La sociedad nueva empresa es fruto de las iniciativas comunitarias tendentes simplificar el procedimiento de fundación de sociedades. Más específicamente, de la Recomendación 97/344/CE de la Comisión, de 22 de abril de 1997, sobre la mejora y simplificación de las condiciones para la creación de empresas; del Plan de acción para promover el espíritu empresarial y la competitividad, conocido como Plan de acción BEST; y de la Carta Europea de la Pequeña Empresa. A través de la sociedad nueva empresa, el legislador ha procurado facilitar el proceso de fundación, incidiendo en la resolución de todos aquellos problemas que suponen una importante barrera para los emprendedores que deciden iniciar una actividad empresarial. De ahí que la Ley 7/2003 haya completado el régimen jurídico de la sociedad nueva empresa con otros elementos destinados a facilitar la creación de empresas y el cumplimiento de las obligaciones que la legislación societaria impone a los empresarios. Todos ellos reciben un tratamiento pormenorizado en este libro.

Book excerpt: This paper estimates the economic effects of a recent reform that simplified business entry regulation in Mexico. The reform was introduced in different municipalities at different points in time. Using microlevel data, I find that the reform increased the number of registered businesses by 5%. This increase was due to former wage earners' opening businesses. Former unregistered business owners were not more likely to register their business after the reform. The reform also increased wage employment by 2.2%. Finally, the results imply that the competition from new entrants decreased the income of incumbent businesses by 3%.
