes reflect a certain scepticism regarding any easy relationship between stated constitutional ideals and enacted constitutional practices. Taken together, they also function as a general working hypothesis about the role of constitutions in the establishment and maintenance of a domestically and internationally imbalanced status quo, of which we are the present-day inheritors. More particularly, this volume addresses the question of the extent to which nineteenth-century constitutionalism may have set the stage for new forms of domination and discrimination, rather than inaugurating a period of 'progress' and increasing equality.
