Their task was to examine the role of Special Operations Forces (SOF) in combating transnational organized crime (TOC). The panelists and plenary participants set to work considering a wide range of issues attending to the TOC threat. After the Symposium concluded, panelists and speakers synthesized the results of their research and panel discussions in articles for publication-those articles are found in the chapters of this report of proceedings. The implication for SOF is they must continue to train to meet the strategic challenges ahead. This will require forward-deployed units that are engaged with their counterparts in host countries because TOC is both a threat to, and a result of, weak, emerging democratic governments that benefit from engagement. Readiness to conduct all SOF core activities will remain a priority.

Transnational organized crime is the principal security threat in Latin America. Beginning in the 1980s, US Special Forces partnered with national police units in Latin America. Initial efforts focused on countering drug trafficking. Today, efforts focus on Transnational Organized Crime. US strategy and policy documents identify this threat, and identify security assistance as one part of US strategy going forward. Yet, the literature record for US Special Forces training national police units to confront the threat is minimal. Thus this research focused on establishing a base for future research and identifying relationships useful to making future policy decisions. The primary research questions is: Why are some US Special Forces partnerships with Latin American national police units effective at countering transnational organized crime? This research encompasses three cases in which US Special Forces partnered with national police units to achieve this objective: Bolivia, Colombia, and Honduras. The cases examine the strategic environment, the units, and the independent and dependent variables. The research determines that the duration of the partnership and the degree of partner nation support are the two most important factors in developing national police units capable of targeting transnational criminal organizations. The first chapter describes the criminal threat, review US strategy, and explain US Special Forces role in security assistance. It will then explain the what, how, and why of this research. Chapter 2 will examine what has been written about TOC and Special Forces training police. Chapter 3 will describe the research design used to conduct this study and its strengths and weaknesses. This paper describes the nature of the post-cold war organized crime threat focusing on its military and paramilitary aspects. It notes that international criminal organizations resemble irregular forces. The paper examines national strategy documents relating to the fight against organized crime and advocates expanding the National Military Strategy and the International Crime Control Strategy to define more exactly the role of the Armed Forces. Next, the paper examines the Posse Comitatus Act and the many limitations and exceptions to the Act as well as legal framework related to that threat. The paper highlights how U.S. law has steadily expanded the direct and indirect role of the armed forces in combating crime, especially drug trafficking. After an ends-ways-means analysis this paper more specifically advocates: (1) Expanding the National Military Strategy to engage more directly the Department of Defense in the combating of international organized crime. (2) Assigning the United States Special Operations Command with a primary task of supporting the national effort to combat international organized crime. (3) Further amending Title 10 of the United States Code to authorize the direct, prescriptive participation of military forces in the combating of international organized crime, or in the alternative, repealing the Posse Comitatus Act. The paper closes by observing that it is only a matter of time before the Armed Forces role in combating international organized crime is expended even further.

This Strategy against this threat is "organized around a single unifying principle: to build, balance, and integrate the tools of American power to combat transnational organized crime and related threats to national security-and to urge our foreign partners to do the same". Along with an emphasis on this emerging threat, the U.S. national strategy addresses these problems by using a whole of government approach. Though the military will not take the lead in this effort, the role of the military will be one of support. The problem is how the U.S. military will effectively integrate with the strategy, or whether or not the military should be involved at all in this mission. The emergence of Regionally Aligned Forces for the military also presents a challenge for inter-cooperation amongst Combatant Commanders (COCOM), as TOC by its definition works beyond the boundaries of nation-states. If the military participates in a whole-of-government approach, the regional alignment of forces must be considered. Coordination will occur at the strategic level, and areas such as logistics and intelligence will require multiple coordinated efforts in order to be effective. This is normal during many different operations; the question is whether the cost-benefit is good enough to warrant such an effort.

The conference examined transnational threats, including terrorism involving weapons of mass destruction, cyber threats to the national infrastructure, and international organized crime. The goal was to evaluate the seriousness of such threats and discuss strategies for dealing with them. In particular, the conference sought to address the question of how military and law enforcement could blend their strategies to better counter transnational threats. A secondary purpose was to clarify the role of the military in meeting challenges that transcend national borders and threaten our national interests. This book highlights some of the main issues and themes that ran through the conference. After looking at the various threats and undertaking a risk assessment, the report considers the unique aspects of transnational threats, and then identifies the key challenges facing the United States, paying particular attention to the role of the military.
