Book excerpt: This Master's thesis analyses the legal protection of software in China, in order to answer the questions, why the enforcement of the norms protecting software does not work effectively and why the piracy rate of software is so high in China. Firstly, the protection of intellectual property and software rights, in general and on an international level, are analysed, in order to build an understanding of the subject at hand. Secondly, the legislation protecting intellectual property rights in China is examined. Finally, an economic analysis supports the argumentation. The formal norms of software protection are corresponding to international standards and hardly inhibit the enforcement. The main reason for the ineffective enforcement is the fact that administrative and judicial authorities, which are in charge of enforcing software rights, are often understaffed, have low funding, are dependent on local governments and have little political power. Additionally, the enforcement is inhibited by corruption, local protectionism and lack of judicial personnel educated in the area of intellectual property rights.

Since the competitors don't have similar software, the SME believes the upgraded user interface could even lead to some new business. However, the more popular the software becomes, the higher the chances of it being copied. The company is well aware of the value of their IP and had already taken steps to protect their core IP. For example, the name of the product had already been registered as a trade mark in all the relevant classes and sub-classes. Nevertheless, it was the software protection that the SME was more worried about.
