Carlos Aguirre examines the evolution of prisons for male criminals in Lima from the conception—in the early 1850s—of the initial plans to build penitentiaries through the early-twentieth-century prison reforms undertaken as part of President Augusto Leguia’s attempts to modernize and expand the Peruvian state. Aguirre reconstructs the social, cultural, and doctrinal influences that determined how lawbreakers were treated, how programs of prison reform fared, and how inmates experienced incarceration. He argues that the Peruvian prisons were primarily used not to combat crime or to rehabilitate allegedly deviant individuals, but rather to help reproduce and maintain an essentially unjust social order. In this sense, he finds that the prison system embodied the contradictory and exclusionary nature of modernization in Peru. Drawing on a large collection of prison and administrative records archived at Peru’s Ministry of Justice, Aguirre offers a detailed account of the daily lives of men incarcerated in Lima’s jails. In showing the extent to which the prisoners actively sought to influence prison life, he reveals the dynamic between prisoners and guards as a process of negotiation, accommodation, and resistance. He describes how police and the Peruvian state defined criminality and how their efforts to base a prison system on the latest scientific theories—imported from Europe and the United States—foundered on the shoals of financial constraints, administrative incompetence, corruption, and widespread public indifference. Locating his findings within the political and social mores of Lima society, Aguirre reflects on the connections between punishment, modernization, and authoritarian traditions in Peru.

Book excerpt: In this sweeping history of reproductive surgery in Mexico, Elizabeth O'Brien traces the interstices of religion, reproduction, and obstetric racism from the end of the Spanish empire through the post-revolutionary 1930s. Examining medical ideas about operations (including cesarean section, abortion, hysterectomy, and eugenic sterilization), Catholic theology, and notions of modernity and identity, O'Brien argues that present-day claims about fetal personhood are rooted in the use of surgical force against marginalized and racialized women. This history illuminates the theological, patriarchal, and epistemological roots of obstetric violence and racism today. O'Brien illustrates how ideas about maternal worth and unborn life developed in tandem. Eighteenth-century priests sought to save unborn souls through cesarean section, while nineteenth-century doctors aimed to salvage some unmarried women's social reputations via therapeutic abortion. By the twentieth century, eugenicists wished to regenerate the nation's racial profile, in part by sterilizing women in public clinics. The belief that medical interventions could redeem women, children, and the nation is what O'Brien refers to as "salvation though surgery." As operations acquired racial and religious significances, Indigenous, Afro-Mexican, and mixed-race people's bodies became sites for surgical experimentation. Even during periods of Church-state conflict, O'Brien argues, the religious valences of experimental surgery manifested in embodied expressions of racialized, and often-coercive, medical science.

The authors argue that even before the process of arrest, trial, and sentencing, the system is biased against the poor in what it chooses to treat as crime. The authors show that numerous acts of the well-off--such as their refusal to make workplaces safe, refusal to curtail deadly pollution, promotion of unnecessary surgery, and prescriptions for unnecessary drugs--cause as much harm as the acts of the poor that are treated as crimes. However, the dangerous acts of the well-off are almost never treated as crimes, and when they are, they are almost never treated as severely as the crimes of the poor. Not only does the criminal justice system fail to protect against the harmful acts of well-off people, it also fails to remedy the causes of crime, such as poverty. This results in a large population of poor criminals in our prisons and in our media. The authors contend that the idea of crime as a work of the poor serves the interests of the rich and powerful while conveying a misleading notion that the real threat to Americans comes from the bottom of society rather than the top. Even contemporary actors of violence are framed by narratives that harken back to old images of the rural bandit, either to legitimize or delegitimize violence, or to intervene in larger conflicts within or between nation-states. However, the bandit seems to escape a straightforward definition, since the same label can apply to the leader of thousands of soldiers (as in the case of Villa) or to the humble highwayman eking out a meager living by waylaying travelers at machete point. Dabove presents the reader not with a definition of the bandit, but with a series of case studies showing how the bandit trope was used in fictional and non-fictional narratives by writers and political leaders, from the Mexican Revolution to the present. By examining cases from Argentina, Brazil, Mexico, Peru, and Venezuela, from Pancho Villa's autobiography to Hugo Chavez's appropriation of his "outlaw" grandfather, Dabove reveals how bandits function as a symbol to expose the dilemmas or aspirations of cultural and political practices, including literature as a social practice and as an ethical experience.
